HomeMy WebLinkAbout06-26-1978 Regular MeetingSTATE OF ALABAMA COUNTY OF BALDWIN The City Council, City of Fairhope, met in regular session on Monday, 26 June 1978, at 7:00 pm in the City Administration Building, 387 Fairhope Avenue, with the following members present: Mayor James P. Nix and Councilmen Jack A. Stipes, Ed Bishop, Sam E. Box, Billy Don Wiggins and Henry G. Bishop. Minutes of 12 June 1978 were approved. Councilman Stipes moved that Renay Tinsley, dba THE TEN CRISP, be approved for a Retail Beer License. Upon being seconded by Councilman Henry Bishop, motion passed unanimously. Councilman Ed Bishop moved that the City purchase a Pitney - Bowes Mailing Machine and Scale for a Cash Price of $566.80 and that we rent their Postage Meter for $11.75 per month (billed quarterly). Councilman Stipes seconded, motion carried. Mayor Nix advised Council that the "201 Program" has no monetary provisions for drainage. Mayor Nix presented, for the Garden Clubs of Fairhope, som( several hundred signed letters from local citizens requesting the City's help in establishing Nature Trails in Fairhope. Consensus was to consider at a later time what the City could contribute if the Garden Clubs provide the expertise, supervision, planning and design for these Trails. Mr. Don Brady of the South Alabama Regional Planning Com- mission came before Council to request adoption of the 208 Water Quality Management Plan for Mobile and Baldwin Counties which he had presented to Council at the last meeting. He reported that all of Baldwin County and most of Mobile County had adopted the Plan and that 100% participation was anticipated by July. Mr. Bra( confirmed the figures used in the projected implications of the ply included a 5% inflation factor and that the Plan was to be renewed each year. Councilman Box moved for adoption of the 208 Water Quality Management Plan and was seconded by Councilman Ed Bishop. Motion passed unanimously. Mr. Bobby Pope, owner of the Yardarm Restaurant, addressed Council regarding problems at the Municipal Pier Parking Oval. Th( two-hour parking limit is resulting in overtime parking tickets for patrons of the Restaurant and owners of boats docked at the Pier Marina. Councilman Stipes moved the Parking Limit signs be remove( Councilman Wiggins seconded, motion carried. Councilman Wiggins made a motion to have a suitable (chain link) Fence erected from the north end of the small wooden fishing pier to the tree next to the beach entrance road in order to solve the problem of people parking in the Oval and walking down onto the beach to avoid Beach Admission charge. The fence would also have a sign stating "Walk-Ins-$1.00". Fence is to. be paid for out of beach revenue. Councilman Stipes seconded, motion passed. Councilman Stipes presented a report on three options for the handling of garbage. This will be taken under advisement unti. next Council meeting. Councilman Henry Bishop moved that the Gas Study prepared by St. Johns Engineering be accepted with thanks. Councilman Box seconded, motion passed. Councilman Box introduced AN ORDINANCE TO ADOPT NEW GAS RATES FOR ALL GAS CUSTOMERS WITHIN THE CITY LIMITS OF FAIRHOPE, ALABAMA, AND ALL GAS CUSTOMERS OUTSIDE THE CITY LIMITS OF FAIRHOPE ALABAMA, AND TO DESIGNATE EACH CLASS OF CUSTOMERS THEREIN in writt( Minutes of City Council Meeting 26 June 1978 . Pap-e 2 form. Councilman Box then moved to suspend the rules for the pur- pose of permitting this Ordinance to be finally passed and adopted at this meeting. Seconded by Councilman Wiggins, the roll call vot( was: Councilman Box - Aye, Councilman Wiggins - Aye, Councilman Stipes - Aye, Councilman Henry Bishop - Aye, and Councilman Ed Bishop - Aye. Motion passed.unanimously. Councilman Box moved this Ordinance, ORDINANCE #617, be finally adopted. Seconded by Councilman Henry Bishop, the roll ca 1 vote was: Councilman Box - Aye, Councilman Wiggins - Aye, Council- man Stipes - Aye, Councilman Henry Bishop— Aye, and Councilman Ed