STATE OF ALABAMA
COUNTY OF BALDWIN
The City Council, City of Fairhope.; met in Regular Session at
7:00 p.m., City Administration Building, 387 Fairhope Avenue,
Fairhope, Alabama 36532, Monday, 25 September 1978.
Present were: Mayor James P. Nix; Councilmen David Ed Bishop,
Sam E..Box, Henry G. Bishop, Billy Don Wiggins, Jack A. Stipes;
City Attorney John Duck; and City, Engineer.Ack Moore.
Minutes of 11 September Regular Session --and 15 September, 197
Special Session were duly approved.
Final Adoption of ORDINANCE NO. 620, amending the Zoning Or-
dinance per rezoning request by Sam Irby and Stark Irvine, washeld
over ,until investigation of proper notification of property
owners Mr. Joseph Middleton and a Mr. & Mrs. Dawson
could be completed.
Councilman Box moved for final adoption of ORDINANCE NO. 621,
amending Zoning Ordinance per Tolora B. Robinson rezoning request.
Seconded by Councilman Wiggins, motion passed unanimously.
Councilman Box moved for final adoption of ORDINANCE NO. 622,
amending Fire Code Ordinance by changing year from "1965" to "1976"
Seconded by Councilman Stipes, motion passed unanimously.
Councilman Stipes moved to accept Stewart Dredging Company's
proposal to dredge Fly Creek fishing wharf area to a depth of six
feet, provided US Corps of Engineers specifications are met, for a
charge of $6,000. Seconded by Councilman Box, motion passed unan-
imously.
Councilman Stipes moved for appointment of Curtis N. William-
son to fill resigned member Bill Gable's unexpired term on the
Harbor Board (term expires April, 1980). Seconded by Councilman
Wiggins, motion passed unanimously.
Councilman Stipes moved for acceptance of Simon Street providE
a concrete header is installed at the south end of the new portion.
Seconded by Councilman Ed Bishop, motion passed unanimously.
Councilman Box introduced an ORDINANCE SETTING SEWER RATES
FOR OUT-OF-TOWN SERVICE. This ordinance will be offered.for final
adoption at next regular session.
Fairhope Paving Company (Les Boone) has offered to attempt to
straighten bulkhead at Municipal Beach for the sum of $1,000.
Councilman Wiggins moved to accept this proposal. Seconded by
Councilman Stipes, motion carried by following vote: AYE-Councilml
Wiggins, Stipes and Box; NAY - Councilman Ed Bishop; ABSTAIN -
Councilman Henry Bishop.
Councilman Ed Bishop moved, seconded by Councilman Wiggins, tc
hear a motion on an item not on Agenda. Motion passed unanimously
to hear the following motion: Councilman Wiggins moved the City
donate an old junked garbage truck chassis to the Marlow Fire
Department. Seconded by Councilman Ed Bishop, motion passed unan-
imously.
Items of old business discussed included a report by Mr. Pope
of Major Homes, Inc., that the drainage pipe to be installed in
Paddock Estates development is being held up by one property owner
Mr. Pope will advise final outcome as soon as possible.

Councilman Stipes asked that Ordinance setting safe -load
limits for City Streets be called to the attention of developers
hauling dirt and materials to job sites. City Superintendent Phil
Rutherford reported school buses have been re-routed in the Patlyn
and Fairwood Drive area.
Councilman Ed Bishop reported Mr. Donaldson of the School
Board is working on the problem of removing old school building
hazard located corner of Church and Morphy Streets.
Mr. Gary Sandell asked for assistance in asking people to
install house numbers on their homes.
Councilman Henry Bishop moved bills be paid as presented with
the exception of Community Consultants' bill for $147.90 following
a discussion regarding the merit of this charge. On questioning
of the Mayor by Councilmen Stipes and Wiggins, the Mayor stated
Community Consultants had not been asked to assist in requesting
Federal Relief Funding for flood damage resulting from 16-inch
rainfall on 26 July 1978. It was noted that in the City's agree-
ment with Community Consultants, the firm would perform their
services for the City only when asked to do so. Motion was se-
conded by Councilman Wiggins and passed unanimously.

ORDINANCE NO. �0
An ORDINANCE amending ORDINANCE NO. 557, adopted 11 August 1975, known as
the ZONING ORDINANCE.
BE IT ORDAINED BY THE CITY COUNCIL, CITY OF FAIRHOPE, as follows:
The Ordinance commonly known as the Zoning Ordinance adopted on
11 August 1975 together with the Zoning Map of the City of Fairhope, be,
and the same hereby is changed and altered in respect to that certain
property described as follows:
Lots B and C of a plat by 0.0. Stewart of the Tolora Robinson
land on east side of Pensacola Street. Said plat dated
12 October 1972.
(Zoning change requested by Tolora B. Robinson)
The classification of said property is hereby changed from R-2 Medium
Density Single Family Residential Development to R-4 Low Density Multi -
Family Residential Development
and it shall hereafter be lawful to construct on such property any struct-
ures permitted by Ordinance No. 557 and to use said premm-ses for any use
permitted by the terms of Ordinance No. 557; provided, however, that
the plans for any structure or building sought to be erected on said prop-
erty shall be in compliance with the building laws of the City of Fairhope
and that any structure shall be approved by the Building Inspector of the
City of Fairhope and that any such structure be erected only in compliance
with such laws, including the requirements of said Ordinance No. 557 of
11 August 1975.

An ORDINANCE amending ORDINANCE NO. 350, adopted the lst day of
September, 1965, known as the FIRE CODE ORDINANCE.
BE IT ORDAINED BY THE CITY COUNCIL, CITY OF FAIRHOPE, as follows_
The year "1965" is hereby amended to read "1976"
