HomeMy WebLinkAbout01-09-1978 Regular MeetingSTATE OF ALABAMA COUNTY OF BALDWIN The City Council of the City of Fairhope, Alabama met in regular session on Monday, January 9, 1978, at 7:00 P.M., at the City Administration, 387 Fairhope Avenue, Fairhope, Alabama with the following members present: Mayor James P. Nix; Councilmen: David E. Bishop, Henry G. Bishop, Sam E. Box, Jack A. Stipes and Billy Don Wiggins. The minutes of the December 27th, 1978 meeting were approved. Councilman Sam E. Box moved, seconded by Councilman Billy D. Wiggins, to open the bids on a new truck. Motion carried. This being the date set for the opening of bids the following bids were received: 1. Gaston Motor Company (5-speed) $ 8,361.92 Automatic Transmission 9,455.05 2. Thomas Pontiac 10,069.84 3. Steber Chevrolet( Automatic ) 8,918.16 Councilman Henry G. Bishop moved, seconded by Jack A. Stipes, to accept the low bid subject to meeting specifications. Motion carried. This being the date set for".tYie public hearing on the rezoning of the Strickland property from R-1 to R-4 for the property identified asIthe northeast corner of Summit Street and St. James Street containing .92 acres more or less in order to construct apartments.containing fourteen (14) units the public hearing was called to order. Mr. Earl Hilyer stated that while he had no objections to the rezoning, the traffic�,situation at 8:00 A.M. and 3:00 P.M., at the Elementary School Should be considered. Mr. Jack Cummings was present at the hearing to represent Mr. Strickland and showed the plans of the proposed apartment complex to Council members. Mr. Cummings said that the apartment rentals would be aimed primarily at the retirement market. Mayor Nix introduced the following Ordinance to change the zoning from R-1 to R-4: ORDINANCE NO. 607 AN ORDINANCE AMENDING ORDINANCE NO. 557, ADOPTED AUGUST 11TH, 1975, BY REZONING THE FOLLOWING DESCRIBED PROPERTY TO R-4: Beginning at the northeast corner of the intersection of Summit and St. James Streets in the Town of Fairhope, Alabama, Baldwin County, run north along the east side of said Summit Street 189 feet to the lands of the Fairhope Single Tax Corporation, thence east along the south side of said Fairhope Single Tax Corporation lands 213.5 feet to the lands of E.D. Corte; thence south along west side of said Corte lands to the north side Fairhope City Council Minutes for meeting January 9, 1978 Page No. 2 of said St. James Street; thence west along the side of said St. James Street 213.5 feet to the beginning containing .92/100 acres more or less part of Block 11, Division 1, according to the Town of Fairhope, Alabama, recorded in Probate Baldwin County, Alabama. Bishop for final adoption of Ordinance No. 604; AN ORDINANCE WHICH ESTABLISHES A PRIVILAGE LICENSE FOR BUSINESSES OPERATING IN THE POLICE JURISDICTION. Motion carried. Councilman Henry G. Bishop moved, seconded by Councilman David E. Bishop, for final adoption of Ordinance No. 605; AN ORDINANCE RATIFYING AND AFFIRMING ESTABLISHING A PRIVILAGE LICENSE FOR BUSINESSES OPERATING IN THE POLICE JURISDICTION FOR THE 1978 LICENSE TAX YEAR. Motion carried. Councilman Jack A. Stipes moved, seconded by Councilman David E. Bishop for final adoption of Ordinance No. 606; AN ORDINANCE TO PROHIBIT THE BLOCKING OF SIDEWALKS WITHIN THE CITY LIMITS OF THE CITY OF FAIRHOPE. Motion carried. Mr. Richard Lacey came before the Mayor and Council on behalf of the Merchants Association, Inc., and told Council members that one member of the Association would be present at each Council Meeting to act as a liason between the Merchants Association and the City. The increase in utility deposits on Rentals was held over for action until the January 23, 1978 meeting of the Council. Councilman Billy Don Wiggins moved, seconded by Councilman Jack A. Stipes, to re -appoint Mr. Peyton Walker, Mrs. Ruth Rockwell, Mr. Ben Barnhill and Mr. Ray Malone to the Parking Authority Board and to Appoint Mr. W.C. Dukes as a member to the Parking Board. Motion carried. Mr. Peyton Walker was reappointed to serve as a member of the Parking Authority Board until January of 1980. Mrs. Ruth Rockwell was reappointed to serve as a member of the Parking Authority Board until January of 1980. Mr. Ben Barnhill was reappointed to serve as a member of the Parking Authority Board until January of 1981. Mr. Ray Malone was reappointed to serve as a member of the Parking Authority Board until January of 1981. Mr. W.C. Dukes was appointed to serve as a member of the Parkin Authority Board until January of 1981. Councilman Billy Don Wiggins moved, seconded by Councilman Jack A. Stipes, to reappoint J. Russell Kilgore to serve Fairhope City