HomeMy WebLinkAbout11-13-1978 Regular MeetingR STATE OF ALABAMA COUNTY OF BALDWIN X The City Council, City of Fairhope, met in regular session at 7:00 p.m., City Administration Building, 387 Fairhope Avenue, Fairhope, Alabama. 36532, on Monday, 13 November 1978. Present were Mayor -James P. Nix; Councilmen Jack A. Stipes, Billy Don Wiggins, Henry G. Bishop, Sam E. Box, Sr., and David Ed Bishop City Attorney John Duck; Acting City Clerk Evelyn P. Phillips. The minutes of 23 October 1978 regular session were duly approved. This being the day set for public hearing on Irby & Irvine's rezoning request on property located between Perdido and Seminole Streets, a large group of interested citizens were present. The property is zoned R-2 Medium Density Single Family Residential and the owners request it be rezoned B-4 Business and Professional District. A petition opposed to the rezoning, signed by 50 interested citizens, was presented to Council. Mr. Starke Irvine presented 8 letters from property owners in favor of the rezoning. Mayor Nix called for a show of hands of those present who live within 300 feet of the property: 0 were in favor and 8 were opposed to the rezoning. Of general attendance: 0 were in favor and 13 were opposed. The Planning & Zoning Commission recommended the request for rezoning be granted. Councilman Stipes moved the rezoning request be denied. Seconded by Councilman Ed Bishop, the vote was: AYES -Councilmen Stipes, Ed Bishop, Wiggins and Henry Bishop. NAYS- None. ABSTAIN- Council- man Box. Motion carried to deny rezoning request. Councilman Box moved for final adoption of Ordinance No. 623 an Ordinance establishing $15.00 fee plus Applicant responsi i ity or all costs of publication, postage, etc., when application is made to the Board of Adjustments and Appeals. Seconded by Council Wiggins, motion passed unanimously. Councilman Ed Bishop moved for final adoption of Ordinance No. 625, an Ordinance establishing $15.00 fee plus Applicant responsibility for all costs of publication, postage, etc., when application is made to the Plan- ning and Zoning Commission. Seconded by Councilman Stipes, motion passed unanimously. Councilman Stipes moved for final adoption of Ordinance No. 626, an Ordinance setting Applicant responsibility for all costs of publication, etc., when application is made to City Council for action on requests made to Planning & Zoning Commission. Seconded by Councilman Ed Bishop, motion passed unanimously. A letter from the Eastern Shore Art Association requesting the use of Knoll Park for the 1979 Arts & Crafts Festival was presented to Council. Councilman Henry Bishop moved permission be granted, and that permission be for 1979 onward until and unless revoked by future action, and that permission be contingent upon approval by the Fairhope Single Tax Corporation. Seconded by Councilman Box, motion passed unanimously. 7 (13 November 1978) The following bids on a Backhoe were opened: Carl Grant Tractor Co. $21,000.00 (Ford) Foley Tractor Co." $24,385.00 (Massey Ferguson) Port City Tractor Co. $18,356.17 (John Deere) Jordan Equipment Co. $22,968.00 (Ford) Councilman Henry Bishop moved low bid be accepted provided specifications are met. Seconded by Council Wiggins, motion passed unanimously. The following bids on two Dump Trucks were opened: Dodo Only Gasoline Diesel Vernz Trucking 525��0U' --- --- Trucking Equipment 4899.66 --- --- Gaston Motor --- 27,993.00 36,944.00 Thomas Pontiac --- 34,772.48 40,172.86 Steber Chevrolet --- 27,839.78 38,197.70 These bids were turned over to Councilmen Box and Stipes and City Super- intendent Phil Rutherford for study. They are to report their findings and recommend which vehicle type to accept at the next regular session on November 27th. Councilman Ed Bishop moved that bids on a typewriter for City Hall be requested. Seconded by Councilman Henry Bishop, motion passed unani- mously. The following bids on replacing drapes in City Hall were considered: Powell Upholstery $962.07 Accent Shop 1009.73 Fairhope Floor Covering 864.00 Eastern Shore Interiors 561.04 Councilman Stipes moved to accept low bid(Eastern Shore Interiors). Seconded by Councilman Ed Bishop, motion passed unanimously. Mr. Gary Sandell, Fairhope Ambulance Service, came before Council to report a