We, the undersigned members of the Fairhope City Council,
do hereby waive notice of a special -called meeting to be held
18 April 1979 at 5:00 pm, City Administration Building, 387
Fairhope Avenue, Fairhope, Alabama 36532, for the purpose of
requesting an opinion from the Attorney General of Alabama
relative to Councilman Billy Don Wiggins' eligibility to serve
while residing outside the Fairhope City Limits, and to appoint
a Library Board member.

The City Council, City of Fairhope met in special session at 5:00 p.m.,
City Administration Building, 387 Fairhope Avenue, Fairhope, Alabama 36532, on
Wednesday, 18 ril 1979, for the purpose of hearing a resolution to be sent
to the Alabama Attorney General relative to Councilman Billy Don Wiggins'
eligibility to serve while temporarily living outside of City Limits, and to
appoint a Library Board amber to fill unexpired term of Mr. William MacGregor
who resigned from the Board on 12 April 1979.
Present were Mayor James P. Nix; Councilmen Ed Bishop, Jack A. Stipes,
Sam E. Box, Sr., Billy Don Wiggins, and Henry G. Bishop; City Clerk Evelyn P.
Phillips, and City Attorney John Duck.
Councilman Henry Bishop introduced, and moved for adoption of, the follow-
ing Resolution. Seconded by Councilman Ed Bishop, motion carried over one
abstention by Councilman Wiggins:
RESOLUTION
BE IT RESOLVED BY THE CITY COUNCIL, CITY OF FAIRHOPE, that the Attorney
General of the State of Alabama be requested to render an Opinion as to the
eligibility of Councilman Billy Don Wiggins to continue to serve on the Fair -
hope City Council while temporarily living out of the City Limits.
ADOPTED this 18th day of April, 1979.

Mayor Nix read a letter written to Attorney General Charlie Graddick, to
be mailed along with a copy of the above Resolution, which stated in part that
Councilman Wiggins ha.d moved to a house he owns, outside the City Limits, which
he has been trying to sell. He intends to live in this house only until a
sale is made. He also wished to state that he has a small living area located
in a store owned by him(Councilman Wiggins) in the corporate limits of the City
and asks if this would meet residency requirements.
Councilman Box nominated Mr. Robert Mason for appointment to the Fairhope
Library Board to complete the unexpired term of Mr. William MacGregor who
resigned April 12th. A Mrs. Linda Gibson asked to make a recommendation to the
Council. She recommended Mrs. Linda Watts be nominated, however, no one placed
Mrs. Watts in nomination. Councilman Henry Bishop moved the nominations be closed.
Seconded by Councilman Box, motion carried with three AYE votes: Councilmen Henry
Bishop, Box and Stipes. Councilmen Ed Bishop and Don Wiggins abstained.
Meeting was duly adjourned.
