STATE OF ALABAMA
COUNTY OF BALDWIN
The City Council of the City of Fairhope, Alabama met
in•regular session on Monday, January 23, 1978, at
7:00 P.M., at the City Administration Building, 387
Fairhope Avenue, Fairhope, Alabama with the following
members present: Mayor James P. Nix, Councilmen:
David E. Bishop, Henry G. Bishop, Sam E. Box, Jack A.
Stipes and Billy Don Wiggins.
The minutes of the January 9th, 1978 meeting were approved.
Councilman Sam E. Box moved, seconded by Councilman Henry
G. Bishop for final adoption of Ordinance No. 607,an
Ordinance amending Ordinance No. 557 by rezoning the
property of Paul D. Strickland located at the northeast
corner of St. James and Summit Streets to R-4. Motion
carried.
Councilman David E. Bishop moved to introduce the followi
Ordinance:
ORDINANCE NO. 610
AN ORDINANCE TO ESTABLISH CUSTOMER DEPOSITS FOR ELECTRIC
DEPOSITS ON ALL RENTAL PROPERTY, INCLUDING SINGLE FAMILY
DWELLINGS DUPLEXES, APARTMENTS, CONDOMINIUMS, AND
COMMERCIAL PROPERTY.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FAIRHOPE,
ALABAMA:
SECTION ONE: There is hereby established Customer
Deposits for Utility on rental property, including single
and.family dwellings, duplexes, apartments and Condominiu
as follows:
A. Electric Deposits: $ 75.00
B. Industrial and Commercial Deposits:
1_ 200 amp single phase service $ 300.00
2. 200 3 if it500.00
3. 400 " it111;000.00
4. 600 " 1,500.00
5. 800 " 2,000,00
6.1,000 " if if2,500.00
SECTION TWO: There is hereby established a service
charge of $ 10.00 for tagging a door or collection of bad
checks on all deliquent accounts on rental properties
as hereinabove described.

SECTION THREE: All tenants must produce either a
Social Security card no. or Drivers License No. at the
time of making the needed deposit as hereinabove set out.
SECTION FOUR: All deposits will be paid by cash or
check.
SECTION FIVE: All Ordinances in conflict herewith be,
. and the same are hereby repealed.
SECTION SIX: This Ordinance shall take effect upon its
due adoption and publication as required by law.

Councilman Sam E. Box moved to introduce the following
Ordinance:
ORDINANCE NO. 611
AN ORDINANCE TO ESTABLISH GAS DEPOSITS FOR ALL RENTAL TENANT;
INCLUDING SINGLE FAMILY DWELLINGS, DUPLEXESM APARTMENTS,
CONDOMINIUMS.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FAIRHOPE,
ALABAMA :
SECTION ONE: There is hereby established a Gas Deposit
of $ 5.0.00 for all tenants, whether occupied by single famill
dwellings, duplexes, apartment houses or condominiums.
SECTION TWO: There is hereby established a service
charge of $ 10.00 for tagging a door or collection of bad
checks on all deliquent accounts.
SECTION THREE: All tenants or renters must produce
either a social security card no. or Drivers License No. at
the time of making such gas deposit. All deposits will be
made by cash or check.

Ordinance:
ORDINANCE NO. 612

AN ORDINANCE TO WATER DEPOSITS FOR ALL RENTAL TENANTS INCLUD
SINGLE FAMILY DWELLINGS, DUPLEXES, APARTMENTS, CONDOMINIUMS.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FAIRHOPE,
ALABAMA :
SECTION ONE: There is hereby established a Water Deposit
of $ 20.00 for all tenants, whether occupied by single family
dwellings, duplexes, apartment houses, or condominiums.
SECTION TWO: There is hereby established a service charge
of $ 10.00 for tagging door or collection of bad checks on all
deliquent accounts.
SECTION THREE: All tenants or renters must produce eithE
a Social Security Card No. or Drivers License No. at the time
of making such Water Deposit. All deposits will be made by

