STATE OF ALABAMA
COUNTY OF BALDWIN
The City Council, City of Fairhope, met in regular session at 7:00 p.m.
City Administration Building, 387 Fairhope Avenue, Fairhope, Alabama, on
Nbnday, 25 June 1979.
Present were Mayor James P. Nix; Councilmen. David Ed Bishop, Sam E.
Box, Sr., and Jack A. Stipes; City Attorney John Duck; and City Clerk
Evelyn P. Phillips.
(It is noted that all unanimously -passed motions in .these minutes
indicate an "aye" vote by all three Councilmen and the Mayor)
Minutes of 11 June 1979 regular session were duly approved.
Councilman Box moved to accept the bid by Steber Chevrolet -Olds
for'$6,594.95 on a truck for the Gas Department, bids having been
opened at the last regular session and held for study until this time.
Seconded by Councilman Stipes, motion passed unanimously.
Counci]man'Bishop moved to accept the $6,500 Performance Bond
on Windmere Place, a James L. Shores development. Seconded by Council-
man Box, motion passed unanimously.
Mayor Nix reported that Transmissions Unlimited is interested in pur-
chasing approximatly 5 acres of City -owned land adjacent to their location
on Pecan Street. Councilman Box moved to advise them that the
City is agreeable to discussing the possible sale. Seconded by Councilman
Stipes, motion passed unanimously.'
Mayor Nix stated that the usual procedure is to appoint an appraiser
for the City to appraise the property. The party interested in purchasing
the property is to also have an appraisal prepared. When this information
is obtained, the City and the purchasing party then meet and discuss the
sale: Councilman Box moved to appoint Mr. Arthur Mannich, of M=Ach
Realtors, to serve as the City Appraiser. Seconded by Councilman Stipes,
motion passed unanimously.
Councilman Stipes moved to authorize the Mayor to suggest to the Planning
& Zoning Commission certain standards or a written policy to be referred to
in regard to requests by developers outside the City Limits for any or all
City Utility tie-ins. Seconded by Councilman Bishop, motion passed unanimously.
Councilman Stipes asked that all City departments be asked'to curtail
equipment useage due to the present gasoline shortage. Mayor Nix reported
that he had already done this.
Councilman Box moved to authorize the City Attorney to begin legal
proceedings toward obtaining a Declaratory Judgement as to what rates can
be charged the City of Daphne when their gas useage exceeds 10;0 of total
gas volume purchased from United Gas Pipe Line Company. Seconded by Council-
man. Stipes, motion passed unanimously.

25 June 1979 minutes
Mayor Nix advised Council that, as of July 1979, local establishments
which now purchase liquor in miniatures or half-pint bottles would have
the option of purchasing liquors in any size containers available. The,
Council will study what effect this new ruling by the ABC Board will have
in our licensing and taxing ordinances.
Under old business, Councilman Stipes asked what decision had been
reached to aid Mr. Larry Kerr's drainage -drive problem on Michigan Street.
Mayor Nix said the City was going to smooth and level -out the slight rise
over the present drainage pipe in Mr. Kerr's drive to see if this will
solve the problem.
Mayor Nix reported that a representative of the Mitchell Company had
met with our City Engineers and that they planned to replace the length of
Spring Rum where their trucks had caused damage.
Mayor Nix and City Attorney John Duck are working on the problem
that has arisen in connection with a Flood Project contractor, Delta
Plumbing Company, and Internal Revenue. Delta has not completed all the
work they contracted for,the Harbor Board will not accept some of their completed
work in Fly Creek, and the Internal Revenue Service has levied against
any monies now due Delta. At present, things are at a stand -still.
Councilman Stipes asked that the County be requested to use a mosquito-fogger
in our area.
Mayor Nix made a brief statement regarding the forth -coming -appointments
to the Council to fill the unexpired terms of former Council members Henry
Bishop and Don Wiggins. Mayor Nix stated that all possible haste is being
made toward filling the vacancies, however, these appointments could not be made
without due deliberation and careful thought.
