COUNTY OF BALDWIN
The City Council, -City of Fairhope, met in regular session
at 7:00 p.m., City Administration Building, 387 Fairhope
Avenue, Fairhope, Alabama 36532, on Monday, 26 February 1979.
Present were Mayor James P. Nix; Councilmen David Ed
Bishop, Jack A. Stipes, Billy Don Wiggins, Sam E. Box, Sr.,
and Henry G. Bishop; City Attorney John Duck and City Clerk
Evelyn P. Phillips.
The minutes of 12 February 1979 regular session were
duly approved.
Councilman Box moved for final adoption'of Ordinance No.
633, an Ordinance annexing the West 200 feet of the North 209
feet of Section 21, Township 6 South, Range 2 East, Baldwin
County, Alabama, LESS AND EXCEPTING therefrom the West 40
feet and the North 15 feet thereof, as petitioned by property
owners Charles B. and Mary A. Ingersoll. Seconded by Council-
man Ed Bishop, motion passed unanimously.
Councilman Box moved for final adoption of Ordinance No.
634, an Ordinance annexing the South half of the Northwest
Quarter of the Southwest Quarter, less 20 feet on the South and
40 feet on the West for roads and less the North 53.75 feet
of the West half of said South �, of the PBJk of the SW-'�, of
Section 16, T6S, R2E, Baldwin County Alabama, as petitioned
by Owner Fairhope Single Tax Corporation and Lessees Jack E.
Pope, Wilma C. Pope and Ruth J. Sully; AND the West Half of the
Northeast Quarter of the Northwest Quarter of the Southwest
Quarter, Section 16, after allowing 40 feet for road on North
and lying in Section 16, T6S, R2E, Baldwin County, Alabama as
petitioned by Owner Fairhope Single Tax Corporation and Lessees
Roy E. and Elsie A. Butgereit. Seconded by Councilman Stipes,
motion passed unanimously.
Councilman Box moved for final adoption of Ordinance No.
635, an Ordinance establishing gas rate for Town of Daphne
when said Town exceeds total gas allocation of 10%. Seconded
by Councilman Wiggins, motion passed unanimously.
Councilman Stipes moved that bids be asked for on the re-
pair work to be done on Electrical Department's Bucket Truck.
Seconded by Councilman Ed Bishop, motion passed unanimously.
Councilman Stipes moved that bids be asked for on concrete
pipe to be used in area back of the Methodist Church. Second-
ed by Councilman Wiggins, motion passed unanimously.
Councilman Wiggins.rominated Mr. Al Johnson to complete
the unexpired term of Ms. Stephanie Montgomery( to March 1981)
on the Recreation Board. Councilman Stipes nominated Ms.
Jimmie Smitherman for this position. Councilman Henry Bishop

moved nominations be closed, seconded by Councilman Ed Bishop.
The vote was: For Mr. Johnson- Councilmen Wiggins, Henry
Bishop, Box and Ed Bishop; For Ms. Smitherman- Councilman
Stipes. Mr. Al Johnson is appointed to the Recreation Board.
Mayor Nix then opened the following bids on two Police Cars:

Chevrolet

for
both
with
trade-ins.
Gaston
Ford
$9,998.00
for
both
with
trade-ins.
Councilman Ed Bishop moved to accept low bidder provided
specifications are met. Seconded by Councilman Stipes, motion
passed unanimously.
Councilman Stipes moved that City Judge Jim Reid be given
a $100-per-month salary increase. Seconded by Councilman
Wiggins, a motion carried over two "Nay" votes by Councilmen
Box and Henry Bishop.
Councilman Stipes moved that bids be obtained on the
Sanitation(Garbage Collecting) Contract. Seconded by Council-
man Ed Bishop, motion passed unanimously.
Councilman Henry Bishop introduced, and moved for adoption
of, the following resolution. Seconded by Councilman Box,
motion passed unanimously:
RESOLUTION
WHEREAS, the City of Fairhope did collect $16,160.00
for Business Licenses from concerns located
in the Police Jurisdiction of the City of
Fairhope, and
WHEREAS the Fairhope Police Department did expend the
sum of $56,237 for police protection in the
Police Jurisdiction of the City of Fairhope;
and the Fire Department of the City of Fair -
hope did expend $8,170 for fire protection
in the Police Jurisdiction
THEN, THEREFORE BE IT RESOLVED that the expense of
Fire and Police Protection in the Police
Jurisdiction of the City of Fairhope did
exceed the revenue received from Business
Licenses issued to locations in said
Police Jurisdiction.
Adopted this 26th day of February, 1979.

Councilman Wiggins presented a copy of the new Airport Lease as
approved by the Airport Board and moved for its acceptance. Seconded'
by Councilman Henry Bishop, motion carried over one "Nay" vote by
Councilman Ed Bishop.
Councilman Stipes moved for payment of the Final Invoice rendered
by Fairhope Paving Company on Division I, Flood Damage Project, provided
that said company presents a letter saying they would be responsible for
compaction tests later in the year. Seconded by Councilman Ed Bishop
motion passed unanimously.
Councilman Ed Bishop moved to agree to rent four Port-O-Lets at
$46.81 each for the Arts & Crafts Weekend. Seconded by Councilman Stipes
motion passed unanimously.
Councilman Stipes moved to authorize City Engineer Ack Moore to
inspect and report to Council on a possible solution to the drainage
problem on White Avenue. Seconded by Councilman Ed Bishop, motion
passed unanimously.
Councilman Box moved to have City Engineer prepare a Cost Estimate
to run Sewer Line from back of Anna T. Jean School to manhole at City
Garage on Section Street. Seconded by Councilman Stipes, motion passed
unanimously.
Councilman Wiggins moved to authorize City Attorney Duck to investi-
gate the retroactive pay raises given the Public Library employees and
to take legal action to correct any illegalities if such is found. Second-
ed by Councilman Henry Bishop, motion passed unanimously.
Councilman Box nominated Councilman Ed Bishop to be a member of the
Library Board effective 1 May 1979. Councilman Stipes moved the nom-
inations be closed. Seconded by Councilman Wiggins, motion carried with
one abstention(Councilman Ed Bishop). Councilman Ed Bishop is appointed
to the Library Board effective 1 May 1979.
Mayor Nix announced that March 12th regular Council session would be-
gin at 6:30 in order to view a film to be presented by the Coastal Area
people.
Meeting was duly adjourned.