Mr. Robert Mitchell of Beasley's Rest Home came before the
Mayor and Council to request a parking space designated for
the handicapped in the area of Beasley's Rest Home.
Councilman Jack A. Stipes was asked to look into the best
place for the location of a sign for handicapped parking and
report back to the Council.
Councilman Billy Don Wiggins said that he would like to see
the new rest rooms that were proposed for the north end of
the beach completed before the beach season opens for this
year.
Councilman Billy Don Wiggins moved, seconded by Councilman
Jack A. Stipes, for the City Engineer Ack Moore, General
Superintendent Phil Rutherford and Mr. Jack Kirk, to meet and
see what is involved in getting the project of new rest rooms
at the beach started with the cost of the rest rooms to come
out of the Beach Revenue Account. Motion carried.
Councilman Jack A. Stipes discussed the rule and regulations
of the Planning Board. Mr. Stipes said that he would like
to see the ten (10) and fifteen (15) day time limits followed
and that a.set of plans on subdivisions be given to General
Superintendent Phil Rutherford in time for him to make an
inspection before the meeting of the Commission.
The application of Willie E. Smith for a beer permit at the
Twirly Bird Club was presented. Councilman Jack Stipes
moved seconded by Councilman David Bishop to deny the
application for a beer permit due to the recommendation of
the Chief of Police after investigation. Motion carried.
Councilman Henry G. Bishop moved, seconded by Councilman
Billy Don Wiggins, for the City to officially accept the
1977 Fiscal Year Audit as presented by Parker & White, C.P.A.
and to keep Parker and White informed as to when and if the
City has implemented their recommendations. Motion carried.

Councilman David E. Bishop moved to introduce the following
Ordinance:
ORDINANCE NO. 613
AN ORDINANCE TO REQUIRE ALL ELECTRICAL WORK DONE WITHIN
THE CITY LIMITS OF FAIRHOPE TO HAVE A PERMIT.ISSUED BY THE
BUILDING INSPECTOR OF THE CITY OF FAIRHOPE, AND SETTING A
FEE THEREFOR WITH EXCEPTIONS OF HOMEOWNERS DOING ELECTRICAL
WORK ON THEIR OWN PREMISES AND THE ELECTRICAL JOB TO BE
INSPECTED BY THE ELECTRICAL DEPARTMENT OF THE CITY OF FAIR -
HOPE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
FAIRHOPE, ALABAMA:
SECTION 1. There is hereby required by all licensed
electricians working within the corporate limits of the City
of Fairhope, to obtain a permit for any electrical job done
within the corporate limits of the City of Fairhope.
SECTION 2. There is hereby established a FIVE DOLLAR
($5.00) fee for issuing the said electrical permit by all
licensed electricians.
SECTION 3. There is hereby excepted from the FIVE
DOLLAR ($5.00) permit all electrical contractors performing
electrical work on new homes where the City of Fairhope has
issued a building permit therefor.
SECTION 4. There is hereby excepted from the FIVE
DOLLAR ($5.00) permit any property owner who is doing his
own electrical work on his own premises.
SECTION 5. That all licensed electrical contractors
performing work within the corporate.limits of the City of
Fairhope, Alabama and who has obtained the necessary permits,
shall notify the electrical department, and the electrical
department shall inspect the electrical work in progress and
upon completion.
SECTION 6. Any person violating the terms of this
ordinance shall, upon conviction, be fined not less than One
Dollar ($1.00) nor more than Five Hundred Dollars ($500.00)
at the discretion of the Court.
SECTION 7. Every day the violation continues, shall be
deemed a separate offense.
SECTION 8. All Ordinances in conflict herewith be, and
the same are hereby repealed.
SECTION 9. This Ordinance shall take effect upon its
due adoption and publication as required by law.

Mayor Nix told members of the Council of the request by the
Police Department for an A.C.I.C. machine.
Mr. Earl Thompson of the State of Alabama Criminal Justice
Department came before the Mayor and Council to explain the
A.C.I.C., teletype communications service. Mr. Thompson told
members of the Council that the cost of leasing the machine
would be $ 200.00 per month with a one time charge of $ 245.00
for installation.
Councilman David E.JBishop moved, seconded by Councilman Henry
G. Bishop, to rent the A.C.I.C. machine for the Police Department
Motion carried.
Final adoption of Ordinance No. 608 was layed over until the Feb-
ruary 13th, 1978 meeting due to failure to meet the fifteen day
advertising limit.
Mayor Nix brought a letter from Thomas Hospital to the attention
of the Council members. Thomas Hospital requested that the
City widen the portion of Ingleside between Morphy and Nichols
in order to expand the hospital to the south. The matter was
turned over to Councilman Jack Stipes to meet with persons from
the hospital and see if there is a possible way to widen the road.
In old business, Councilman Henry G. Bishop asked for an update
on the City's liability insurance for city officials. Mayor Nix
said that at the present time only one bid has been received.
It was decided that the liability insurance for City officials
would be settled at the February 13, 1978 meeting of the Council.
Councilman Stipes asked the progress on putting a top on the post
at the warehouse.
There being no further business on a motion duly made, seconded
and carried, the meeting adjourned.
