HomeMy WebLinkAbout05-28-1979 Regular Meeting73 STATE OF AIABAMA COUNTY OF BALDWIN The City Council, City of Fairhope, met in regular session at 7:00 p.m. City Administration Building, 387 Fairhope Avenue, Fairhope, Alabama 36532, on Monday, 28 May 1979. Present were Mayor James P. Nix; Councilmen Henry G. Bishop, Sam E. Box, Billy Don Wiggins, Jack A. Stipes, and David Ed Bishop; City Attorney John Duck, and City Clerk Evelyn Phillips. Minutes of the 14 May 1979 regular session were duly approved. A public hearing of Cuylar & Alice Volking's application for an Off -Premises Beer License for the D-MART located on Highway 98 and Marlow Road in Point Clear was held. No one present was opposed to the application. Proof of publication was presented. Councilman Stipes moved for approval, no one seconded. Application denied. A public hearing of Pauline I. Tate's application for a Retail Beer ;h License for the T & M QUICK STOP located on South Greeno Road was held. No one present was opposed to the application. Proof of publication was presented. Councilman Box moved for approval, no one seconded. Application denied. Councilman Box moved for final adoption of ORDINANCE NO. 638, an Ordinance amending Ordinance No. 512 increasing Court Costs for moving violations from $9.00 to $13.00 and all other Court Costs from $12.00 to $16.00. Seconded by Councilman Ed Bishop, motion carried with one abstention by Councilman Wiggins. • f Councilman. Stipes moved for final adoption of ORDINANCE NO. 639, an Ordinance to provide for the City to use .any and all meter deposits to apply toward any unpaid utility bill in arrears over 60 days, with due notice, and to require new deposits to be made, and'any unpaid balance be satisfied, when and if reconnection is requested. Seconded by Councilman Box, motion carried with one abstention by Councilman Wiggins. Mrs. Harriet Otteson, President of the Fairhope Garden Club, read the following letter as spokesman for all four local Clubs. Mayor Nix thanked Mrs. Otteson and other members of the Clubs for bringing this information to the Council and asked their assistance in carrying out their proposals. Councilman Box moved to have the letter included in the minutes. Seconded by Councilman. Henry Bishop, motion carried with one abstention by Councilman Wiggins: Gentlemen: The memberships of the Fairhope, Dogwood, Sundial and Wisteria Garden Clubs feel that some positive steps in sigh control should be forthcoming. After defeat of the additions to the existing ordinances which were proposed by your appointed commission, we strongly urge that you enforce those regula- tions that are already law. Present regulations forbid: flaming colored lights associated with signs. use of public rights -of -way for any signs whatsoever. blocking of intersections or traffic visa- bility by signs. ,'' (28 May 1979) 74 Any permanent outdoor advertising sign in residential zoned areas. Any signs attached to trees, utility poles or fences. Any sign which is no longer functional remaining more than 30 days. Any sign not being maintained. We pledge ourselves to aid city officials in noting existing signs with an eye to enforcement. Councilman Box advised the Council that he had resigned from the Planning & Zoning Board. Mayor Nix said an appointment to fill the position on the .Board would be made at the next regular Council session and reminded Council that a Councilman would be appointed. Mayor Nix opened bids on a Leaf Vacuum. Tieco & Company of Pensacola and Truck Equipment Company of Birmingham submitted several bids on various sizes and types of Vacuum. Councilman Stipes moved that he and City Superintendent Rutherford meet and study the bids and recommend action to the Council. Seconded by Councilman Ed Bishop, motion carried with one abstention by Councilman Wiggins. Mr. Pope of Major Homes, Inc., came before Council to report the completion of the work in Paddock Estates relative to the drainage problem. Councilman Stipes moved to revoke the Council's suspension on Building Permits for Mr. Pope when City Superintendent Rutherford confirms the work is complete and the area has been resodded. Seconded by Councilman Box, notion carried with one abstention by Councilman Wiggins. Councilman Stipes moved that the City Attorney be required to attend all Board meetings. Seconded by Councilman Ed Bishop, motion carried with one abstention by Councilman Wiggins. Councilman Stipes reported that he had met with a State Highway Department official regarding the erosion of the roads at two intersections, one on Section Street and one on Morphy Avenue. An estimate of the cost to repair the wads will be sent to Councilman Stipes; and the City and the County will have to share the repair costs if repairs are authorized. Countihnan Stipes moved to obtain information about funding for a comprehensive drainage plan through the Coastal Area Board. Seconded by Councilman Ed Bishop, motion carried with one abstention by Councilman Wiggins. 6� Councilman Stipes moved to -approve a supplemental agreement between Fairhope and Daphne relative to curtailment and penalty for overusage of gas imposed an United Gas Pipe Line Company by the Federal Energy Regulatory Commission. The agreement would spell out how penalty would be paid, if imposed. Seconded by Council- man Box, motion carried with one abstention by Councilman Wiggins. Councilman Stipes intr_tduced, and moved for adoption of, the following Resolution. Seconded by Councilman Ed Bishop, motion carried with one abstention by Councilman Wiggins: (28 May 1979) RESOLUTION BE IT RESOLVED the Mayor and Council of the City of Fairhope requests that the City of Fairhope be given every consideration as a possible site for the location of a new County Courthouse or Courthouse Annex if and when a site is selected. ADOPTED THIS 28th day of May, 1979 Q . - City C With unanimous consent of Agenda were acted upon. /, r the following items not on the Councilman Ed Bishop moved to approve the Recreation Board's decision to let the bid on light poles for Stimpson Field to the next lowest bidder due to the low bidder's inability to deliver. Seconded by Councilman Stipes, motion carried with one abstention by Councilman Wiggins. rii Mr. Gary Sandell advised Council of an 8-hour CPR Training Course sponsored by the American Heart Association available to City employees at no cost. Councilman Stipes moved that the course be offered to employees. Seconded by Councilman Ed Bishop, motion carried with one abstention by Council- man Wiggins. Mayor Vix announced that he had received letters of resignation from Councilmen Henry G. Bishop and Billy Don Wiggins. The resignations were duly accepted, with reluctance and expressions of deep appreciation for their hard work and devotion to duty being made by the remaining Council. Meeting was duly adjourned..