Bishop - Aye. Motion passed unanimously. (ORDINANCE #617 ON PAGES 3 - 7) Councilman Box introduced AN ORDINANCE TO ESTABLISH GAS CURTAILMENT PLAN AND FIXING PRIORITIES FOR THE DIFFERENT GAS CUSTOMERS OF THE CITY OF FAIRHOPE in written form. Upon a motion by Councilman Box, seconded by Councilman Stipes, to suspend the rules for the purpose of permitting this Ordinance to be finally passed and adopted at this meeting, the roll call vote was: Councilman Box - Aye, Councilman Wiggins - Aye, Councilman Stipes- Aye, Councilman Henry Bishop - Aye, and Councilman Ed Bishop - Aye Motion passed unanimously. Councilman Box moved this Ordinance, ORDINANCE #618, be finally adopted. Seconded by Councilman Henry Bishop, the roll cal: vote was: Councilman Box - Aye, Councilman Wiggins - Aye, Council- man Stipes - Aye, Councilman Henry Bishop - Aye, and Councilman Ed Bishop - Aye. Motion passed unanimously. (ORDINANCE #618 ON PAGES 8 - 9) Mrs. Frances Lucassen asked Council to reconsider refund- ing a deposit made by her in 1960 in the amount of $75.00 which Council had voted against doing at the last meeting. After some discussion, Councilman Henry Bishop moved to issue Mrs. Lucassen a Deposit Refund check for $75.00. Seconded by Councilman Stipes, motion carried. Councilman Ed Bishop moved to introduce the following Resolution: WHEREAS, the City Council is concerned about the present condition of the old School Building located on Church & Morphy Streets, and, WHEREAS, this condition is one of hazard and danger and could cause severe problems in our community, NOW THEREFORE, be it resolved that the City Council is desirous to know what the School Board plans to do to rectify this situation. Seconded by Councilman Henry Bishop, motion carried. Cou'tcilman Stipes moved the bills be paid as presented witl the exception.of Moore Engineering's bill for work at Paddock Estai This bill is to be returned as Mr. Pope was to pay for this work. G AN ORDINANCE TO ADOPT NEW GAS RATES FOR ALL GAS CUSTOMERS WITHIN THE CITY LIMITS OF FAIRHOPE, ALABAMA, AND ALL GAS CUSTO OUTSIDE THE CITY LIMITS OF FAIRHOPE, ALABAMA, AND TO DESIGNATE EACH CLASS OF CUSTOMERS THEREIN. SECTION I - There is hereby established rate designations for all gas customers served by the City of Fairhope, Alabama as follows: G 1 Inside General Service G 2 Outside General Service G 3 Large Commercial & Industrial -- Inside City Limits, Fairhope G 4 Large Commercial & Industrial -- Outside City Limits, Fairhope G 5 Special Rates (Grand Hotel & Town of Daphne) G 6 City Use (Valued on Inside General Service) SECTION II - GENERAL SERVICE WITHIN CITY LIMITS - G 1 (Residential & Small Commercial) A. There is hereby established natural gas services to individual dwellings or apartments, municipal and school buildings and small individual commercial establishments whose physical location is within the corporate limits of the City of Fairhope, Alabama. Service to more than one premises shall not be combined, nor shall it be shared with or resold to others. Designations shall be known as G 1 as hereinabove set out. B. MONTHLY RATE First 300 cu.ft. or less for $2.25, plus Next 1,000 cu.ft. or less $0.40, per 100 cu.ft.,plus Next 8,700 cu.ft. or less $0.32, per 100 cu.ft.,plus Next 90,000 cu.ft. or less $0.26, per 100 cu.ft.,plus All over 100,000 cu. ft, for $0.235 per 100 cubic feet. C. MINIMUM BILL The minimum monthly bill for any one customer shall be $2.25. D. TAXES The above rate is that charged by the City of Fairhope, a any additional charges levied by State or Federal authorities, such as the 4% Educational Tax, will be in addition to the above rate schedule. PAYMENT Bills for service rendered hereunder are payable within ten (10) days from due date, and if not paid within such period, a five (5%) percent penalty shall be added to the amount of the total bill rendered. SECTION III - GENERAL SERVICE OUTSIDE CITY LIMITS - G 2 (Residential and Small Commercial) A. APPLICABILITY Applicable for