HomeMy WebLinkAbout03-27-1978 Regular MeetingSTATE OF ALABAMA COUNTY OF BALDWIN The City Council of the City of Fairhope, Alabama met in regular session on Monday, March 27th, 1978, at 7:00 P.M., at the City Administration Building, 387 Fairhope Avenue, Fairhope, Alabama with the following members present: Mayor James P. Nix; Councilmen: David E. Bishop, Henry G. Bishop, Sam E. Box, Jack A. Stipes and Billy Don Wiggins. The minutes of the March 13, 1978 were corrected as follows: Councilman Jack Stipes moved, seconded by Councilman Henry G. Bishop, for the City to remove the old steps at the foot of Perdido going down to the beach since they were unsafe and there was an errosion problem, and to hold up on the repair or installation of new steps until a study can be made to correct the errosion problem. Motion carried. Councilman Henry G. Bishop moved, seconded by Councilman Sam E. Box, for the City to approve the issuance of a beer license to Voncile Delores Smith for the Twirley Bird Club. Motion carried. The application of Marina Management Corporation for a beer license was presented and held over for action until the April 10, 1978 meeting of the Council. 1. Councilman Sam E. Box moved, seconded by Councilman Jack A. Stipes for the City to accept the low bid by W.R. Mitchell on the water line extension on U.S. 98 south, as recommended by City Engineer Ack Moore, less the deletion of the water line going to the school in Point Clear, in accordance with Moore Engineering's recommendation. Motion carried. Councilman Billy Don Wiggins noted for the record that the City of Fairhope has met several times with members of the Twin -Bay Water System and stated that the City has no objections to a contract between Twin Bay Water System and -the City of Fairhope, however the City needs to meet its obligations and perhaps once Twin Bay's plans were reworked they could connect into the City at a later time. City Attorney John V. Duck read a letter from Twin -Bay Water System to Council members. This letter shall become a part of these minutes as per Twin-Bay's request. Councilman Sam E. Box moved, seconded by Councilman Jack A. Stipes to pay Moore Engineering the amount of $ 6,422.0 , for services in connection with the water line extension. Motion carried. Fairhope City Council Minutes for meeting March 27, 1978 Page No. 2 Councilman Jack A. Stipes told members of the Council that the License Clerk has brought to his attention the fact that people are buying Delivery Licenses and paying only for a quarter of a year, yet they are using the license for the whole year. Mr. Stipes said that he would like to see the License Ordinance amended to require the purchase of the licneses on a yearly basis and not allow licenses to be paid for quarterly. Councilman Jack Stipes moved to introduce the following Ordinance: ORDINANCE NO. AN ORDINANCE TO AMEND ORDINANCE NO. 544 ADOPTED THE 25TH DAY OF NOVEMBER, 1974, ESTABLISHING THE LICENSE SCHEDULE FOR THE CITY OF FAIRHOPE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FAIRHOPE ALABAMA THAT ORDINANCE NO. 544, AN ORDINANCE ESTABLISHING THE LICENSE SCHEDULE FOR THE' -.CITY OF FAIRHOPE BE AND THE SAME IS HEREBY AMENDED TO READ AS FOLLOWS: SECTION 9-5. DUE DATE AND PENALTIES. All privilage license taxes levied hereundershall be due on the first day of January of each year and shall be deliquent on the following first day of February, except that Insurance Licenses levied hereunder shall not be deliquent until the following second day of March. In the event of any license levied hereunder shall not be paid before the same has become deliquent, there shall be added thereto a penalty of fifteen (15%) percent of the amount of such license plus interest at the rate of six percent (6%) a year from the date of such deliquency, and a citation fee of one dollar and fifty cents ( $ 1.50 ), which penalty, interest and citation fee must be collected by the City Clerk when the license is issued. ALL LICENSES LEVIED HEREUNDER SHALL BE DUE AND PAYABLE IN FULL ON THE FIRST DAY OF JANUARY OF EACH YEAR, AND NO LICENSES SHALL BE PAID IN INSTALLMENT PAYMENTS SUCH AS QUARTERLY OR SEMI-ANNUALLY. Bishop for the City to go out on bid for a new emergency repair truck for the Gas Department. Motion carried. Mayor Nix told Council members that the contract between the City and Fairhope Ambulance Service expired in February and said the Mr. Gary Sandell has requested renewal of the contract along with additional monies. The last contract with Fairhope Ambulance Service was for an appropriation of $ 250.00. Mr. Sandell has requested that this appropriation be increased to $ 600.00 per month. Mr. Sandell gave a report on the problems of ambulance service along with a financial statement showing a loss of $ 1,949.00 f the last year. Mr. Sandell said that he has been operating at a loss for the past several years and can not continue to operate the ambulance at a loss. Councilman Jack