HomeMy WebLinkAbout05-22-1978 Regular MeetingSTATE OF ALABAMA COUNTY OF BALDWIN The City Council, City of Fairhope, Alabama met in regular session on Monday, May 22, 1978 at 7:00 pm in the City Administration Building, 387 Fairhope Avenue with the Following members present: Mayor James P. Nix, Councilmen; Ed Bishop, Sam E. Box, H. G. Bishop, Don Wiggins, and Jack A. Stipes. Mxs. Florence Thames came before the Coucil to present letters explaining that funds were available through funding agencies to assist Senior Citizens in securing a place to live that they can afford. Also meals and transportati and requested to the Council to pursue these methods so our Senior Citizens would not have to move to other areas. Councilman Jack A. Stipes reported on a study of ambulance service in several communities and how they have helped find this service. Motion by Councilman Stipes to enter into a contract with Fairhope Ambulance Service at a cost of $500.00 per month for a one year period. Seconded by Councilman Ed. Bishop. Upon being put to a vote; voting aye -Councilmen Stipes and Bishop Voting nay -Sam Box, Henry G. Bishop and Don Wiggins. Motion Denied. Councilman Sam Box introduced an ordinance to impose a 2 (two) ',0 Sales Tax used for (a) supporting an ambulance service (b) provide funds for a civic center (c) for the general fund of the City of Fairhope. The motion was out of order because it was not in written form. Motion was withdrawn at Councilman Box's request. Ack Moore of Moore Engineering reported on inspection of Paddock Estates as to compaction, thickness of blacktop, grades on curbs and drainage. The developer of Paddock Estates has been informed of his responsibility. Mayor Nix reported on Funds in the Merchants National Bank: Water and Sewer Bonds Account that could be transferred to the Water and Sewer Operating Account. Councilman Box moved to introduce the following resolution: WHEREAS., there are excess funds on deposit at Merchants National Bank for improvements to our water system and, WHEREAS, it was necessary to repaint the one million gallon water tank both inside and out and remove the smaller seventy five thousand gallon tank. NOW THEREFORE, be it resolved that the Mayor and the City Auditors pr with the withdrawal from any of the accounts where there is a surplus up to the amount of $45,000.00 for the payments of the improvements. Seconded by Councilman Henry G. Bishop. Motion Carried. Motion by Councilman Stipes, seconded by Don Wiggins that Beer Permit for Carolyn Watkins Watts, Young Street Address be allowed. Motion Carried. Mayor Nix reported to the Council that there was a possibility the City could secure one supervisor and manpower through the CETA program, to be used on drainage problems. Motion by Don Wiggins, providing the City could get a supervisor to over see the men to proceed with the application. Seconded by Councilman Stipes. Motion Carried. Minutes of the City Council Meeting May 22, 1978 Page 2 After a discussion on traffic hazzards on So. Section St.,Councilman Henry G. Bishop moved to introduce the following resolution: WHEREAS, the US Post Office in Fairhope is used daily by more people than most buildings and, WIEREAS, it is located onone of the most congested and troubled streets in town and, WIEREAS, the parking situation around the Post Office is deplorable at best and extremely unsafe, does not meet the requirements of Planning and Zoning rules and regulations, NOW THERFORE, be it resolved that the Mayor and City Council of the City of Fairhope enlist the help of the US Postal Service, Senator Sparkman, Senator Allen and Congressman Edwards is seeing that the present owners of the Post Office Building be required to meet all of the requirements of the Planning and Zoning rules and regulations, thus providing safe ingress and egress or other Postal facilities. So Carried. Councilman STipes made the motion that the City Superentendant inspect all new streets'eurbs, gutters, and underground drainage before any monies are approved for payments. Seconded by Councilman Ed Bishop. Motion carried. Nbtion by Don Wiggins, seconded by Sam.E Box that two (2�parking signs be placed in effect around the oval at the Municipal Pier. All cars without Beach Stickers or a ticket from the booth will be in violation. Police to issue parking tickets. Motion carried. Mr. John Duck, City Attorney, reported back to the City Council that it was his legal opinion that a restuarant does not comply with the intent of B-1 Zoning and recommended that the Zoning Ordinance be brought up to include restuarants in B-1 Zone if it were the Council's wish to allow the request of Mr. Mulcahey. Nbtion by Councilman Ed Bishop, seconded by Councilman Stipes to deny the issuance of a Building Permit for a restaurant in B-1 Zoning. Motion carried. Nbtion by Don Wiggins, seconded by Jack Stipes, should an application for a Building Permit being compatiable for B-1 Zoning be requested by Per. Mulcahey then it should pass. Motion carried. Nbtion by Councilman Henry Bishop, seconded by Councilman Don Wiggins, that bills as presented be approved for payment. Motion carried. Mr Pennington of Material Sales presented a drainage problem to the Council and requested some action be taken to alleviate the water that flows across their property from Brown and Johnson streets then on across Fairhope Ave. Cotnci]man Stipes stated that he would check into this matter. There being no further business the meeting adjourned.
