COUNTY OF BALDWIN
The City Council of the City of Fairhope, Alabama met in
regular session on Monday, December 12, 1977, at 7:00 P.M.,
at the City Administration Building, 387 Fairhope Avenue,
Fairhope, Alabama, with the following members present:
Mayor James P. Nix; Councilmen : David E. Bishop, Henry G.
Bishop, Sam E. Box, Jack A. Stipes and Billy Don Wiggins.
Mayor Nix told Council members that at the November 28th,
1977 meeting on the vote regarding the Kilgore Rezoning
Public Hearing he had misunderstood the wording of the
motion and had erroneously voted no and should have voted
Mayor Nix said that he wanted to amend the minui.es of the
November 28, 1977 meeting to show that he voted yes, in
favor of denying the application for rezoning.

Mayor Nix vacated the Mayor's seat to Mayor Pro-tem David
E. Bishop to call for another vote on the Kilgore rezoning.
Councilman Sam E. Box moved, seconded by David E. Bishop
to deny the rezoning application of J. Russell Kilgore.,
Upon being put to vote the following vote was recorded:
AYES: David E. Bishop, Sam E. Box and Mayor Nix. NAYES:
Henry G. Bishop, Jack A. Stipes and Billy D. Wiggins.
Mayor Nix voted AYE to break the tie vote. Motion carried.
Mr. Jim Eddins came before the Mayor and Council regarding
the Twin -Bay Water System. Mr. Eddins distributed fact sheep
to the members of the Council regarding a water main south
along U.S. 98 to the Bay Botique and Mullet Point. Mr.
Eddins stated that the City of Fairhope's proposed plans to
install a water main along this route would adversely
affect the rural community since it would cause the Twin
Bay Water System's plans to be uneconomical regarding the
installation of a water main. Mr. Eddins said that if the
City went along U.S. 98 approximately 1/4 of a mile they
would take in 150-200 water users which would be 25 to 35
percent of the users in the entire area making the implemen-
tation of a sewer and waste treatment system uneconomical
for a number of years. Mayor Nix told Mr. Eddins that the
City was responding to requests from the people in the area
for water service and stated that the people were obviously
unaware that the service was still forthcoming from the
Twin Bay Water System. The Council told members of the
Twin -Bay Water System that they would take the matter under
advisement.
Councilman Sam E. Box moved, seconded by Councilman Billy
Don Wiggins, to appoint Attorney -at -Law James Reid as the
City Judge on a six month basis at a salary of $ 300.00 per
month. Motion carried.
Councilman Jack A. Stipes discussed the expenditures for tri s
made by City Employees for conventions and conferences. Mr.
Stipes said that he would like to see reports to the Council
regarding these trips.

Councilman Henry G. Bishop moved seconded by Councilman Billy
Don Wiggins for the approval of a beer and liquor license to
Nancy Gayle Stafford for the Hideaway. Motion carried.
This being the date set for the oapening of bids on• wo new
polcie cars the following bids were received:

