COUNTY OF BALDWIN �
The City Council, City of Fairhope, met in regular session at
7:00 p.m., City Administration Building, 387 Fairhope Avenue, Fairhope,
Alabama 36532, on Monday, 13 August 1979.
Present were Mayor James P. Nix; Councilmembers David Ed Bishop,
Jack A. Stipes, Trisha Nelson, Sam E. Box, Sr., and C.O. McCawley;
City Attorney John Duck and City Clerk Evelyn Phillips.
Minutes of 23 July 1979 regular session were duly approved.
Mayor Nix opened the following single bid received on roof work to;
be done at Fisherman's Wharf:
Robert Coma.lander, Jr., General Contractor, Fairhope, Al.
$1,450 to remove & dispose of existing roof, and replace
same; Cost-plus basis on board replacement: 7.50 per hour,
1070 of materials cost.
Councilman Stipes moved to take the bid under advisement. Seconded by
Councilman Bishop, motion passed unanimously.
Only one bid was received on the obsolete vehicles advertised for
sale:
$150.01 by Marii Ziegler on the 1958 Chevrolet 235
Pickup Truck, 6 cylinder.

Councilman Bishop moved to accept this offer. Seconded by Councilman
Stipes, motion passed unanimously. .;I
This being the date set for a Public Hearing on Restaurant Liquor
License application by Harold Parker and Maxine Ward, dba MAX'S CAFE
AND LOUNGE, Mayor Nix asked if there was anyone present to oppose this ,
application. There was no opposition when it was explained this license•
will replace a current license, replacement being necessary due to
a change in the owners of the establishment. Proof of Publication was
presented. Councilman Stipes moved to approve the application. Seconded
by Councilman McCawley, motion passed unanimously.
A Public Hearing was also held on an Off Premises Beer License
application by Albert Rodgers, dba RODGERS PACKAGE STORE. There was no
one present in oppostion to the application. Proof of Publication was
presented. Councilman Stipes moved to approve the application. Seconded
by Councilman Box, motion passed unanimously.
Mayor Nix advised Council of the need to appoint a Councilmember to
the Planning & Zoning Commission and, also, to the Airport Board. Council-
man Bishop nominated Councilman Stipes for the Planning & Zoning Commission:
Councilman. Box moved the nominations be closed. Seconded by Councilman
Bishop, motion passed unanimously. There being no other nominations,
Councilman Stipes was appointed to serve from the present until 30 September
1980-
Councilman Stipes nominated Councilman McCawley for the Airport Board.
Councilman Bishop moved the nominations be closed. Seconded by Council-
man Box, motion passed unanimously. There being no other nominations,
Councilman McCawley was appointed to serve from the present until 30
September 1980.
Councilman Stipes moved to construct a short sidewalk from Bancroft Street
to Section Street which would only require approximately 4 or 5 cubic yards
of concrete. Seconded by Councilman Bishop, motion passed unanimously.
Councilman Stipes also asked that the City's portion of the sidewalk in
front of the Eastern Shore Courier office, and a portion of the sidewalk
near Price Furniture Store where a drainage pipe is located, be checked
for any needed repair work.
Councilman Stipes moved that application be made to the Coastal Area
Board for a $52,000 comprehensive drainage plan grant. Councilman Stipes
explanied the City would be responsible for 20%, or $10,400, and the
Single Tax Colony has agreed to pay half of this amount. Councilman Box
seconded the motion to make the application. Motion passed unanimously.
Councilman. Bishop introduced, and moved for the adoption of, the
following Resolution. Seconded by Councilman Stipes, motion passed
unanimously
RESOLUTION
BE IT RESOLVED BY THE MAYOR AND COUNCIL OF THE CITY OF FAIRHOPE,
ALABAMA, that said.governing body fully supports Thomas Hospital in their
efforts to obtain additional Hospital Bed allowances, said additional,.
beds being necessary for the care and well-being of the Citizens -of Fairhope`-.
and surrounding environs being served by Thomas Hospital,
ADOPTED THIS 13th DAY OF AUGUST, 1979.

Mayor Nix said copies of this resolution will be mailed to all our Congress-
men., Senators, and members of the Board who would rule upon the Hospital's
request for additional beds.
Councilman Stipes introduced, and moved for the adoption of, the following
resolution. Seconded by Councilman Bishop, motion passed unanimously:
RESOLUTION
BE IT RESOLVED BY THE MAYOR AND COUNCIL OF THE CITY OF FAIRHOPE that the
following persons be and are hereby authorized to sign 'checks and conduct
all City business with the First National Bank of Fairhope and Merchants
National Bank, Mobile, until such authorization be revoked by this body:

the Mayor or City Clerk is not available.

Councilman Box moved to set tax millage at 15 mills, as it is now.
Seconded by Councilwoman Nelson, motion passed unanimously.
On the Mayor's question, Councilman Box moved to hear a vacation of
easement request not on the Agenda. Seconded by Councilman Stipes, motion
passed unanimously.
Property owners Wanda Henry and Phyllis Nesbitt presented a letter'
requesting the vacation of an easement. City Attorney John Duck explained
to them there is a legal method by which this request has to be presented
to Council. The request will be presented at the next meeting in the
proper way.
On request, Councilman Stipes moved to hear Library business not on
the Agenda. Seconded by Councilman McCawley, motion passed unanimously.
Councilman Bishop advised that he wished to present the Library's proposed
79-80 budget. A general discussion began between other Library Board
members, and friends, in the audience. The Mayor asked Councilman Bishop
to continue. Councilman Bishop read the budget which totaled 878,430.00.•
After more discussion, Councilman Box moved that the Library operate on
last year's budget, not to exceed $58,100, for the next fiscal year.
Seconded by Councilwoman Nelson, motion passed with one abstention by Council-
man Bishop.
On request, Councilman Bishop moved to hear a request for an Ordinance
not on the Agenda. Seconded by Councilman Stipes, motion passed unanimously.
Councilman Stipes stated he was still concerned about dunpting materials
in gullys and that he would like to move to have the City Attorney prepare an
Ordinance against this dumping. After some discussion, the consensus seemed to
be that present littering and trash dining Ordinances covered the problem, -
Councilman Stipes withdrew his motion.
Meeting was duly adjourned.
