HomeMy WebLinkAbout03-13-1978 Regular Meeting%1 STATE OF ALABAMA COUNTY OF BALDWIN The City Council of the City of Fairhope met in regular sessio on Monday, March 13, 1978, at 7:00 P.M., at the City Administr tion Building, 387 Fairhope Avenue, Fairhope, Alabama with the following members present: Mayor James P. Nix; Councilmen: David E. Bishop, Henry G. Bishop, Sam E. Box, Jack A. Stipes and Billy Don Wiggins. The minutes of the February 27th, 1978 meeting were approved with, :th(e following correction: Councilman David E. Bishop moved, seconded by Councilman Jack A. Stipes for the City to deny the issuance of a Club License to Mr. Joseph Fram. Upon being put to vote the following vote was recorded: AYES: David E. Bishop, Henry G. Bishop, Sam E. Box and Jack A. Stipes. NAYES: Billy Don Wiggins. Motion carried. The application of Voncille Smith for a beer license for the Twirly Bird Club was held for action at the March 27th, 1978 meeting of the Council. City Superintendent Phil Rutherford came before the Mayor and Council to request a new radio for the City Supply Building stating that the present radio is 25 to 30 years old and in bad condition. Councilman Jack A. Stipes moved seconded by Councilman David E. Bishop for the City to go o4 on bid for a new radio for the Supply Building. Motion carried. Councilman Henry G. Bishop moved, seconded by Councilman David E. Bishop for the City to approve the use of Knoll Park for a wedding as per the request of Mr. Donnie Koen providing ther are no vehicles in the park. Motion carried. Councilman Jack A. Stipes opened a discussion on the Street Ordinance. Councilman Stipes said that it needs to be brought to someone's attention that the tests be made on the streets that are newly constructed as per the City's Ordinance on accepting streets. City Engineer Ack Moore and Council member discussed the City's procedure on plans brought into the City by individuals constructing streets in subdivisions. It was agreed that a copy of the Ordinance on Streets be given to the individual at the time he comes into the City to construct a new street in order for him to follow the rules layed out therein. This being the date set for the opening of bids on a Utility Building the following bids were received: 1. Gulf Coast Steel Builders of Mobile: 50 x 100 x 14 $ 32,089.00 50 x 150 x 14 46,334.00 2. Ponderosa Builders, Inc, Pensacola, Fla. 50 x 100 50 x 150 35,598.00 50,447.00 7. Contractor So., Inc. of Mobile. 50 x 100 50 x 150 35,841.00 50,272.00 Councilman Jack A. Stipes moved seconded by Councilman David E. Bishop to take the bids on the Utility Building under advisement until the March 27th, 1978 meeting of the Council unless the City Council calls a special meeting before that date. Motion carried. Councilman Sam E. Box moved, seconded by Councilman Henry G. Bisho for the City to cancel all contracts with industrial users and assure them that the City will continue to supply them but that the City is going to have a rate study. Motion -carried. Councilman Sam E. Box moved, seconded by Councilman Billy Don Wiggins for the City to go out on a rate study for the gas depart- ment. Motion carried. Councilman Jack A. Stipes reported on the stairs at Perdido Avenue. Mr. Stipes recommended that the City not put steps anywhere at this time since it may cause an errosion problem. Councilman Jack Stipes moved, seconded by Councilman Henry G. Bis for the City to remove the steps and put off the building of new steps until a more feasible study can be made on the situation. Motion carried. Councilman Jack. A. Stipes asked members of the Council if they fe the City should get new stickers for the beach this year or continue with the stickers that the City has on hand, and also asked if the Council still felt that the $ 1.00 per car and $.25 per person is still feasible to charge. The Council decided to turn over this years charges and stickers for the beach to the Recreation Board for their recommendation, to be brought back to the Council. Fairhope City Council Minutes for meeting March 13, 1978 Page No. 3 Councilman Sam E. Box moved, seconded by Councilman Billy D. Wiggins, for the City to buy a sand removal chain and new sprockets. Motion carried. City Engineer Ack Moore presented bills to the Council on the water line extension project as follows: W.R. Mitchell $ 36,704.45 Moore Engineering 815.65 Mayor Nix presented the members of the Council with his report on his recent trip to Washington D.C. Mayor Nix urged members of the Council to contact their State Representatives and State Senators regarding the bill to allocate the beer tax to the municipalities, stating that this bill will serious- ly jeopardize and curtail the City of Fairhope's revenues for recreational programs if passed. Mr. Jack Pope came before the Mayor and Council regarding the current street improvement project now underway. Mr. Pope asked the Council if they would entertain the thought of having another paving program of(rct' this one in order for him to get his streets paved, stating that he did not feel he could meet the April 1st, 1978 deadline for getting streets accepted under this paving project. City Attorney John V. Duck said that he recommended the City continuing with the current paving project as it is at this time and starting another paving project. Mr. Duck said that he felt the City should start putting their street assessments on records in the Probate Cour. of Baldwin County. Councilman Jack A. Stipes moved, seconded by Councilman David E. Bishop for the City to continue with the the April lst, 1978 deadline on accepting streets under this paving project and start another paving program once the City gets enough streets to warrant one, r?oT;r 0 Ck-r `cot . City Engineer Ack Moore informed Council members that the bid opening on the water line extension going south on 98 would be on March 17th, at 10:00 A.M, and that the bids would be tabulated March 18th, at 10:00 A.M.,,-. City Engineer Ack Moore told Council members that there was 550 feet of gas line on U.S. 98 that needed to be relocated, and stated that he needed authorization by the City to prepare the plans and ask for bids under emergency conditions. Mr. Moore said that the City needed to have City Attorney John Duck draw up an agreement with the firm having the work done in order for the City to be reimbursed. Councilman Sam E. Box moved, seconded by Councilman Jack A. Stipes for the City to agree to relocate the gas lines on U.S. 98 and to have City Attorney John Duck draw up an agreement and Mr. Ack Moore to draw up the plans on the lines with no costs to the City. Motion carried. Mayor Nix told Council members that Monday, March 20th, 1978, officials with the Water Improvement Commission and Public Safety Commission would be presenting the City with an award fo the City having won the award for best operated water and sewer plant for three consecutive years. Mayor Nix said that there would be a dinner at 6:30 at the Fireman's Hall at which time the presentation will be made. Bishop moved seconded by Councilman Billy Don Wiggins, for the City to take advantage of discounts received when bills are paid before a certain date even if payment of the bill conflicts with the meeting date of the Council when all of the bills are approved. Motion carried. Mr. Steve Newman spoke with Council members on the jetties at the pier. Mr. Newman spoke of various geological conditions regarding the sea walls, and said that the filling in the cracks would correct the situation since the sand will eventually fill in around the edges of the rocks. Councilman Billy Don Wiggins said that he would like for the City to look into a rake that can be put behind the tractor which would pick up sticks and cans off of the beach. Mr. Wiggins said that there was a man who would demonstrate this rake to the members of the Council . Councilman Henry G. Bishop moved, seconded by Councilman Billy Don Wiggins, to pay the bills as presented. Motion carried. Councilman Billy Don Wiggins moved seconded by Councilman Sam E. Box to give authorization to City Attorney John V. Duck as per his request to take dispostion of Sally Maloney and Claude Arnold ( expert witness ) on the law ,6tc,i-r Sally Maloney vs. City of Fairhope, and also authorize the City Attorney to take disposition of Mr. Jack Thomas on Cummings and Thomas. Motion carried. Councilman Sam E. Box moved, seconded by Councilman David E. Bishop to follow the City Attorneys instructions on the water extension of Jubilee by the Bay. Motion carried.