Gaston Motor Company: With # 10 as a trade-in; �

Thomas Pontiac Co.: No Bid.
Councilman David E. Bishop moved, seconded by Councilman Jack
A. Stipes, to reject the bids since the bids were riot led: in
accordance with specifications. Motion carried.'"
Councilman Jack A. Stipes moved, seconded by Councilman David
E. Bishop, to resubmit the bid for two (2) new police cars,
with and without a trade in on one of the cars and a bid on
one car to be purchased outright. Motion carried.
Councilman Jack A. Stipes told members of the Council that it
would cost approximately $ 3,000.00 for paving at Fly -Creek,
and requested that the City appropriate the monies for the
paving. Mr. Stipes said that when it rains in the area the
water washes.up red clay which fills up the boat slips so that
boats can not get up to the gas tanks.
Councilman Jack A. Stipes moved, seconded by Councilman Billy
Don Wiggins, for the City to go out on bid for the paving at
Fly Creek. Motion carried.
Councilman Sam E. Box moved, seconded by Councilman Billy Don
Wiggins; to hold the regular meeting of the City Council on
Tuesday, December 27, 1977, at 7:00 P.M. Motion carried.
Councilman Jack A. Stipes moved, seconded by Councilman Sam E.
Box, for the City to advertise for a public hearing on the
rezoning of the Rosa Acres Subdivision from R-3 to R-2.
Motion carried.
Councilman Jack A. Stipes moved to introduce the following
Ordinance.
ORDINANCE NO. 603
AN`ORDINANCE TO PROHIBIT THE BLOCKING OF STREETS, SIDEWALKS,
ALLEY WAYS OR OTHER RIGHTS -OF -WAY WITHIN THE CITY LIMITS OF
THE CITY OF FAIRHOPE, ALABAMA AND ESTABLISHING THE FINES
THEREFORE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FAIRHOPE,
ALABAMA, AS FOLLOWS:
SECTION 1. It shall be unlawful for any person to block
or impede by partially blocking any street, alley way,
sidewalk, or other right-of-way, within the Corporate
Limits of the City of Fairhope, Alabama.
SECTION 2. Any person convicted under this Ordinance shall
be fined not less tahn $ 1.00 nor more than $500.00 under
the discretion of the Court.

SECTION 3. Any and all ordinances in conflict herewith
be, and the same are hereby repealed.
SECTION 4. That this ordinance shall take eff::t upon its
due adoption and publication as required by law.

Councilman Jack A. Stipes moved, seconded by Councilman Henry
G. Bishop, to have the City refund the amount that the builder
paid for a building permit and a job license fee at the St.
Lawrence Catholic Church, since it has been the policy of the
City not to charge churches for building permits. Motion
carried.
This being the date set by the Council for the leasing of Fly
Creek the following were received:
1. Robert L. Jefferson, $ 1,000.00 for the lease
of the building and $ 1.00 per thousand pounds of
fish sold.
2. Joe Pennington: $ 1,000.00 for lease of the
building and .10� per 100 pounds of fish sold.
Councilman Jack A. Stipes moved, seconded by Councilman David
E. Bishop, to give the lease as presented to Mr. Robert L.
Jefferson. Motion carried. .
Councilman Sam E. Box moved, seconded by Councilman Jack A.
Stipes for the City to-adv-ertise for a public hearing on the
rezoning of the Strickland property. Motion carried.
The application of Mr. Leon Allen for a beer permit for Allen's
Seafood located at Battles Wharf was held over for action at the
December 27, 1977 meeting of the Council.
Councilman David E. Bishop told Council members of a proposed
rate increase by Alabama Power Company for an increase on
wholesale electric rates, with the increase to be proposed at
17.92 %/ effective January of 1978 and 17.92 % effective at the
end of 1978.

Mrs. Margaret Meiselbach came before the Mayor and Council
to inform them of a dog that bit her child on city property
and said that it required 16 stitches and urged the City
to do something about the situation regarding this particular
dog. The Council assured Mrs. Meiselbach that they would
look into the situation.
Sam E. Box moved, seconded by David E. Bishop to set the
Holiday schedule for the City of Fairhope as follows:
1. 1/2 day Friday December
of Christmas Eve.
2. Closed Monday, December
of'Christmas Day.
3. Closed Monday, January
New Years Day.
Motion carried.

Councilman Billy Don Wiggins moved, seconded by Councilman
Jack A. Stipes for the Council to hear City Superintendent
Phil Rutherford. Motion carried.
Mr. Rutherford told the Mayor and Council that he could
get a special deal on Caterpillar parts whereby he could
get parts for the Caterpillar for $ 400.00 which would normall
cost a great deal more.
Councilman Jack A. Stipes moved, sceonded by Councilman Billy
Don Wiggins, to authorize Mr. Rutherford to purchase the parts
at $ 400.00. Motion carried.
Councilman Jack A. Stipes moved, seconded by Councilman Billy
D. Wiggins, to give all of the City Employees a Christmas Bonu
of $ 50.00 per person. Motion carried.
There being no further business on a motion duly made, seconde
and carried, the meeting adjourned.
