HomeMy WebLinkAbout06-12-1978 Regular MeetingSTATE OF ALABAMA COUNTY OF BALDWIN The City Council, City of Fairhope, met in regular session on Monday, 12 June 1978, at 7:00 pm in the City Administration Build- ing, 387 Fairhope Avenue, with the following members present: Mayor James P. Nix and Councilmen Jack A. Stipes, Ed Bishop, Sam E. Box, Billy Don Wiggins and Henry G. Bishop. Miss Diane Trengove, an Australian Exchange Student from Ringwood, Australia, came before the Council to present a book; entitled "Ringwood, Place of Many Eagles" by Hugh Anderson,to the Mayor and Council from the Mayor and Council of Ringwood. Miss Trengove expressed her thanks and appreciation for the many happy hours she had spent here in Fairhope during the past year. Mayor Nix accepted the gift and said the book would be placed in our Public Library for our citizens to enjoy. Mr. Don Brady of the South Alabama Regional Planning Commis- sion addressed the Council on the 208 Water Quality Management Plan for Mobile and Baldwin Counties. Mr. Brady reported that Gulf Shores, Loxley and Bayou La Batre have adopted this plan. The Council accepted the informational sheets provided by Mr. Brady for study and later action. Councilman Henry Bishop made a motion that the City repay Mayor Nix for monies spent to keep the Fairhope Ambulance Service in operation and to ay Fairhope Ambulance Service a Five Hundred Dollar monthly fee ($500.00) from now until the end of current Fiscal Year. Seconded by Councilman Stipes, motion carried over two nay votes by Councilmen Wiggins and Box. Councilman Stipes made a motion that the following RESOLUTION be adopted. Seconded by Councilman Ed Bishop, motion carried. Be it resolved that the City Council, City of Fairhope, urges all Fairhope Citizens to take out the Ambulance Policy provided by the Fair - hope Ambulance Service. It was furthehr��,,s��uuggested and agreed that a meeting of interest persons would be / t`the City Administration Building on Thursday; ?2 June 1978, at 10:00 am to plan ways and means of aiding Mr. Gary Sandell of the Fairhope Ambulance Service in obtaining at least 1,000 subscribers for the Ambulance Service. Mr. Sandell reported some 300-plus present subscribers and, if a total of 1,000 could be reached, he felt the Service would no longer need help from the City monies. General Councilman Stipes and/Superintendent Phil Rutherford reported that the drainage problem at Material Sales Company could be alleviated by some 40% if 24" pipe were installed down Brown Street This will be taken under consideration after Councilman Stipes meets with the Single Tax Colony in regard to the size pipe they plan to use during their paving project in this area. Motion by Councilman Box to adopt the following RESOLUTION] s seconded by Councilman Ed Bishop and carried unanimously: WHEREAS, Builders Center, Inc., a Louisiana Corporation, has requested of the City of Fairhope to relocate approximately 672 L.F. of 6" high-pressure mill - wrapped steel gas transmission pipe lines, including two (2) 6" gas valves and two (2) 6" line stoppers and miscellaneous fittings located south of the I-10 interchange with US #98, running south in Baldwin County, Alabama, said gas lines being owned by the City of Fairhope, and, fed WHEREAS, the City of Fairhope is willing to accept and relocate the said gas lines according to the Minutes of City Council Meeting 12 June 1978 Page 2 engineering designed plan and under the super- vision of Moore Engineering Company, and, WHEREAS, the City of Fairhope is willing to authorize the Mayor and acting City Clerk to enter into an agreement with Builders Center, Inc., a Louisiana Corporation, for the payment of the cost of the relocation thereof, said costs being estimated at a total of Twenty Thousand Nine Hundred ($20,900.00) Dollars, and, WHEREAS, the City of Fairhope is willing to further authorize the Mayor to enter into said agreement if the said agreement provides that the Builders Center, Inc., a Louisiana Corporation, shall be liable for any costs overruns on the saidproject and is willing to enter into the agreement to pay the overruns within 30 days from the submittion of due proof by the City of Fairhope, and NOW, THEREFORE, be it resolved by the City Council of the City of Fairhope, Alabama, that the Mayor, and Acting City Clerk be, that they are hereby authorized to enter into an agreement with Builders Center, Inc., a Louisiana Corporation, to re- locate a gas transmission pipe line as hereinabove set out, according to the engineering design and specifications and under the supervision of Moore Engineering Company of Fairhope, Alabama, upon Builders Center, Inc., paying to the City of Fairhope, the sum of Twenty Thousand Nine Hundred ($20,900.00) Dollars prior to the beginning of the construction of the relocation of the said work. BE IT FURTHER RESOLVED, that a copy of the said agreement be incorporated into the minutes of the meeting on this date and made a part hereof as fully set out herein. City -of Ifairhol e Upon motion being made by Councilman Box, seconded by Council• man Wiggins and carried by unanimous vote, the following AGREE- MENT is entered into: IMini of City Council Meeting 12 , 1978 Page 3 AGREEMENT STATE OF ALABAMA COUNTY OF BALDWIN THIS AGREEMENT, made this the _day of 1978, by and between the CITY OF FAIRHOPE, a muni pal