HomeMy WebLinkAbout10-09-1978 Regular Meeting1 STATE OF ATABAMA X COUNTY OF BALDWIN X The City Council of the City of Fairhope met in regular session at 7:00 p.m., City Administration Building, 387 Fairhope Avenue, Fairhope, Alabama. 36532, on Monday, 9 OCTOBER 1978. Present were Mayor James P. Nix; Councilmen Jack A. Stipes, Billy Don Wiggins, Henry G. Bishop, Sam E. Box, Sr., David Ed Bishop; City Attorney John Duck; Acting City Clerk Evelyn P. Phillips; and a large group of inter- ested townspeople. Minutes of 25 September 1978 regular session were duly approved. Councilman Stipes moved for approval of Retail Beer License appli- cation made by Mrs. Dorothy B. Pacey for the Wash House Restaurant. Seconded by Councilman Wiggins, motion passed unanimously. Mayor Nix began the Public Hearing on the_Ordinahce to amend the Zoning Ordinance "SIGNS" section by asking for comments from the interested parties present. After much discussion, Councilman Wiggins asked for a poll of the audience. Of those present, 34 were in favor of adoption and 21 were opposed to adoption of the Ordinance amending the Zoning Ordinance. Council- man Box moved for adoption, seconded by Councilman Henry Bishop. Notion was denied by the following vote: AYE - Councilmen Box and Henry Bishop. NAY - Councilmen. Ed Bishop, Stipes and Wiggins. Ordinance No. 620, amending Zoning Ordinance per rezoning request by Starke Irvine and Sam Irby, was again presented to Council for final adop- tion after being held over from.25 September session. There is a question as to whether all property owners were properly notified. Councilman Henry Bishop moved that the property owners be notified and advertising be done to set up a new public hearing on 13 November on this request for rezoning. Seconded by Councilman Box, motion passed unanimously: Councilman Box moved for final adoption of Ordinance No. 624, an ordinance amending Ordinance No. 586, establishing new out-of-town sewer rates. Seconded by Councilman Stipes, motion passed unanimously. Councilman Ed Bishop introduced an ordinance to amend the Zoning Ordinance by establishing a $15.00 application fee plus responsibility for the costs of publication, notification postage, and any and all other costs incurred by the Planning & Zoning Commission on behalf of each applicant requesting a recommendation to the City Council for rezoning of property. Councilman Wiggins introduced an Ordinance amending the Zoning Or- dinance by establishing applicant's responsibility for costs of publication, postage, and any and all other expenses incurred by the Mayor and Council in acting upon applicant's rezoning request. 2 (9 October 1978) Councilman Stipes introduced an Ordinance to establish a $15.00 fee plus responsibility for costs of publication, postage, and any and all other costs incurred when an applicant appeals to the Board of Adjustment. Public Hearing date on these three ordinances is set for 13 November 1978. Councilman Box moved for adoption of the following Resolution. Se- conded by Councilman Ed Bishop, motion passed unanimously: BE IT RESOLVED BY THE COUNCIL OF THE CITY OF FAIRHOPE that City Attor- ney John Duck is authorized to take necessary legal action to collect from James Earle Contractors of Daphne and/or Braxton Counts Contractors of Theo- dore the amount of $4,381.74 for damages to a high-pressure Gas Main located at Lake Forest which occured on 3 August 1978. Councilman Wiggins moved that "No Parking" signs and signs prohibiting motocycles or motorbikes be placed on Mobile Street near the steps leading to Bay. Seconded by Councilman Stipes, motion passed unanimously. Mrs. Dorothy Shine of the Fairhope Public Library Board, and a large group of Library supporters, addressed the Council regarding the Library Bud- get Request. The Mayor and Council assured all present that the budget requested by the Library would be given full consideration, no budget requests however can be decided upon until after the Annual Audit is complete. Councilman Stipes moved, seconded by Councilman Ed Bishop, that City continue to operate on basis of old budget until new budget is approved. Motion passed unanimously. Councilman Box moved for a public hearing on the new budget, date to be decided upon completion of Annual Audit. Seconded by Councilman Ed Bishop motion passed unanimously. Mr. Frank Clemons and Mr. Louis Agee requested Middle Street sewer line be extended approximately 200 feet to allow them to be connected to the line. Each of them presented a $200.00 check. Councilman Ed Bishop moved to authorize the Mayor to have the line extended as requested if it can be done for approximately $400.00. Seconded'by Councilman Box, motion passed unanimously. Councilman Henry Bishop moved bills be paid as presented. Seconded by Councilman Ed Bishop, motion passed unanimously. Mayor Nix reported an additional Senior Aide to drive the Senior Cit- izen Mini -Bus had been approved by South Alabama. Regional Planning Commission.
