The City Council, City of Fairhope, met in regular session at 7:00 p.m.
City Adninistration Building, 387 Fairhope Avenue, Fairhope, Alabama 36532,
Monday, 11 June 1979.
Present were Mayor James P. Nix; Councilmen Jack A. Stipes, Sam E. Box,Sr.,
and David Ed Bishop; City Clerk Evelyn Phillips and City Attorney John Duck.
(It is noted that all unanimously passed motions in these minutes indicate
an "aye" vote by all three Councilmen and the Mayor.)
Minutes of 28 May regular session and 31 May special session were duly
approved.
By unanimous consent, the Council reconsidered the application of Cuylar
& Alice Volking for an Off -Premises Beer License for the D-MART, located at
the corner of Highway 98 and Marlow Road, which had been denied due to lack
of a second to an approving .motion on May 28th. Councilman. Stipes moved for
approval of the application. Seconded by Councilman Box, motion passed unan-
imously.
Mayor Nix reported that an 80-20 grant is available to fund a comprehensive
drainage plan study. Councilman Stipes moved that he be authorized to meet
with the Fairhope Single Tax Corporation to discuss their participation with
the City on this project before grant is applied for. Seconded by Councilman
Box, motion passed unanimously.
Mr. Art Regas, Ponder Engineering Company, developers of Carmel Square,
met with Council regarding sewer hookup. This development is outside the
City Limits. Mr. Regas reported the location change of a pumping station,,
required by the Planning & Zoning Board, and asked for permission to hookup at this time.
Councilman Box advised Mr. Regas that the sewer plans were in order, however,
further discussions with the Planning & Zoning Board regarding land use would
be required before Council could give approval of the sewer hookup.
Councilman Box said he would like to have a resolution setting up require-
ments on sewer and water connections for reference when these questions come up.
This will be discussed for later action.
Mrs Carol Saltz came before Council with a request to hookup to a sewer
line near Middle School. She is also located outside the City Limits. Council-
man Stipes moved to authorize Councilman Box to take Ms. Saltz's request under
study, to meet with City Engineers, and to either approve or delay Ms. Saltz's
request, provided that all expense of the hookup is borne by Ms. Saltz, and re-
port back to Council what action was taken. Seconded by Councilman Bishop,
motion passed unanimously,
Mayor Nix reported that, due to the loss of a pickup truck in an accident
last week, he had asked for bids on a vehicle to replace this truck. Councilman
Box moved to open the bids. Seconded by Councilman Stipes, motion passed unan-
imously. Bids were received from Gaston Motor Company, Steber Chevrolet Company,
and Thomas Pontiac-GMC Company; however, none of the vehicles could meet City
Specifications. Councilman Bishop moved to take the bids under consideration
for action at a later time. Seconded by Councilman Stipes, motion passed unan-
imously.
With unanimous consent of the Council, the following items of business
were allowed, though not on the Agenda.
Councilman Stipes read a letter from Mr. Larry Kerr about a drainage
problem at his home on Michigan Avenue. Councilman Stipes, City Superintendent
Phil Rutherford and CETA engineer Mr. Clark were asked to meet with Mr. Kerr
to see what could be cone to correct his problem. ,
The Mitchell Company asked if there was any objection to their adding
32 Units to the Low -Income Housing Development they are constructing on Spring
Run. Councilman Stipes moved to advise them there was no objection. -Seconded
by Councilman Bishop, motion passed unanimously.
Councilman Box introduced the following Resolution. Councilman Bishop
moved for its adoption. Seconded by Councilman Stipes, motion passed unanimously.
RESOLUTICN
WHEREAS, the City of Fairhope proposes to construct projects for the
abatement of water pollution consisting of wastewater treatment works, and -
WHEREAS, Title II regulations (40 CFR 35.917) require facilities planning
as an element of the construction of publicly owned wastewater treatment works, and
WHEREAS, the City of Fairhope is eligible for Federal grant assistance
under Title II of PL 92-500,
NOW THEREFORE IT IS RESOLVED that the City prepare and submit an applic-
ation to the EPA for a Step I grant for the preparation of a Facilities Plan.
IT IS FURTHER RESOLVED that James P. Nix, Mayor for the City of Fairhope
is authorized to execute all forms, applications, and contracts, on behalf of
the City for this project, and that henceforth all documents so executed will
be valid and will reflect the intentions of the City of Fairhope.

Councilman Box moved to amend the above resolution's last paragraph
as follows ........ all forms, applications, AND CONTRACTS on......", the change
being the addition of the words "and contracts". Seconded by Councilman Stipes
motion passed unanimously.
Councilman Bishop moved to pay bills as presented. Seconded by Councilman
Stipes, motion passed unanimously.

Councilman. Stipes moved to add a strip of sidewalk an the east side of Section
Street from Magnolia to the old Steber Chevrolet building to the Sidewalk Project
now being done by the CETA crews. Seconded by Councilman Bishop, motion passed
unanimously.
City Engineer, Ack Moore, was asked to report on street and drainage problems at
the next Council meeting.