corp- oration, organized and existing under the Laws of the State of Alabama, by and through its duly authorized Mayor, hereinafter referred to as "FIRST PARTY" and BUILDERS CENTER, INC., a Louisiana corporation, organized and existing under the Laws of the State of Louisiana, by and through its duly authorized officers, hereinafter referred to as "SECOND PARTY", WITNESSETH: WHEREAS, the FIRST PARTY herein is the owner of gas lines located on U.S. Highway #98, running from South of the I-10 interchange along said U.S. Highway #98 to Daphne Alabama, and WHEREAS, the SECOND PARTY herein is desirous of having the FIRST PARTY herein lower the said gas line, according to the engineering design and supervision of Moore Engineering Company, Inc., and WHEREAS, the CITY OF FAIRHOPE, by and through its governing body has adopted a resolution authorizing the Mayor to enter into a contract with the SECOND PARTY herein for the said work. NOW, THEREFORE, the Parties herein do hereby agree as follows: 1. That the FIRST PARTY herein shall relocate approxi- mately 672 L.F. of 6" high pressure mill wrapped steel gas transmission pipe line, including two (2) 6" gas valves and two (2) 6" line stoppers and miscellaneous fittings located South of the I-10 interchange with U.S. Highway #98 in Baldwin County, Alabama, according to the engineering design and supervision of Moore Engineering Company, Inc. That the approximate cost of the relocation is TWENTY THOUSAND NINE HUNDRED ($20,900.00) DOLLARS and that the SECOND PARTY herein hereby agrees to pay the said sum upon the due execution of this Agreement by both Parties herein, and before the said work is to be started. 3. That the FIRST PARTY herein hereby agrees to begin the relocation upon the payment of the amount herein stated, in advance, and upon the approval of Moore Engineering; the engineering firm that shall be supervisor of the relocation according to its engineering design and supervision of const- ruction plans and specifications. 4. That the SECOND PARTY herein hereby agrees that if there is any cost overrun that it is to pay to the FIRST PARTY herein such sum, upon due proof from the submission of the cost overruns. Seconded by Councilman Wiggins, motion carriec Mrs. Frances Lucassen requests that a Utility Deposit in the amount of $75.00 made by her in June of 1960 be refunded to her. Councilman Stipes made a motion that this refund be made only if Mrs. Lucassen can provide proof of deposit payment (such as a pro- per receipt). Seconded by Councilman Wiggins, motion carried. Councilman Box made a motion that the repairs on the outfall line from the Sewer Plant be put out for bids. Councilman Wiggins seconded, motion carried. Motion was made by Councilman Wiggins that Mr. Herman Taylor be appointed Fire Marshall and Fire Inspector for the City of Fairhope and that his salary be increased by one step. Seconded by Councilman Box, motion carried. City Engineer Ack Moore reported to the Council that the Twin Bay Water System project is being held up pending some paper work required by the Farm and Home Administration. Action delayed until this is cleared up. City Engineer Moore also presented the Council with hi.s recommendations regarding the acceptance of the streets in the Paddock Estates Sub -division. Councilman Stipes moved that the City Engineer's recommendations be accepted with the further pro- vision that two more bore -tests be made at points designated by Council on the plans, that a build-up of .lots be made as discussed, that a 24" concrete pipe be used in drainage to gully as shown on plans, and that a meeting is held between Contractor, City Engineer and Property Owner Beard; then, the City will accept the streets for maintenance. Seconded by Councilman Wiggins, motion carried. Councilman Stipes moved that when streets are paved and curbs are finished on any City Street Improvement Project, the Stop Sign be re -erected immediately. Seconded by Councilman Wiggins, motion carried. Councilman Wiggins made a motion that a fee of Five Hundred Dollars ($500.00) per month be charged the City of Daphne for the use of the Fairhope Police Radio and Jail. Councilman Stipes seconded, motion carried. Councilman Stipes moved that a Public Hearing be held at the first Council meeting in July regarding zoning changes on the Dyas and other Propertys. Seconded by Councilman Wiggins, motion carrie Councilman Wiggins moved that advertising of this Public Hear ing be done. Seconded by Councilman Ed Bishop, motion carried. A motion was made by Councilman Henry Bishop that the outline of duties for City Clerk, Treasurer and Bookkeeper be changed to delete that part regarding a monthly Bank Reconciliation of all Bank Accounts be made by the City Auditing Firm. Seconded by Councilman Stipes, motion carried. Motion by Councilman Henry Bishop, seconded by Councilman Ed Bishop, that bills as presented be approved for payment. Motion carried. Liquor License for Renay Tinsley dba THE TEN CRISP (formerly Allen's Seafood) was discussed for the first time. .S" Minutes of City Council Meeting 12 June 1978 1 1Page 7 Councilman Stipes moved that a resolution be adopted to the effect that no City Sales Tax would be levied without the approval of majority popular vote. Seconded by Councilman Henry Bishop, motion was denied by three Nay Votes by Councilmen Wiggins, Box, and Ed Bishop.