successful drive selling Service Contracts and to announce no request for monetary assistance would be made for this year. Puny people worked hard on this drive and three Volunteers will receive a special Thank You from the City for their efforts. The Mayor will take care of preparing an appropriate letter for presentation at a later meeting. Councilman Wiggins requested the Mayor look into the Wrecker Rotation System operated by the Alabama State Troopers when highway accidents occur in our area. Councilman Stipes suggested that any usable..... materials removed from the City Rescue Wagon when it was converted into the Senior Citizens Shuttle Bus be donated to the Fairhope Ambulance Service. This will be done after our Police and Fire Departments collect any materials usable by them. 9 (13 November 1978) • Councilman Stipes moved a refund be made to the widow of Mr. Cedric Britton, Jr., of the Boat Rent paid a few days prior to his passing. Seconded by Councilman Wiggins, motion passed unanimously. Councilman Stipes moved bids on the leasing of Fisherman's Wharf be based on a two year period instead of one year. Seconded by Councilman. Henry Bishop, motion passed unanimously. Councilman Stipes moved the City should not enter into any other paving agreements with Sub -Dividers. Seconded by Councilman Henry Bishop, motion passed unanimusly. Councilman Henry Bishop moved for approval without lay -over on a re -applica- tion by Mrs. Dorothy Pacey of the Wash House Restaurant for an Alcoholic Beverage License. Mrs. Pacey applied for a "Retail Beer" license on September 25th, was approved by the Police Department and by the Council on October 9th. She is re- applying at this time due to the fact that she needed a "Restaurant.Liquor" license instead of a "Retail Beer" license. Councilman Bishop stated Mrs. Pacey is a well known, established businesswoman (Punta Clara Kitchens) and a second Police investigation and two -week layover would only cause expense and delay to no real pur- pose. Motion was seconded by Councilman Box and carried by the following votes: AYES - Councilmen Henry Bishop, Don Wiggins, and Sam Box. NAYES - Councilmen Ed Bishop and Stipes. Councilman Stipes introduced a Resolution establishing a new procedure for Alcoholic Beverage License Applications. Applicants would be required to publish a notice of their intention to apply for a license once a week for two successive weeks prior to presenting application to Council. This Resolution will be held over until next regular session for action. Councilman Wiggins reported bids were received an lights at Stimpson Field by the Recreation Board at their last regular meeting. Mack Electric Company was low bidder at $166.25 each fixture and $35.50 each lamp. Councilman Wiggins moved to accept Mack Electricas bid subject to Federal Agency approval. Seconded by Councilman Box, motion passed unanimously. The following bids were opened on light poles at Stimpson Field: American Creosote $392.00 (each pole) Creo. Treated Councilman Wiggins moved for acceptance of low bid subject to Electrical Super- intendent Norris and City Superintendent Rutherford's approval. Seconded by Councilman Box, motion passed unanimously. Councilman Henry Bishop introduced and moved for adoption of the following Resolution. Seconded by Councilman Stipes, motion passed unanimously: I (13 November 1978) RESOLUTION BE IT RESOLVED BY THE CITY COUNCIL, CITY OF FAIRHOPE, that WHEREAS, all Revenue Sharing Funds received by the City of Fairhope have been and are obligated for the use of the Fairhope Public Library, and WHEREAS, this has been standard practice since early in 1974, and WHEREAS, the Council Minutes do not reflect the adoption of this standard obligation by motion or resolution THEN, THEREFORE, IT IS RESOLVED, that the practice of obligating all Revenue Sharing Funds to the Fairhope Public Library is and has been a standard practice. Resolved this 13th day of November, 1978. SIGNED 1 Councilman Wiggins moved to authorize Mayor Nix to proceed with and execute all necessary documents to conclude the purchase of West Baldwin Water System. Seconded by Councilman Box, motion passed unanimously. Councilman Henry Bishop roved to pay bills as presented. Seconded by Councilman Wiggins, motion passed unanimously.
