Central Standard Time, City Administration Building, 387 Fairhope Avenue, Fairhope, Alabama 36532, on Tuesday, 26 December 1978 Mayor James Nix presided as chairman of the meeting and called the meeting to order. Evelyn P. Phillips, City Clerk, acted as clerk of the meeting. On roll call, the following were found to be present: Mayor Nix and Councilmen David E. Bishop, Sam E. Box, Sr., Henry G. Bishop, Billy Don Wiggins, and Jack A. Stipes; City Attorney John Duck, and the following were found to be absent: none. The Mayor stated that a quorum was present and that the meeting was open for the transaction of business. Minutes of 11 December regular session and 18 December Special Session were duly approved. This being the date set for a Public Hearing on the rezoning request by a number of property owners for property located along a 300-foot strip on each side of Greeno Road from Fairhope Avenue to just north of Volanta Street, a large group of interested citizens, pro and con, were invited to address Council. Mr. Byrd Moore acted as spokesman for the owners requesting a zoning change from R-1 Low Density Single Family Residential District to B-4 Business and Profession- al Offices. Mr. Moore stated Greeno Road is no longer a little traveled residen- tial street, it is a heavily -traveled State Highway- By -Pass and the owners of the property under discussion could not sell their land as Residential property for this reason. The rezoning would set up a buffer zone between the present resi- dents and the Greeno Road traffic according to Mr. Moore. Several residents of the area stated their opposition to Mr. Moore's group. They felt rezoning would make present problems worse, would prefer to keep the area residential. Of all the property owners directly involved, Mr. Moore reported 96.5% were in favor of the rezoning and 3.5% were opposed, The Planning & Zoning Commission recommended the request be denied. Councilman Box moved to deny the request. On a second by Councilman Ed Bishop, the following votes were recorded: AYE - Councilman Box and Ed Bishop. NAY - Councilman Wiggins. ABSTAIN - Councilmen Henry Bishop and Jack Stipes. The motion to deny the rezoning request carried. The local V.F.W. Club Commander and the Post Chaplain reported to Council that every effort possible will be made to reduce noise at the VFW Club on Mobile Street. Mayor Nix thanked then and their supporters for appearing at the meeting, advised any resident who felt noise was still disturbing, or who saw any person violating the peace of the public to sign a warrant for such noise- makers or violaters thus allowing a Judge to render a decision as to whether or not ordinances were being broken by patrons of the V.F.W. Club, and advised that the local Police Department would be continuing their investigations. Councilman Henry Bishop introduced ORDINANCE 140. 627, An Ordinance authorizing the issuance and making sale of $535,000 Principal Amount of General Obligation Various Purpose Warrants of the City to be Dated 1 December 1978. Councilman Box moved that the rules be suspended and unanimous consent 23 (26 December 1978) be given for immediate consideration of and action on said Ordinance No. 627, which motion was seconded by Councilman Stipes, and upon the same being put to vote the following vote was recoded: YEAS NAYS Mayor Nix None 'Councilmen David E. Bishop Henry G. Bishop Sam E. Box Jack A. Stipes Billy D. Wiggins Mayor Nix thereon declared that the motion for unanimous consent for immediate consideration of and action on the said ordinance had been unanimously carried. Councilman Henry Bishop thereupon moved that tie said ordinance be finally adopt- ed, which motion was seconded by Councilman Ed Bishop, and upon the motion being put to the vote the following vote was recorded: YEAS NAYS Mayor Nix None Councilmen David E. Bishop Henry G. Bishop Sam E. Box Jack A. Stipes, Billy D. Wiggins The Chairman thereupon announced that the motion for adoption of the said or- dinance had been unanimously carried. The Mayor then presented to the meeting a form of Official Statement with respect to the General Obligation Various Purpose Warrants authorized in the preceding ordinance and also a form of Official Statement with respect to a proposed $400,000 issue of General Obligation Public Improvement Bonds and a proposed $360,000 issue of Water, Gas and Sewer Revenue Bonds. Councilman Henry G. Bishop then introduced the following resolution in writing: BE IT RESOLVED by the Mayor and City Council of the City of Fairhope, Alabama. (herein called "the City") as follows: (1) The Official Statement with respect to $535,000 principal amount of General Obligation Various Purpose Warrants of the City to be dated December 1 1978, in substantially the form presented to the meeting at which this resolu- tion is adopted, is hereby adopted as the Official Statement of the City with respect to said Warrants. (2) The Official Statement with respect to $400,000 principal amount of General Obligation Public Improvement Bonds of the City to be dated December 1, 1978 and $360,000 principal amount of Water, Gas and Sewer Revenue Bonds, Series 1978 of the City to be dated December 1, 1978, in substantially the form pre- sented to the meeting at which this resolution is adopted, is hereby adopted as the Official Statement of the City with respect to said Bonds. (3) The Bonds referred to in paragraph (2) of this resolution shall be offered at public sale upon sealed bids, the said bids to be opened at 11:30 o'clock on Tuesday, January 8, 1979. -The terms of the public sale of said Bonds shall be as set forth in the Official Invitations for Bids respectively pertaining thereto, as set out as appendices to the Official Statement with respect to said Bonds heretofore approved in this resolution._,, The commence- ment of the publication of said Official Invitations for Bids by the City Clerk 24 (26 December 1978) is hereby ratified and approved, and the City Clerk is hereby authorized and directed to complete said publication in accordance with the provisions of Alabama law regulating the public