The City Council, City of Fairhope, met in regular session at 7:00 p.m.,
City Administration Building, 387 Fairhope Avenue, Fairhope, Alabama,on
Monday, 23 April 1979.
Present were Mayor James P. Nix, Councilmen Ed Bishop, Jack A. Stipes,
Sam E. Box, Sr., and Henry G. Bishop; City Attorney John Duck and City
Clerk Evelyn P. Phillips. Absent - Councilman Billy Don Wiggins.
Minutes of 9 April regular session and 18 April special session
were duly approved.
Mr. St. John of St. John Engineering, Consultants,,advised Council of
cost to run electrical service to Pump #2. Original estimate of $25,000
can be reduced to approximately $13,000. Increased use of the Pump further
recommended the service be installed, according to Mr. St. John.
Councilman Ed Bishop moved to authorize Electrical Superintendent Aaron
Norris to proceed with the work. Seconded by Councilman Box, motion passed
unanimously.
Mayor Nix opened a number of bids on inns for the Electrical Department
-Transrupter, disconnect seitches, steel, and Gang Switches.
Councilman Ed Bishop moved the bids and specifications be turned over to
Superintendent Norris and Engineer St. John for study as to which met their
specifications and authorize them to accept the lowest acceptable bid.
Seconded by Councilman Stipes, motion passed unanimously.
Mayor Nix advised Council that the County Board of Equalization nomin-
ations made at the April 9th regular session would be for the unexpired
term of a Mr. Bob Faust of Foley. New nominations were needed for the
next term. Councilman Stipes moved to resubmit the same three nominations.
Seconded by Councilman Ed Bishop, motion was defeated by three NAY votes:
Councilmen Henry Bishop, Councilman Box, and Mayor Nix.
Councilman Stipes then nominated Mr. Robert J. Potter, Councilman
Henry Bishop nominated Mr. Sam Dyson, and Councilman Ed Bishop nominated
Mr. Isadore Reynolds. Councilman Stipes moved the nominations be closed.
Seconded by Councilman Henry Bishop, motion passed unanimously.
Councilman Box reported on the Study to Prepare a 201 Wastewater
Facilities Plan for the City of Fairhope. This involves sewerage only.
The recommendation was, and was so moved by Councilman Box, to negotiate
a contract for the Step 1 Plan only. Seconded by Councilman Henry Bishop
motion passed unanimously.
Councilman Stipes brought a problem about trash and garbage being
thrown on a side road near the City Garage on South Section Street to the
attention of the Council. Councilman Stipes said he would contact the State
Highway Department about this. Council agreed this would be the proper action.

Mr.. Jack Pope, Major Homes, Inc, brought a sample Restrictive Covenant
form to Council in regard to the maintenance of the superstructure of a
Covered Bridge over a city street in Covered Bridge Estates for Council
approval. The covenant stated that Major Homes would be responsible for
five years, then the City would maintain the covered bridge and assess the
property owners for th maintenance. Council disagreed with this and
Councilman Ed Bishop moved that the covenant be changed to read that after
the five years, maintenance by the City would be billed to an Association -
an association to be formed by the property owners to conduct this business -
with the responsibility of assessments and collections resting on the
Association of property owners rather than on the City. Councilman Stipes
seconded this motion which passed unanimously.
Councilman Stipes moved that bids on hauling the garbage transfer
trailer to the Magnolia Springs landfill be obtained. Seconded by'Councilman
Box, motion passed unanimously.
WABB, Inc, requested permission to hold a promotional project, called
WABB-97 ROCK JET SKI DAY, at the Fairhope Municipal Pier area. Councilman
Henry Bishop moved to deny the request. Seconded by Councilman Box, motion
passed unanimously.
Mr. Gary Sandell, Fairhope Ambulance Service, came before Council with
a plan whereby the City would purchase an Ambulance Rescue Unit with equip-
ment which would be leased to Fairhope Ambulance at a nominal fee. The
equipment can be.purchased through a 50/50 grant program of the Alabama
Office of Highway and Traffic Safety. Mr. Jim Harris, formerly employed
by this State agency, further explained this grant program whereby an
agency such as a Municipality could purchase the Rescue Unit by paying
half the cost and the Office of Highway & Traffic Safety paying half.
The City cools own the Unit and lease it to the Fairhope Ambulance Service.
Mr. Sandell would pay the City for its share of the purchase price thereby
no finds would be required of the City. Councilman Stipes moved to approve
this plan and authorize Mr. Sandell to go ahead with his application for
the grant. Seconded by Councilman Ed Bishop, motion passed unanimously.
Mayor Nix asked that a further stipulation be added to the Resolution
passed April 9th regarding the Vacation of a Right -of -Way at corner of
Section & Seminole Streets. The stipulation would be an agreement that
the VFW Sign would remain where it is now located as long as the VFW Club
remains in its present location. Councilman Henry Bishop moved for approval
of this stipulation. Seconded by Councilman Box, motion passed unanimously.
Councilman Box moved to hear business not on the Agenda regarding an
appointment to the Board of Adjustments to fill an unexpired term. Mr.
Victor Altamirano resigned from the Board due to his moving out of town.
Seconded by Councilman Henry Bishop, motion passed unanimously. Mayor
Nix nominated Mr. Claude Puckett for the unexpired term. Councilman Box
moved that nominations be closed. Seconded by Councilman Stipes, motion
passed unanimously.
Councilman Henry Bishop moved to pay bills as presented. Seconded by
Councilman Ed Bishop, motion passed unanimously.
Councilman Box asked Mr. Jack Kirk to have the time clock in the City
Hall repaired.