Council , Minutes for meeting January 9, 1978 Page No. 3 as a member of the Fairhope Municipal Airport Board. Potion carried. Mr. J. Russell Kilgore was reappointed to the Fairhope Airport Board until November of 1979. Councilman Sam E. Box moved, seconded by Councilman David E. Bishop to reappoint Mr. Victor Altramarino to serve as a member of the Fairhope Board of Adjustments and Appeals. Motion carried. Mr. Victor Altramarino was reappointed to serve as a member of the Fairhope Board of Adjustments and Appeals until October of 1980. Councilman Jack A. Stipes asked members of the Council about the City's policy on use of the City's Rescue Wagon. Mr. Stipes expressed concern about the liability of the City regard the use of the Rescue Wagon, regarding the coverage, and stated that he would like to see a policy to utilize regarding the Rescue Wagon, and also to see the Rescue Wagon equipped with the necessary supplies. Mr. Gary Sandell of Fairhope Ambulance Service came before the Mayor and Council and read a statement regarding the State Regulations for an operator of a Rescue Wagon. Mr. Roy White came before the Mayor and Council to urge them to continue the use of the Rescue Wagon stating that it was vital to the City. Councilman Sam E. Box moved, seconded by Councilman Jack A. Stipes for the City to run the Rescue Wagon for emergency and back-up purposes by authority of the Mayor and Chief of Police, and that the Rescue Wagon be updated with the necessary supplies and materials at the discretion of the Mayor and Chief of Police Motion carried. Councilman Sam E. Box moved, seconded by Councilman Jack A. Stipes for the City to authorize the difference in sick pay and Workman's Compensation for employees injured on the job when necessary. Motion carried. Sam E. Box moved, seconded by Jack A. Stipes for the City to extend the water lines to the Police Jurisdiction if the study shows this to be feasible. Motion carried. The Mayor and Council set the date for the Public Hearing on the rezoning of the Rosa Acres Subdivision for January 20, 1978 at 5:00 P.M. Councilman Jack A. Stipes moved, seconded by Councilman David E. Bishop, to hear the recommendations of the Fairhope Planning and Zoning Commission. Motion carried. Councilman Sam E. Box moved, seconded by Councilman Jack A. Stipes for the City to advertise for a public hearing on the rezoning of the Amos Wagner property from R-4 to B-4, to be held at the January 23, 1978 meeting of the City Council. Motion carried. Stipes moved to introduce the following Ordinance: ORDINANCE NO. 08 ^ AN ORDINANCE TO AMEND THE CITY OF FAIRHOPE ZONING ORDINANCE NO. 557, ADOPTED AUGUST 11TH, 1975, AS FOLLOWS: BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FAIRHOPE, ALABAMA, THAT SECTION 4.2 THRU 4.6 OF THE CITY OF FAIRHOPE ZONING ORDINANCE NO. 557 BE AND THE SAME IS HEREBY AMENDED TO READ AS FOLLOWS: SECTION I. 4.2 R-1 LOW DENSITY SINGLE FAMIT.Y RFSTT)F.NTTAT. T)TS 4.21 Uses Permitted: Single -Family dwellings those uses permitted on appeal in Section 4.1. 4.22 Requirements for Lot Area, Lot Width, Cove - age and other factors: (a) Minimum Lot Area and Lot Width: Each Lot shall have a minimum lot are, of fifteen (15, 000) square feet and a minimum lot width of 100 feet at the front building setback line. (b) Yard Regulations: (1) Front: Each Lot shall have a minimum front yard of forty (40) feet. (2) Side: Each lot shall have a tots side yards of a minimum of thirty (30) feet; with a minimum of ten feet (10) on one side. (3) Rear: Each lot shall have a minimum rear yard of forty-five (45) feet. (c) Maximum Building Height: Except as provided for herein no structure shall exceed this height limit provided that the lot width is increased ten (10) feet for each additional foot added. (d) Maximum Building Coverage: The maximum land coverage by building(s) shall be thirty (30) percent of the total lot area. 4.23 Off -Street Parking Regulations: See Article VI. Section 6.9. 3 Fairhope City Council Minutes for meeting January 9, 1978 Page No. 5 SECTION II. 4.3 R72 MEDIUM DENSITY SINGLE-FAMILY RESIDE DISTRICT: 4.31 Uses Permitted: Single -Family dwelli and those uses permitted in Section 4.1 and 4.2. 