sale of n micipal bonds. ADOPTED this 26th day of December 1978. Councilman Henry Bishop thereupon moved that the said resolution be finally adopted, which motion was seconded by Councilman Wiggins, and upon the motion being put to the vote the following vote was recorded: YEAS NAYS Mayor Nix None Councilmen David E. Councilman Stipes moved to deny Leroy Lyons' application for an Off Premises Beer License at Young Street Service Station due to the recommendation that applic- ation be denied by the Fairhope Police Department. Seconded by Councilman Ed Bishop, motion to deny passed unanimously. Councilman Henry Bishop moved to approve Pauline I Tate's application for an Off Premises Beer License at T & M Quick Stop. Seconded by Councilman Wiggins, motion passed unanimously. Councilman Stipes moved for final adoption of ORDINANCE NO. 628, an ordinance to establish procedure for all applications to the City Council, City of Fairhope (26 December 1978) 25 for approval of the issuance of Beer or Liquor Licenses located within the City Limits of the City of Fairhope or its Police Jurisdiction. Seconded by Councilman Ed Bishop, motion passed unanimously. Councilman Henry Bishop introduced and moved for adoption of the follow- ing Resolution setting the pay scale of all City Employees with the stipula- tion that Electrical Department Superintendent's salary be at the same level as other Department Superintendents and that legal verification of Council's right to increase City Clerk's salary be obtained. Seconded by Councilman Ed Bishop, motion passed unanimously: RESOLUTION BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF FAIRHOPE, ALABAMA, that the following is the pay scale for all City Employees of the City of Fairhope, Ala- bama.: General Fund: Clerical Doris Childress - Bookkeeper Marii Ziegler - License Permits & Asses. Upon Councilman Wiggins moved for acceptance of low bid, Baldwin at $9,246.26. Seconded by Councilman Stipes, motion passed bid review Mr. H.S. St. John, the City's Engineering Consultant, reported on and pre- sented copies of their Electrical Rates Study which included recommended new Electrical Pates. Councilman Ed Bishop introduced the new rates as an ORDINANCE, such rates to be effective January 1, 1979. Councilman Box moved to suspend the rules in order to finalize action on this ORDINANCE. Seconded by Councilman Wiggins, the vote was AYES Councilmen Box, Wiggins, Henry Bishop, Ed Bishop, and Jack Stipes. NAYS - none. Councilman Ed Bishop then moved for final adoption of ORDINANCE NO. 629, an Ordinance to es- tablish rates for all electrical customers served by the City of Fairhope. Sec- onded by Councilman Box, motion passed unanimously. Councilmman. Henry Bishop moved that Councilman Box be authorized to settle a matter between the City and a customer who is questioning the amount of a bill for some service work. The customer contacted Councilman Box, thus involving him person- ally, and Council wishes to verify Councilman's decisions in the matter to be the City's position. Seconded by Councilman Stipes, motion passed unanimously. Mayor Nix presented Council with a letter from Baldwin National Bank of Robertsdale, Fairhope branch, stating that since they had had a deposit re- lationship with West Baldwin Water Authority for a number of years and since the City has now taken over the assets and liabilities of West Baldwin Water, that they be authorized to receive City deposits. Councilman Wiggins moved that West Baldwin Water Authority Account be left in Baldwin National Bank. Motion died due to lack of a second. The following bids were received and opened by the Mayor on a pick-up truck for the Water Department: Thomas Pontiac $5,255.63 Gaston Motors 5,095.49 Councilman Box moved to accept low bid provided vehicle meets specifications Seconded by Councilman Henry Bishop, motion passed unanimously. (26 December 1978) Councilman Stipes moved for 5-year appointment of Mr. Vince Valentin to the Personnel Board. Seconded by Councilman Box, motion passed unanimously. Councilman Box moved for 3-year appointments of Mr. Horace Stowe and Mr. E.B. Grin to the Parking Authority. Seconded by Councilman Wiggins, motion passed unanimously. Councilman H.Bishop moved for a 3-year appointment of Mr. Ray Gipson to the Board of Adjustment. Seconded by Councilman Stipes, motion passed unanimously. Councilman Box moved for approval of the Mayor's appointment of Mr. Ted Bennett to the Planming & Zoning Commission. Seconded by Councilman Ed. Bishop motion passed unanimously. Councilman Wiggins moved to transfer $3,000 from the Beach Fund to the Recreation Board's Improvement Account to cover cost of surfacing and resur- facing some basketball courts at Young Street Recreation Center. Seconded by Councilman Stipes, motion passed unanimously. Councilman Henry Bishop introduced and moved for adoption of the follow- ing Resolution. Seconded by Councilman Stipes, motion passed unanimously. RESOLUTION WHEREAS, the City of Fairhope is desirous of entering into an agreement with Parker & IMte, a Certified Public Accounting firm, to review and supervise all City of Fairhope accounting, and WHEREAS, Parker & White will review all Cash Receivable Journals, Cash Disbursement Journals, reconcile all Bank Accounts, prepare monthly General Journal entries, and prepare a monthly Financial Statement. ITIEREF0RE, BE IT RESOLVED that such an agreement is now in effect between. the City of Fairhope and Parker & White, CPA's, for a term to begin 1 October 1978 and to expire 30 September 1979, at a monthly cost of $800.00 to be paid by the City of Fairhope to Parker & White in the following manmer: $250.00 - General ,Fund $200.00 - Electric Fund $150.00 - Gas Fund $150.00 - Water & Sewer Fund $ 50.00 - Recreation Fund ADOPTED THIS26thday of December 1978. Councilman Henry Bishop moved to pay bills as presented. Seconded by Councilman Wiggins, motion passed unanimously. (26 December 1978) 29 Councilman Wiggins asked that Mr. John Parker, Chairman of the Planning & Zoning Ccnnnission, be invited to attend the next regular session of the City Council.