natural gas service to individual family dwellings and apartments, municipal and school buildings, and small individual commercial establishments whose physical locat- ion is outside the corporate limits of the City of Fairhope. Service to more than one premises shall not be combined (unless served through one meter), nor shall it be shared with or resold to others. B. SECTION IV - LARGE COMMERCIAL & INDUSTRIAL RATE (G 3 -- Inside, G 4 -- outside) A. APPLICABILITY Applicable to large commercial and industrial customers whose median monthly consumption is 100 Mcf or above on an inter- ruptable basis and is restricted to those establishments which heretofore have been served under commercial and special rates, and terminated constracts. Service to more than one premises shall not be combined (unless served through one meter), nor shall it be shared with or resold to others. B. MONTHLY RATE First 20,000 cu. ft. or less for $60.00, plus Next 80,000 at $ 0.26 per 100 cu. ft, plus, Next 900,000 cu. ft. or less at $ 0.235 per 100 cu. ft., plus All over 1,000,000 cu. ft. at rate $ 0.215 per 100 cu. feet. C. MINIMUM BILL Minimum monthly bill for G 3 & G 4 customers shall be $60.00. D. TAXES The above rate is that charged by the City of Fairhope, and any additional charges levied by State or Federal authorities, such ast he 4% Educational Tax, will be in addition to the above schedule and related charges. E. DELIVERY PRESSURE Normal delivery pressure to the customer shall be deter- mined by the pressure available in the City of Fairhope's mains at the customer's location and may be reduced, as necessary, by the City to comply with supplier and regulatory curtailment directives under the current Modified IV Catagory Plan. Where the customer's operational pressure requirements exceed the delivery pressure available at the customer's location, thus re- quiring the installation of increased compressor capacity, a -3- Minu f City Council Meeting 26 June 1978 Page 6 pressure factor (corresponding to the psig) will be used to cal- culate actual monthly consumption of gas to be billed. F. DAILY OVERRUN PENALTY In the event that a Maximum Daily Quantity (MDQ) overrun penalty is levied against the City due, in part or in whole, to industrial delivery overruns, the industry will pay a daily over- run penalty of $1.00 per 100 cubic feet (Ccf) against all units in excess of the industry's established MDQ, in addition to the above schedule. G. PAYMENT Bills for services rendered hereunder are payable within ten (10) days from due date, and if not paid within such period, a five (50) percent penalty will be added to the total amount billed. H. TERM OF CONTRACT Service under this G 3 & G 4 shall be for a minimum initial period of one (1) year, and thereafter from month to month until terminated by thirty (30) days written notice, or as is specified in any existing contract for services. SECTION V - GRAND HOTEL NATURAL GAS RATE - G5 WHEREAS, the natural gas purchase rate of United Gas Pipe Line Company to the City of Fairhope, Alabama will be increased from $1.5508 per thousand cubic feet (Mcf) to $1.6390 per Mcf, effective July 1, 1978; and WHEREAS, the 1950 service agreement between Fairhope and Grand Hotel in Paragraph Six allows wholesale purchase cost in- crease adjustments to the retail rate charged by the City of Fairhope to the Grand Hotel in Exhibit A of said contract; NOW, THEREFORE, the following natural gas rate will be levied for all gas sold to the Grand Hotel by the City of Fairhope, effective July 1, 1978, until subsequent wholesale increases or decreases by United Gas Pipe Line Company, or until November 9, 1978, the termination date of the now existing contract with the Grand Hotel: -4- Minutes of City Council Meeting 26 June 1978 First 300 cu. ft. or less for $2.39, plus Next 1,000 cu. ft. or less for $0.29 per 100 cu. ft,pl s Next 1,700 cu. ft. or less for $0.27 per 100 cu.ft.,pl s Next 17,000 cu. ft. or less for $0.22 per 100 cu.ft.,pl s