The City Council, City of Fairhope, met in regular session at 7:00
p.m, at the City Administration Building, 387 Fairhope Avenue, Fair -
hope, Alabama on Monday, 12 February 1979
Present were Mayor James P. Nix; Councilmen Jack A. Stipes,
Billy Don Wiggins, Henry G. Bishop, Sam E. Box,. Sr., and David Ed
Bishop; City Attorney John Duck and City Clerk Evelyn P. Phillips.
The minutes of 22 January regular session and 1 February special
session were duly approved.
Mr. Don Sutherland and Mrs. Beverly Jennings of Baldwin Electric
Membership Corporation presented a check for $2,012.61 in payment of
Gross Receipts Tax for 1978.
Councilman Stipes introduced and moved for adoption of the follow-
ing Resolution. Seconded by Councilman Ed Bishop, motion passed unan-
imously:
RESOLUTION
BE IT RESOLVED BY THE CITY COUNCIL, CITY OF FAIRHOPE, that all
Work Orders will be charged out at cost on materials and at each
employee's actual pay rate (including allowance for fringe benefits).
When items on a particular Work Order are to be charged to a
customer, such items shall be charged: Materials at cost price
marked up 10%, and Labor at employee's actual pay rate (including
fringe allowance) marked up 100%.
Exception: Materials, such as meters, which have an established
set rate will continue to be billed to the Customer at the said
established set rate.

The following offers to buy the City's Backhoe were opened:

Councilman Henry Bishop moved to accept Wilson and Son's offer of
$3,022.00. Seconded by Councilman Stipes, motion passed unanimously.
The following offer to buy the City's Pick-up was opened:
Richard Ward $ 81.96
Councilman Henry Bishop moved to accept this offer. Seconded by Councilman
Stipes, motion passed unanimously.
An application for an Off -Premises Beer License has been filed
by Rosie L. Dennis, dba PENCIL's, located at corner of Twin Beach
Road and South Section Street. Councilman Wiggins moved to set
hearing date for 12 March 1979. Seconded by Councilman Ed Bishop,
motion passed unanimously.
Councilman Wiggins reported the Recreation Board had received
the following bids on resurfacing Young Street's tennis/basketball
courts and moved for acceptance of low bidder Pylate Construction
Company's bid. Seconded by Councilman Box, motion passed unanimously:
Valta Construction Co. $ 3,676.32
Temco, Inc. $ 3,390.00
Melton Construction $ 3,360.00
Pylate Construction $ 3,172.50
Councilman Box moved to have`a Public Hearing on an Ordinance
to amend Zoning Ordinance, Section 6.7 SIGNS, on 12 March 1979.
Seconded by Councilman Ed Bishop, motion passed unanimously.
Councilman Stipes reported that a number of Street Signs are in
bad condition and need replacing. Councilman Stipes moved that the
County Commissioners be contacted about placing a Signal Light at
intersection of Twin Beach Road and Section Street, seconded by Coun-
cilman Wiggins, motion passed unanimously.
Mr. Marion Wynne came before Council as spokesman for Citizens
Concerned about the Public Library, a group of citizens who wished to
express their concern about recent events relative to the local Library.
A lengthy discussion ensued. Councilman Ed Bishop stated he was concern-
ed about the repeated use of the words "financial crisis" and "lack of
funding" in local news articles. Councilman Wiggins questioned Mr.
Wynne about various aspects and thanked him for bringing the 120-name
petition from the Concerned Citizens. Councilman Box read a prepared
statement in which he suggested the Library Board request the resigna-
tion of Librarian Claire Oaks. Councilman Stipes stated it was past
time for the Library and the Librarian to be about the business of run-
ning the Library on the funding received as all other City Departments
are doing. Councilman Henry Bishop said he was concerned about the 16%
salary increase for the Librarian, the 43" salary increase for the Assist-
ant Librarian and the 23% increase for the Clerk when all other City employ-
ees received less than 9%. Mayor Nix summed up by reminding all present
that the funding granted to the Library was 13% more than last year, that
t1-e budget of $68,000 was about $11.26 per capita(the highest in the
State of Alabama), that no one was being denied the right of free speech,
and that the Council's only concern was for the swift return of the co-
operation enjoyed by all in the past.

