HomeMy WebLinkAbout08-02-1978 Special MeetingSTATE OF ALABAMA COUNTY OF BALDWIN The City Council on Wednesday, 2 August Building, 387 Fairhope purpose of discussing of a fiscal agent and X of the City of Fairhope met in special sess 1978, at 5:00 p.m. at the City Administrat Avenue, Fairhope, Alabama 36532,for the an unexpected development regarding the hir for an up -date on flood damage funding. Present were Mayor James P. Nix; Councilmen David Ed Bishop, Sam E. Box, Henry G. Bishop, Billy Don Wiggins and Jack A. Stipes. Mayor Nix and Councilman Henry Bishop reported they had been advised by Frazer -Lanier that an agreement exists between the City and Frazer -Lanier which has been in effect since 19 June 1976oand that this agreement retains their firm as the City's fiscal agent until cancelled by written notice within 60 days of cancellation day. Investigation reveals such an agreement does exist with the result that further discussions will have to take place before a fiscal agent can be retained. There is no reflection on Frazer - Lanier or Thornton, Farish & Gauntt intended by Council, however, in order to protect the interests of all parties, it was decided, and so moved by Councilman Box, to revoke the motion retaining Thornton, Farish & Gauntt as fiscal agent which was passed at Council Meeting on 29 July 1978. Upon a second by Councilman Henry Bishop, the vote was: In favor of revocation - Councilmen Box, Henry Bishop and Wiggins. Opposed - Councilmen Ed Bishop and Jack Stipes. Motion carried to revoke the.motion of 29 July 1978. Mayor Nix reported to Council that all action possible is being taken to have the President of the United States declare that a major disaster exists in our area in order to receive federa assistance under the provisions of the Disaster Relief Act of 1974. A copy of a letter from Alabama's --Governor George C. Wallace to President Jimmy Carter was presented to each Councilman. Some response is expected in the next ten days. Mayor Nix further reported he had been advised the US Corps of Engineers had already requested emergency authorization to dredge the channel in Fly Creek which should alleviate some of ----the problems at the Fishing Docks. In regard to the broken sewer line which runs from Myrtle Stre to Section Street near Bon Secour Street, Mayor Nix reported the awarding of the contract to Fairhope Paving Company at a low bid of $27,075.00. Meeting was duly adjourned. Credle, Regional Director Department of Housing and Urban Development Federal Disaster Assistance Administration 1375 Peachtree St., N.E., Region IV Suite 750 Atlanta, Georgia 30309 Dear Mr. President: I respectfully request that you declare that a major disaster exists in the State of Alabama under the provisions of the Disaster Relief Act of 1974, Public Law 288, 93rd Congress. During the period of July 25th through July 27th, 1978, heavy rains and lightning caused destruction and damage to public and private property .in one county of the state. There were one dead, none injured, 'twenty-five evacuated, twenty homes and eight businesses with minor, moderate or severe damages. There was flood insurance. There were major damages to roads, streets and public facilities (power systems, water, sanitary, road systems) and crop damage. Total damage estimates at this time are: Public $1,450,000/Private $600,000/;agriculture $996,000. Principle problems were damage to road systems, sanitary sewer systems and water systems. On July 215, 1978, I directed the execution of the State Emergency Plan in accordance with Section 301 of the Law. State and local . efforts in response to this disaster situation have been: the. severe weather alert and notification put into operation; State and local emergency teams/personnel were deployed to the disaster scenes and began recovery operations, e.g., emergency repair to facilities, evacuation and rescue operations. Credle, Regional Director July 31, 1978 Page 2 I find that the situation is beyond the capabilities of the State and the affected local governments to effectively alleviate the existing situation in that the State and local governments have expended money from budgets that were only adequate for normal operating costs. Funds are needed to assist individuals and government entities to overcome the loss of crops, businesses, personal belongings, to remove debris and repair public and private non-profit facilities. Many roads and streets are blocked causing excessive traffic detours. Some sections of Daphne and Fairhope are operating sanitary and sewage systems on temporary connections. Pursuant to Section 301 of the Law and Federal Disaster Assistance Administration regulations, I certify that the total of expenditures and obligations for this disaster for which no Federal reimbursement will be requested are expected to exceed $50,000 in accordance with the following table: PUBLIC ASSISTANCE: STATE STATE 'LOCAL Debris & Wreckage Clearance $0 $0 Protective Work 0 5,000 Restoration of Public Facilities (Note 1) 50,000 20,000 Other (Specify) 0 0 TOTAL $50,000 $25,000 Note 1. $50,000 from the budget of the State Highway Department will be allocated to perform maintenance and recovery work on county roads. Technical assistance is being furnished to entities by the Highway Department and the Health Department. Additional considerations which support the necessity for Federal assistance in this disaster situation are that: Baldwin County sustained heavy damage.from flooding in February and May, 1978 for which they received no Federal assistance. This required expenditures of over $300,OOO for repairs and reconstruction to the county road system. These expenditures depleted the county's road fund budget. The financial conditions of Fairhope (population 6,063) and Daphne (population 2,382) precludes them from recovering to any appreciable extent unless they receive substantial financial help. Local government commitments (as indicated) are expenditures by the cities of Fairhope and Daphne on July 25th and July 26th, 1978. Reimbursement will be for all county expenditures and for munici- palities beginning July 27, 1978. Categories C and I have been verified by State Engineers. Sincerely,, ` ' is George C.