Next 30,000 cu. ft. or less for $0.20 per 100 cu.ft.,pl s Next 200,000 cu. ft. or less for $0.189 per 100 cu.ft,pl Next 750,000 cu. ft. or less for $0.1789 " 19if ", p1luc All over 1,000,000 cubic feet at $0.1759 per 100 cubic feet. PAYMENT: Bills for service rendered hereunder are payable within ten (10) days from due date, and if not paid within such period, a five (5%) percent penalty shall be added to the amount of the total bill rendered. SECTION VI - That if any part of this Ordinance shall be ruled unConstitutional by any court of competent jurisdiction, then all other parts or sections herein shall remain in full force and effect. SECTION VII - Any and all Ordinances in conflict herewith be, and the same are hereby repealed. SECTION VIII - This Ordinance shall take effect July 1, 1978 after its due adoption and publication as required by law. ADOPTED THIS THE 26th day of June, 1978. (p a AN ORDINANCE TO ESTABLISH GAS CURTAILMENT PLAN AND FIXING PRIORITIES FOR THE DIFFERENT GAS CUSTOMERS OF THE CITY OF FAIRHOPE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FAIRHOPE, Fairhope, Alabama: SECTION I - Whenever the Gas supply is delivered to the City of Fairhope by its supplier, "UNITED GAS PIPELINE COMPANY", if not sufficient to meet the requirement of all customers of the City served from its gas system, the City of Fairhope may interrupt or curtail service to any customer or customers in accordance with the following priority schedule. Priority I shall be the highest priority and the last class of customer curtailed or interrupted. PRIORITY DESCRIPTION I All residential requirements, and those small commercial requirements of less than 50 Mcf per day. II Large commercial human needs & public buile- ing customer requirements. f III Large commercial requirements other than Priority II, and industrial requirements of 50 Mcf per day or less. IV Industrial requirements not otherwise specified. SECTION II - When curtailment of gas deliveries becomes necessary for any reason, gas volumes shall be curtailed or interrupted pro rata among all customers in Priority IV until all customer gas requirements have been curtailed or cut-off point reached. If, the curtailment of Priority IV is not sufficient, and further curtailment or interruption is necessary, volumes shall be curtailed or interrupted pro rata through each Priority, beginning with III and proceeding through I, as necessary to satisfy each curtailment volume from the gas supplier. SECTION III - Customers served from the City gas distri- bution system owned and operated by the City of Daphne shall be curtailed in accordance with the above priority system of Fairhope. Such curtailment will necessitate reduction in `Minutes of City Council Meeting i26 June 1978 Page 9 volume in gas purchased by Daphne in order to meet and abide by the requirements of curtailment so that the results pre- scribed by the curtailment program can be realized. On Daphne's failure to do so, Fairhope may reduce pressure and/or volume of gas delivered to Daphne at the three delivery points into Daphne's system, such reduction to be based on records of consumption available to Fairhope on its base year records. SECTION IV - This Ordinance shall not abridge or contr- vene any of the provisions of the contract and Court Orders between the City of Fairhope and the Town of Daphne and they shall remain in full force and effect, and that reductions may made as they become necessary and under such terms as is re- quired by the gas supplier, or as directed by a regulatory authority, any governmental agency or any court of competent jurisdiction. SECTION V - Each Section herein shall be considered independent of the other, and any Section herein ruled un- Constitutional by any court of competent jurisdiction, the remaining Sections shall remain in full force and effect. SECTION VI - This Ordinance shall take effect upon the First day of July, 1978, after its due adoption and publication as required by law.