Councilman Box moved for annexation of the Charles Ingersoll property
located in the West 200 feet of the North 209 feet of Section 21, T6S,
R2E, Baldwin County, Alabama, less and excepting therefrom the West 40
feet and the North 15 feet thereof (corner of Greeno Road and Nichols
Street), as approved and recommended by the Planning & Zoning Board.
Seconded by Councilman Wiggins, motion passed unanimously.
Councilman Box introduced ORDINANCE no. 633, an Ordinance annexing
the Ingersoll Property zoned M-1 Light Industrial.
Councilman Box moved for annexation of the Single Tax Corporation proper-
ty now leased to:(1) Jack E. and Wilma C. Pope and Ruth J. Sully locat-
ed in the South half of the Northwest Quarter of the Southwest Quarter
less 20 feet on the South and 40 feet on the West for roads and less
the North 53.75 feet of the West half of said South half of the North-
west Quarter of the Southwest Quarter of Section 16, T6S, R2E, Baldwin
County, Alabama, and (2) Roy E. and Elsie A. Butgereit located in the
West half of the Northeast Quarter of the Northwest Quarter of the
Southwest Quarter, Section 16,, after allowing 40 feet for road on North
and lying in Section 16, T6S, R2E, Baldwin County, Alabama, as approved
and recommended by the Planning & Zoning Board. Seconded by Councilman
Stipes, motion passed unanimously.
Councilman Box introduced ORDINANCE No. 634, an Ordinance annexing
the above Single Tax Colony property zones—B-2 General Business.
Councilman Box introduced ORDINANCE no. 635, an Ordinance establishing
Gas Rate for Town of Daphne when said Town of Daphne exceeds Ten Percent
Allocation.
Councilman Henry Bishop moved to have Bond Amount of City Employees
increased from $5,000 to $25,000. Seconded by Councilman Ed Bishop,
motion passed unanimously.
Councilman Wiggins introduced the following Resolution and moved
for its adoption. Seconded by Councilman Stipes, motion passed
unanimously.
RESOLUTION
BE IT RESOLVED THAT, Chester E. Billie, Roberta C. Billie, Howard
R. Thomas, Barbara J. Thomas, A. Wesley Stapleton and Beverly J. Staple-
ton, are the -owners and holders of liens of all of the property abutting
on a public right-of-way more particularly described as follows:
Valley Forge Court West and Valley Forge Court East, as
shown on plat of First Addition to Colonial Acres, as recorded
in the office of the Judge of Probate of Baldwin County, Ala-
bama, in Map Book 10, page 77
AND THAT, the said owners and lien holders have filed a petition
with the City Council of the City of Fairhope, Alabama, requesting
that said City Council of the City of Fairhope, Alabama give an assent
to the vacation of a public right-of-way described above.
NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City
of Fairhope, Alabama, as follows:

That the City Councilmen of the City of Fairhope, Alabama, do
assent to the vacation of a public right-of-way described as
follows:
All of Valley Forge Court West and Valley Forge Court East, as
shown on plat of First Addition to Colonial Acres, as per plat
thereof recorded in the office of the Judge of Probate of Bald-
win County, Alabama, in Map Book 10, page 77, and all drainage
and utility easements or other public easements as shown or dedi-
cated on said plat
which said right-of-way is situated in the City of Fairhope,
Alabama; that a certified copy of this resolution be furnished
to said petitioners in order that same can be attached to the
Declaration of Vacation to be filed in this matter as provided
for by Code of Alabama 1975, Section 23-4-1.

Councilman Stipes moved to obtain bids on two Police Cars. Second-
ed by Councilman Ed Bishop, motion passed unanimously.
Councilman Wiggins moved for approval of Jubilee Optimist Club's
request to be in charge of the Fourth of July Celebration. Seconded
by Councilman Henry Bishop, motion passed unanimously.
Councilman Stipes moved to cooperate with the proposed "Spring
Fever Chase", a foot race during Arts & Crafts weekend. Seconded by
Councilman Henry Bishop, motion passed unanimously.
Councilman Ed Bishop moved to obtain quotations on having the
City's Ordinances codified. Seconded by Councilman Henry Bishop,
motion passed unanimously.
Councilman Stipes moved to have CETA sidewalk crew replace broken
sections of sidewalks in Ingleside area. Seconded by Councilman Wiggins
motion passed unanimously.
Councilman Stipes introduced and moved for adoption of the following
Resolution. Seconded by Councilman Ed Bishop, motion passed unanimously:
RESOLUTION
WHEREAS, Truck Route 98(Greeno Road) desperately needs to be
four laned from where it presently ends at Highway 104 to at least
County Route 44(Twin Beach Road) and,
WHEREAS, a portion of U.S. 98(Section Street) that falls within

the corporate limits of the City of Fairhope is in need of re -sur-
facing, and,
WHEREAS, sidewalks along US 98(Section Street) are needed,
NOW THEREFORE BE IT RESOLVED, by the Mayor and Council of the
City of Fairhope, that the Governor and State Highway Director, State
of Alabama, be contacted and asked that they lend their support to
seeing these projects completed.

Councilman Ed Bishop moved to authorize City Attorney John Duck
to contact Utility Services, Inc., in regard to some unfinished work on
the City's Water Tank. Seconded by Councilman Stipes, motion passed
unanimously.
Councilman Stipes moved to pay half of costs(with Single Tax
Corporation) on some additional drainage on Brown Street, about
$4,400. Seconded by Councilman Wiggins, motion passed unanimously.
Mr. Byrd Moore of Eastern Shore Builders requested permission to
hook up with existing sewer line, at his expense, near East Gayfer
Street to serve a sub -division not contiguous to the City Limits.
Councilman Stipes moved to approve this request provided that deeds
carry the clause that the property will be annexed as soon as possi-
ble. Seconded by Councilman Wiggins, motion passed unanimously.
Councilman Henry Bishop moved to pay bills as presented. Council-
man Wiggins seconded -and motion passed unanimously.
Meeting was duly adjourned.