A. Stipes moved, seconded by Councilman David E. Bishop, for the City to pay Fairhope Ambulance Service the sum of $ 250.00 per month as in the prior contract for the next three (3) months, and for the Council to take the renewal of the contract under advisement in order for them to study the City's financial condition and see if they can come up with ways and means of raising more money. Motion carried. Councilman Jack A. Stipes moved, seconded by Councilman Sam E. Box, to amend the City of Fairhope's Personnel Rules and Reg- ulations to require a physical examination of new employees prior to them entering the City's service. Motion carried. Mrs. Cheryl Bartels came before the Mayor and Council represent ing the citizens of the area who want the City to repair !:he stairs going to the beach at the foot of Perdido Avenue. Mrs. Bartels stated the reasons why the residents of the area want the stairs repaired. Councilman David E. Bishop moved, seconded by Councilman Billy Don Wiggins for the City to repair the stairs at the foot of Perdido, Motion carried. 'fir. Joe Odom came before the Mayor and Council regarding a building permit being issued between Gayfer and Grand Avenues. Mr. Odom said that it was rumored that a Restaurant was to be opened in this area and he felt that it would create an even greater traffic hazard there than was now in existence. Z'z)uncilman Jack A. Stipes moved, seconded by Councilman Billy Don Wiggins that the Building Inspector be instructed not to issue a building permit to any structure that would compound the traffic situation in the area on North Section Street be- tween Gayfer and Grand. Motion carried. Mayor Nix informed members of the Council of a motion made by the Parking Authority and passed to recommend to -the Council *hat they consider having parking installed on Bayview between Fairhope Avenue and Magnolia as authorized on the map as pre- sented. Mr. George McKean said that the construction would be on the right-of-way and that only three dogwoods and one cedar tree would have to be removed and transplanted. Councilman Wiggins said that he had no objections to the City providing the labor but did not feel the City should spend any money on the paving. Stipes said that he would contact every person within a block of the Bayview Parking area and see how they felt about the situation and report back to the Council at the next meeting. The drainage situation on School Street was discussed as per the request of Mr. Geoff Cain. Mr. Cain has requested the the City start where they left off and work further north approximately 150 feet since he is now ready to build his bridge. Councilman Sam Box told Council members that he will present the easement from the Methodist Church. Councilman Billy Don Wiggins told Council members that he has met with the Recreation Board and that their recommenda- tion was to start off this season with the same charges at the beach as last year. ( $ 1.00 per car load up to four (4) people and .25�_ for each additional person. ) Councilman Sam E. Box moved, seconded by Councilman Billy Don Wiggins, to correct the wording of a motion made at the February 27, 1978 meeting of the Council for the Council not to purchase any additional gas from Ciba-Geigy ( the motion named Clarke Mobile and should have named Ciba-Geigy ) Motion carried. Mayor Nix told Council members that there was some property adjacent to the City Park on Volanta up for sale in the amount of $ 40,000.00 Councilman David E, Bishop moved{ seconded by Councilman Billy Don Wiggins, to hear the proposal for Cable T.V. Motion carried. Mayor Nix told Council members that he has been contacted by Mr. Bill Talbert representing a firm out of Troy Alabama who said they were in a position to move into Fairhope and install Cable T.V. as soon as they get F.C.C, approval. Mayor Nix said that they would give the City of Fairhope three percent (3%) of the gross revenues received in the City of Fairhope, Councilman Sam E. Box moved, seconded by Councilman Henry G, Bishop, for the City to advertise for any other companies that might be interested in putting Cable T.V. in Fairhope in the Mobile Press Register one time a week for two (2) weeks, inviting any interested companies to submit their proposals for the April 28, 1978 meeting of the City Council. Motion carried. Councilman Henry G. Bishop moved, seconded by Councilman Sam E. Box, that the City file all of their street paving assessments in the records at the County Court House in Bay Minette. RESOLUTION Councilman of the BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF FAIRHOPE ALABAMA AS FOLLOWS: That the Mayor be authorized to negotiate for temporary financing on the water line extension project on U.S. 98 south at the lowest possible interest rate available and; BE IT FURTHER RESOLVED; that the Mayor and City Clerk be authorized to sign any and all necessary documents per- taining to the temporary financing.
