HomeMy WebLinkAbout10-23-1978 Regular Meeting1, 3' ,STATE OF ALABAMA X COUNTY OF BALDWIN X The City Council of the City of Fairhope met in regular session at 7:00 P.M., City Administration Building, 387 Fairhope Avenue, Fairhope, Alabama 36532, on Monday, 23 OCTOBER 1978 Present were Mayor James P. Nix; Council David Ed Bishop, Sam E. Box, Sr., Henry G. Bishop, Billy Don Wiggins, Jack A. Stipes; City Attorney John Duck; Acting City Clerk Evelyn P. Phillips; and Mr. Thad Ingram represen- ting Moore Engineering Company, the City Engineers. Minutes of 9 October 1978 regular session were duly approved. Councilman Stipes moved for approval of the City of Fairhope Civil Preparedness and Disaster Plan as prepared by Mr. Frank Buchanan, also a vote of thanks to Mr. Buchanan for a job well done. Seconded by Council- man Ed Bishop, motion passed unanimously. Councilman Henry Bishop introduced, and moved for the adoption of, the following Resolution. Seconded by Councilman Box, motion passed unanimously: WHEREAS, MR. PARMADUKE DYSON was one of Fairhope's Most Distinguished Citizens and whose contributions toward the growth and success of the City of Fairhope is beyond estimate, and WHEREAS, MR. MARMADUKE DYSON and his family were residents of Fairhope from 1904 until his passing, and WHEREAS, MR. MARMADUKE DYSON, in addition to his construction work in the City of Fairhope was one of the leading citizens and active in the Fairhope Single Tax Colony and was President of Fairhope Single Tax Corporation for twenty-four(24) years, and WHEREAS, MR. MARMADUKE DYSON was one of the original founders of the Bank of Fairhope, and served on its Board of Directors from 1917 until his retirement in 1959, and WHEREAS, MR. MARMADUKE DYSON was a Director on the official Board of the Baldwin County Savings & Loan Association until his retirement, and WHEREAS, MR. MARMADUKE DYSON was an outstanding humanitarian, assisting many people in acquiring homes and property in Fairhope, Alabama who, without his assistance, would not have been financially able to do so, and WHEREAS, MR. MARMADUKE DYSON was especially interested in and was a leader in education and in his quiet, unassuming way, con- tributed to the quality of school facilities in the early days of the City of Fairhope, and WHEREAS, the Mayor and City Council of the City of Fairhope (23 October 1978) 4' are desirous of showing their appreciation for the many contributions made by Mr. Dyson to the growth of the City of Fairhope in its early days; NOW THEREFORE, BE IT RESOLVED that the Mayor and City Council of the City of Fairhope do by these presents, in honor and memory of MR. MARMADUKE DYSON, change the name of "CHESTNUT STREET" to be known from now and henceforth, as "DYSON STREET" in the City of Fairhope, Alabama. BE IT FURTHER RESOLVED that a copy of this Resolution be spread upon the Minutes of the Meeting of the City Council of the City of Fairhope on the 23rd day of October, 1978. BE IT FURTHER RESOLVED, that a copy of this Resolution be mailed to each of the lineal descendants of MR. MART?ADUKE DYSON. ADOPTED THIS THE 23rd day of 1978. Councilman Box moved for the re -appointment of Mr. Clarence McCoy and Mr. Peyton Walker to the Board of Adjustment & Appeals. Seconded by Council- man Stipes, motion passed unanimously. Councilman Henry Bishop moved for the re -appointment of, with a vote of thanks for an excellent job, Mr. Billy Don Wiggins to the Airport Board. Seconded by Councilman Box, motion passed unanimously. Councilman Stipes moved for the re -appointment of Mr. Sam E. Box., Sr., to the Organic School Board. Seconded by Councilman. Ed Bishop, motion passed unanimously. Councilman H. Bishop moved to authorize the Acting City Clerk to pay Contract Billings, where retainage is involved, during first ten days of each month. Seconded by Councilman Box, motion passed unanimously. Councilman Stipes moved for the acceptance of the low bid of $28,290.00 by the Vernz Trucking Company of Pensacola on the Garbage Transfer Trailer. Seconded by Councilman Henry Bishop, motion passed unanimously. Councilman Stipes moved to authorize bids be obtained to replace drapes in City Hall. Seconded by Councilman Ed Bishop, motion passed unanimously Mayor Nix reported that the bids opened on Division III of the Disaster work had proved to be unacceptable. The FDAA estimates to repair this area of damage are much lower than the lowest bid offered. As a result, Moore Fnsneering had contacted the bidders and 1'1r. Thad Ingram reported the following responses: Fairhope Paving Company(low bidder) will not negotiate their bid of $63,144.05. 5" (23 October 1978) Northwestern, Inc., is willing to negotiate but will limit any decrease to not more than 10%. (Bid $86,644.70, adjusted to $77,980.23 after quantative adjustment by City in Section C- Item 2, Treated Timber Steps; maximum reduction= $70,582.23) Mr. Ingram -went on to report that Delta Plumbing Company, who did not bid on Division III originally, would like to offer a bid of $40,262.75 at this time if allowable. City Superintendent Phil Rutherford reported that his conversation with Mr. Lawrence Bowden on the possibility of FDAA allowing Delta to enter a bid at this point resulted in a negative opinion but he is still waiting for a confirmation or a denial of whether the bid by Delta will be allowed. Councilman Box moved to reject the bids opened on September 15th on Division III since they are unacceptable to FDAA. Seconded by Councilman Stipes, motion passed unanimously. Councilman Wiggins moved to reject the $1,000 special offer by Fairhope Paving Company to straighten the bulkhead (part of Division III repairs). Seconded by Councilman Box, motion passed unanimously. Councilman Ed Bishop moved to accept Delta Plumbing Company's bid of $40,262.75 if FDAA allows the bid to be entered. Seconded by Councilman Wiggins, motion.passed unanimously. Councilman Stipes moved, provided FDAA will not allow Delta's bid to be entered at this point, to authorize City Engineers to immediately advertise for bids on Division III. Seconded by Councilman Ed Bishop, motion passed unanimously. Mayor Nix reported that the extension of the Middle Street sewer line requested by Mr. Frank Clemons and Mr. Louis Agee at the last regular session can be done for approximately $400.00 and will be done as fast as the work crew can be assigned to the job. Councilman Stipes moved to have bid requests sent out on two 10-yard Dump Trucks and a Backhoe similar to the one now used by the Gas Department. Quotes should be requested on gasoline -powered and diesel -powered vehicles. Seconded by Councilman Henry Bishop, motion passed unanimously. Councilman Stipes moved to authorize the Mayor to request a CETA Project for replacing and repairing sidewalks, opening walking trails, and clearing blind corners. Seconded by Councilman. Ed. Bishop, motion passed unanimously. Councilman Wiggins reported an impressive number of participants involved in the various recreational programs now being offered and supervised by the Recreation Board. Councilman Box was asked to meet with Water & Sewer Superintendent Mike Rejczyk and Mr. Charlie Middleton regarding water and sewer connections for a trailer park Mr. Middleton proposed to open soon. Meeting was duly adjourned.