4.32 Requirements for Lot Area, Lot Width, Coverage and Other Factors: (a) Minimum Lot Area and Lot Width: Each Lot shall have a minimum lot arer of ten thousand five hundred (10,500) square feet and a minimum lot width of seventy-five (75) feet at the building set -back line. (b) Yard Regulations: (1) Front: Each lot shall have a minimum front yard of thirty-five (35) feet. (2) Side: Each lot shall have a minimum side yard of ten (10) feet on each side, excE where the owner wishes to build a driveway to the rear yard in which case the drivE shall be a minimum of fifteE (15) feet leaving a minimum planting area of three (3) feet along the lot line. (3) Rear: Each lot shall have a minimum rear yard of forty (40) feet. (c) Maximum Building Height: Except as provided for in this Ordinanc( no structure shall exceed a heigt of two (2) stories or thirty (30: feet. Structure may exceed this height limit provided the lot wic • is increased by ten (10) feet-foi each additional foot added. (d) Maximum Building Coverage: The maximum building coverage by building(s) shall be thirty (30) percent of the total lot area. 4.33 OFF STREET PARKING REGULATIONS: See Article VI, Section 6.9. SECTION III. (2) Side: Each lot shall have a minimum side yard of eight (8) feet on each side, except wher the owner wishes to build a driveway side shall be a min- imum of fifteen (15) feet, leaving a minimum planting are of three (3) feet along the lot line. Where a side yard is adjoining an R-1 or an R-2 district the side yard -adjoin- ing shall be a minimum of ten (10) feet. For a corner Lot see ART. 3.4234. (3) Rear: Each lot shall have a minimum rear yard of thirty- five (35) feet. (C) Maximum Building Height: Except as provided for elsewhere in this Ordinance no structure shall.exceed a height of two (2) stories or a maximum height of thirty (30) feet. (D) Maximum Building Coverage: The maximum land coverage by building(s shall not exceed twenty-five (25) percent of the land area. SCETION IV. 4.4 R-4 LOW DENSITY MULTI -FAMILY RESIDENTIAL DISTRICT: USE 4.41. VI, SECTION 6.9 SECTION V. 4.5 R-5 HIGH -DENSITY MULTI -FAMILY RESIDENTIAL: 4.51 Uses Permitted; Any use permitted in an R-1, R-2, R-3 and R-4 District, Multi -Family dwell- ing units consisting of apartments, totimhouses condominiums, and similar developments. Such structures are allowed to contain restaurants and enclosed recreational facilities when integrated with.the building complex. Valley Forge Court West ( in Part One ) f om the future terminus of Colonial Drive, southwest 245 feet, a cul-de-sac. 1 4. Valley Forge Court East ( in Part Two ) from t future terminus of Colonial Drive,`southeast 245 feet, a cul-de-sac. 5. Fredrick Subdivision: A. circle of fifty feet radius being the bulb of a cul-de-sac at the north end of Patlynn Drive, in Block,4 of Volanta subdivision. Councilman Jack,A. Box for the City to,accep't the waiver and agreements on the above streets and include them in the current paving program, with the costs to be assessed to each property owner. Motion carried,. Copies of the compaction tests, base coring and asphalt thickness coring tests are attached for your information. Also attached is a letter from Valta Construction Company to Mr. Dial guaranteeing the workmanship and materials for a period of one year. after acceptance by the Owner. R E S O L U T I O N A RESOLUTION to amend 1101.1 of the Subdivision Regula- tions of the City of Fairhope, adopted by Resolution on the 17th day of January, 1972. WHEREAS, the Planning Commission of the City of Fair - hope, Alabama, did adopt Subdivision Regulations by Resol- ution adopted on the 17th day of January, 1972, and WHEREAS, the Planning Commission is desirous of amend- ing Article 11, Section 1101.1 to read as follows, NOW, THEREFORE, BE IT RESOLVED, that Article 11, Section 1101.1 be, and the same is hereby amended to read as follows: The Municipality shall not accept, lay -out, open, improve, grade, pave, curb, or light any street, or lay or authorize water mains or sewers or connections to be laid in any street within any portion of territory for which the Planning Commission shall have adopted a major street plan, unless such street shall have been accepted or opened as or shall otherwise have received the legal status of a public street prior to the adoption of such plan, or unless such street corresponds with a street shown on the official master plan or with a street on a subdivision plat approved by the Planning Commission or on a street plat made by and adopted by the Commission. The Council may, however, accept any street not shown on or not corresponding with a street on the official master plan or on an approved subdivision plat or an approved street plat, provided the ordinance or other measures accepting such street be first submitted to the Municipal Planning Commission for its approval, and if approved by the Commission, be enacted or passed by not less than a majority of the entire membership of the City Council. (Code of Alabama, 1940, Recompiled, 1958, Title 37, Chapter 16, Article 3, Section 801). This Resolution shall take effect upon its due adoption and publication as required by law.
