HomeMy WebLinkAbout05-14-1979 Regular Meeting70 STATE OF ALABAMA COUNTY OF BALDWIN X The City Council, City of Fairhope, met in regular session at 7:00 p.m. City Administration Building, 387 Fairhope Avenue, Fairhope Alabama 36532, on Monday, 14 May 1979. Present were Councilmen Henry G. Bishop, Sam E.-Box, Sr., Jack A. Stipes, and Ed Bishop; City Attorney John Duck; and City Clerk Evelyn P. Phillips. Mayor James Nix was in Huntsville attending the League of Municipalities Convention and Councilman Billy, Don Wiggins was also absent. Councilman Henry Bishop moved to authorize Councilman Stipes to act as Chairman Pro Tempore. Seconded by Councilman Box, motion passed unanimously. Mr. Albert Norquist asked if Councilman Stipes could vote in this position and City Attorney Duck said he could but not if his vote caused a tie -vote. ?? Minutes of the 23 April regular session and the 9 May special session were duly approved. Councilman Box introduced the following Resolution. Councilman Henry Bishop moved for its adoption. Seconded by Councilman Ed Bishop, motion passed unanimously: RESOLUTION WHEREAS, Municipal Clerks have contributed much to the proper running and smoothness of City Government, and WHEREAS, Municipal Clerks work long and hard to carry out their assigned duties, diverse as they may be, and. WHEREAS, many States, Counties, and Cities all over the nation are joining together to specially recognize the men and women who serve as a vital link between the Public and its elected officials, NOW THEREFORE BE IT RESOLVED, that the City of Fairhope is proud to join in this national recognition by proclaiming the week of May 13-19, 1979, as MUNICIPAL CLERKS WEEK. Chairman Stipes reported tha-e only one bid had been received on the hauling contract(to haul garbage transfer trailer to landfill in Magnolia Springs). City Superintendent Phil Rutherford stated y71 (14 May 1979) no specifications had as yet been agreed upon in order to request bids in the proper manner. Councilman Box moved that the one bid be returned and that Superintendent Rutherford and Councilman Stipes meet to work up the specifications and advertise for bids. Seconded by Councilman Ed Bishop, motion passed unanimously.. Councilman Box reported the need for a second Leaf Vacuum and moved to request bids for same, diesel -powered and gasoline -powered. Seconded by Councilman Ed Bishop, motion passed unanimously. City Superintendent Phil Rutherford was asked to write a letter to the Mitchell Corporation about street damage on Spring Run caused by heavy trucks traveling to their development in that area. Councilman Box moved for acceptance of $69,000 Performance Bond on Richmond Square by Eastern Shore Builders, Inc. Seconded by Coun- cilman Henry Bishop, motion passed unanimously. Councilman Box introduced the following Resolution. Councilman Henry Bishop moved for adoption. Seconded by Councilman Ed Bishop, motion passed unanimously: RESOLUTION BE IT KNOWN TO ALL MEN, the City Council of the City of Fairhope, Alabama, does hereby present the following resolution having been duly considered and approved at the regularly scheduled meeting of May 14, 1979. WHEREAS, the City of Fairhope, Alabama supports, endorses and approved public education and educational pursuits of its -residents. WHEREAS, the City of Fairhope recognizes the evening courses offered by James H. Faulkner State Junior College at Fairhope High School having added to the educational, cultural and economic enrichment of its residents and residents of surrounding environs and WHEREAS, the City of Fairhope gives due recognition to the need for its residents to have opportunities to continue their education within the parameters and economies of their personal time, vocational endeavor and money. NOW THEREFORE BE IT RESOLVED, the City of Fairhope does herely favor, support, encourage and endorse the continuing of the educational activity at Fairhope High School of the Fairhope Center of James H. Faulkner State Junior College. ADOPTED this 14th day of 72 (14 May 1979) Councilman Box introduced an ORDINANCE TO MUTD ORDINANCE No. 512, changing Court Costs on all traffic cases from $9.00 to $13.00 and all cases from $12.00'to $16.00. Councilman Ed Bishop reported a price had been received from Riviera Utilities in the amount of $10,235.64(four times annual revenue), less $1,028.06 depreciation, net cost $9,207.58 for customer American Woodcrafters, Inc. Councilman Ed Bishop moved to purchase the customer. Seconded by Councilman Box, motion passed unanimously. Councilman Henry Bishop asked Councilman Ed Bishop to determine whether or not a letter to discontinue the 1964 contract with Riviera Utilities had been written as yet and to to report to Council. Councilman Box read a letter from United Gas Pipe Line Company stating gas price would increase approximately $.57 per thousand cubic feet effective 1 July 1979. Councilman Box then moved that this information be turned over to Consultant St.John Engineering Company for study and recommendations as to a possible gas rate increase to City customers. Seconded by Councilman. Ed Bishop, motion passed unan- imously. Councilman Ed Bishop moved to retain the services of Attorney Charles Arendall and Firm to work with City Attorneys Duck and Kopesky. Seconded by Councilman Box, motion passed unanimously. Chairman Stipes asked for permission to bring up subjects not on the Agenda. Councilman Henry Bishop so moved,seconded by Council- man Box, motion passed unanimously. Councilman Box introduced an ORDINANCE TO PROVIDE FOR THE USE �+ OF ANY AND ALL UTILITY DEPOSITS ON ACCOUNTS M ARREARS FOR OVER 60 ' DAYS, WITH DUE NOTICE TO OVERDUE CUSTOMER, AND WITH THE REQUIREMENT THAT SUCH A CUSTOMER WOULD HAVE TO FIRST SATISFY ANY REMAINING OVER- DUE AMOUNT AND MAKE NEW DEPOSITS IN ORDER TO HAVE SERVICE RECONNECTED. Councilman Box moved to authorize City Attorney John Duck to draft a Prostitution Ordinance modeled on the one used in Mobile, Alabama., as requested by the Police Department. Seconded by Council- man Ed Bishop, motion passed unanimously. City Superintendent Phil Rutherford was asked to check the steps at the end of Perdido Street. Mr. Albert Norquist reported that the top part of the steps had been repaired(part of the flood damage repairs) but the bottom half was unsafe and dangerous.
