COUNTY OF BALDWIN
The City Council of the City of Fairhope, Alabama met in
regular session on Monday, November 28th, 1977, at 7:00 P,M.,
at the City Administration Building, 387 Fairhope Avenue,
Fairhope, Alabama with the following members present:
Mayor James P. Nix; Councilmen: David E. Bishop, Henry G.
Bishop, Sam E. Box, Jack A. Stipes and Billy Don Wiggins.
The minutes of the November 14th, 1977 meeting were approved.
Mr. Don Brady of the South Alabama Regional Planning Commissio
came before the Mayor and Council regarding the Water Improve-
ment Program for Fairhope. Mr. Brady stated that the reason
he requested to come before the Council was to seek guidance
and direction from the City for a plan of action. regarding
the waste water treatment in Mobile and Baldwin Countv, Mr..
Brady explained the various,alternati_ves available to the
City of Fairhope and handed out forms to Council members and
those present at the meeting in order to get an input as to
which alternative the City would like to chose regarding the
waste water treatment for Fairhope.
This being the date set for the public hearing on the rezoning
request of Mr. Elliott Powe from R-2 Medium Density Single
Family Residential District to R-4 High Densitv Residential
District for the property identified as an acreage parcel
located on the north side of Middle Street approximately 220
feet west of intersection of Ingleside Avenue and Middle Street.
The subject property has a width of 380 feet fronting Middle
Street and a depth of 250 feet.
Mr. Byrd L. Moore of Eastern Shore Builders was present to
represent Mr. Powe at the meeting. Mr. Moore presented a lette
which shall become a part of these minutes which he stated
contained 51 % of the property owners in this areas signatures
in favor of the rezoning. Mr. Moore stated that the square
footage would exceed that required by R-4 zone.
Mayor Nix opened the hearing for any comments from those presen
at the meeting interested in the Powe request for rezoning.
Mr. Louis Agee told Council members that he was representing
27 property owners in the area under consideration for rezoning
and read a letter stating their opposition due to the fact that
they felt it would increase vandalism, decrease property values
leave the area open for transients, and make the conditions in
the area unfavorable for the children and the elderlv. The
letter asked the Council to accept the recommendations of the
Planning Commission and deny the request.
Councilman Sam E, Box moved, seconded by Councilman Jack A.
Stipes to deny the request of Elliott Powe for rezoning.
Upon being put to vote the following vote was recorded: AYES:
David E. Bishop, Sam E. Box, Jack A. Stipes and Billy Don Wiggi S.
NAYES: NONE ABSTAIN: Henry G. Bishop. Motion carried..

This being the date set for the public hearing on the request
of Mr. J. Russell Kilgore for rezoning of property from R-2
Medium Density Single Family Residential District to R-3
Limited Multi -Family Residential District the 1.29 acres on
the western most portion of the Kilgore Property, the hearing
was called to order.
Mr. Kilgore was present to represent his application. Mr.
Kilgore stated that he desired the rezoning in order to con-
struct four duplexes. Mr. Kilgore said that the construction
of the duplexes would in no way affect Pecan Street and that
he was willing to abide by the restrictions placed by the
Fairhope Planning Commission in that there would be a covenant
running with the deed that nothing larger than four duplexes
would be built on the area defined, that a fence would be
extended as far as the Bishop property line surrounding the
property, and that a green belt would be planted immediately
at the time of the development to insure a buffer. The meeting
was then opened to those present regarding the rezoning request
Property owners from the area asked Mr. Kilgore various
questions regarding the rezoning as to how far the rezoning
would go regarding future development, the affect on the
drainage and the total number of duplexes which would be con-
structed..
Mayor Nix then asked for a show of hands of those present at
the hearing in favor and opposed to the rezoning. Those oppose(
outnumbered those in favor of the rezoning.
Councilman Sam E. Box moved, seconded by Councilman David E.
Bishop,, for the City to deny the request of Mr. J. Russell
Kilgore for a change in zoning from R-2 to R-3. Upon being
put to vote the following vote was recorded: AYES: David
E. Bishop, Sam E. Box NAYES: Henry G. Bishop, Jack A. Stipes
and Billy D. Wiggins. Mayor Nix voted Naye. It was stated
that the request for rezoning was dead at this time.
Mr, Leon Harris of the Bay Area Alcoholic Council came before
the Mayor and Council to request a contribution from the City
for the program.., Members of the Council explained to Tor,
Harris the City's position on contributions stating that all
contributions had been omitted from the City's budget.
Councilman Jack A. Stipes moved, seconded by Councilman David
E. Bishop, to deny.the request for a contribution to the
Bay Area Alcoholic Program. Motion carried.
The Mayor and Council received a letter from Carlton Niemeyer
requesting an extension of water lines to Montrose. Council-
man Sam E. Box moved, seconded by Councilman David E. Bishop
to recommend the extension of the water lines as requested by
Carlton Niemeyer and for the City to go out on bid .for the
cost of the extension. Motion carried.
Mr. Henry G. Bishop moved to introduce the following Ordinance
ORDINANCE NO , 603 ,
AN ORDINANCE ANNEXING THE HEREINAFTER DESCRIBED PROPERTY
WHICH SAID PROPERTY IS CONTIGUOUS TO THE CITY LIMITS OF THE
CITY OF FAIRHOPE, ALABAMA SUCH_i.ANNEXATION BY PETITION OF ALL
OF THE PROPERTY OWNERS SAID PROPERTY,
WHEREAS, CHESTER HUNT and wife, MARY L. HUNT; being the
owners of all of the hereinafter described, such property