Councilman Box moved to hear business not on the Agenda regarding the
Fairhope Public Library. Seconded by Councilman Ed Bishop, motion passed
unanimously.
Mayor Nix made a brief statement to the effect that certain actions
on the part of the present Library Board had made it necessary for the
City Council to take action which, though unpleasant, they found to be
a duty as duly elected Officials of all the people of Fairhope.
Councilman Box introduced Ordinance No. 636, an Ordinance repealing
Ordinance No. 325-, also known as Section 14A-1 through 14A-7 of the Code
of Ordinances of the City of Fairhope(said Ordinance No. 325 created
the Fairhope Public Library.)
Councilman Box then moved to suspend the rules for immediate consider-
ation of Ordinance No. 636. Seconded by Councilman. Stipes, the vote
was AYE Councilmen Box, Stipes, Henry Bishop, Ed Bishop and Mayor Nix.
NAY - NONE. Motion passed unanimously.
Councilman Ed Bishop moved for final adoption of Ordiance No. 636.
Seconded by Councilman Stipes, motion passed unanimously.
Councilman. Henry Bishop introduced, and moved for adoption of, the
following Resolution. Seconded by Councilman Box, motion passed unanimously:
RESOLUTION
BE IT RESOLVED BY THE FAIRHOPE CITY COUNCIL that Ms. Clair Oaks'
services as Librarian of the Fairhope Public Uibarary be terminated
effective immediately, and,
BE IT FURTHER RESOLVED that all other employees be asked to stay in their
respective positions, and
BE IT FURTHER RESOLVED that Mr. Charles T. Cromwell be appointed as
an interim Librarian effective 24 April, 1979.

Councilman Stipes introduced Or ce No. 637. An Ordinance to
establish Free Public Libraries; Appoint Library Boards; Set out Powers
and Duties of the Library Board; Establishment and Maintenance of Joint
Library Service in Accordance with Title 11-90-1 Through 11-90-4 of the
1975 Code of Alabama.
Councilman Box moved to suspend the rules for immediate consideration
of Ordinance No. 637. Seconded by Councilman Ed Bishop, the vote was
AYE - Councilman Box, Ed Bishop, Henry Bishop, Stipes and Mayor Nix:
NAY - none. Motion passed unanimously.

Councilman Henry Bishop moved for final adoption of Ordinance No. 637.
Seconded by Councilman Stipes, motion passed unanimously.
Mayor Nix nominated the following persons to serve as the Library
Board under Ordinance No. 637.
For 1 year - Mr. Robert Mason
For 2 years- Mrs Ed Nelson
For 3 years- The Reverend H.B. Shepherd
For 4 years- Mrs. James Benford
For 4 years-, and as Temporary Chairman, - Ed Bishop
Councilman Henry Bishop moved to close the nominations and for the acceptance
of the above Board. Seconded by Councilman Box, motion carried with one
abstention by Councilman Ed Bishop.
Meeting was duly adjourned.