The application for a beer permit for Nancy Gayle Stafford
for a beer permit for the Hideaway was held over for action
at the December 12th, 1977 meeting of the Council.
Councilman David E. Bishop moved, seconded by Councilman
Billy Don Wiggins, for the step-down at the back door of City
Hall to be corrected with a tamp in order to avoid possible ✓
injuries that might occur from the step down. Motion carried.)
There being no further business on a motion duly made, seconder
and carried, the meeting adjourned. r

City Engineer Ack Moore came before the Mayor and Council
to discuss the subdivision regulations of the City of Fair -
hope. 11r. Moore asked what constituted a street being
accepted for maintainence, since the Planning Commission's
rules and regulations do not really say. Councilman
Sam E. Box, the Council's representative on the Planning
Commission was given a Resolution to present to the
Planning Commission along with a copy of the City's Ordinan
on accepting streets for maintainence in order for the
Planning Commission to resolve a policy between the Plannin
Commission_and the Council in order to assure that the Coun
will have the fina lsay, ;ifs a bad •street goes into a sub-

Councilm'an,David E'°Bishop moved to hire the City Engineer
to make an inspection of`Lillian Street and make a rec-
ommendation to the City Council. Jack A. Stipes seconded
the motion;: Motion carried.

Mayor Nix informed Council members of the recommendation
from Moore Engineering that the City accept Commercial
Park Drive effective August 17th, 1977.
Councilman Jack A. Stipes moved, seconded by Councilman
Henry G. Bishop, for -the City to accept Commercial Park
Drive effective August 17th, 1977, subject to an inspection
being made by General Superintendent Phil Rutherford and
City Engineer Ack Moore. Motion carried.
Councilman Henry G. Bishop moved, seconded by Councilman
Jack A. Stipes, to pay the bills as presented. Motion
carried.
Councilman Jack A. Stipes told Council members that the
deliquent utility bills were not being cut-off for non-
payment as they should be.

Councilman Billy Don Wiggins moved, seconded by Councilman
Henry G. Bishop , for the City to abolish the Committee se
up in February of 1977 to handle hardship cases on delique t
utility accounts since the purpose of the Committee has been
abused, making it unable for ,the Committee to do the job
intended. Motion carried.
Councilman Billy Don Wiggins moved, seconded by Councilman
Henry G. Bishop, to appoint Councilman Jack A. Stipes and
City Superintendent Phil Rutherford, to oversee all deliqu nt
utility bills. Motion carried.
Mr. Gerald Pond of the Independent Newspaper came before the
Mayor and Council and said that effective January 27, 1978
the Independent will have met all legislative requirements
in order to advertise legal notices. Mr. Pond asked
the Council if they would consider the Independent when
they advertise the City's legal and public notices.
Councilman Billy D. Wiggins moved, seconded by Councilman
Henry G. Bishop, for the City to proceed with getting the
proposed costs and applications on the Adult Recreation
Center remodeling. Motion carried.
City Superintendent Phil Rutherford said that he needed to
rent a Pan to dig a vein to help cover up the landfill.

Mr. Rutherford said that the cost of renting a Pan would
be $ 35.00 an hour for the machine and operator.
Councilman Henry G.. Bishop moved, seconded by Councilman
Jack A. Stipes, to authorize Phil Rutherford to rent a
Pan in order to help at the Landfill at a cost of $ 35.00
per houre for one weeks work. Motion carried.
There being no further business on a motion duly made,.
seconded and carried, the meeting adjourned.
