COUNTY OF BALDWIN� The City Council of the City of Fairhope, Alabama met in regular session on Monday, October 24th, 1977, at 7:00 P.M. �+x at the City Administration Building, 387 Fairhope Avenue, Fairhope Alabama with the following members present: Mayor James P. Nix; Councilmen: David E. Bishop, Henry G. Bishop,f Sam E. Box, Jack A. Stipes and Billy Don Wiggins. The Minutes of the October loth, 1977 meeting were approved. Councilman Henry G. Bishop moved, seconded by Billy Don Wiggins to introduce and adopt the following Resolution. notion carri;ed,. RESOLUTION WHEREAS; Reverend R.A. St. Pierre has been the Pastor of Redeemer Lutheran Church and a valued citizen. of Fairhope for the past eleven years; WHEREAS; Under Reverend St. Pierre's leadership Redeemer Lutheran Church has grown from fifty to over three hundred and fifty members; WHEREAS; Under Reverend St. Pierre's leadership anEduca- ti.ona.l Buildinz and a beautiful sanctuary was built; WHEREAS; Reverend St. Pierre has contributed much to the growth and development of Fairhope, and the loss of Reverend St. Pierre will be greatly missed by not only the congregation of the Redeemer Lutheran Church but'the entire City which he has so faithfully served and given so much of himself; NOW, THEREFORE.BE IT RESOLVED, That REVEREND R.A. ST. PIE be commended for his service and contributions to the City of Fairhope, recognizing the fact that Fairhope is a much better place to live because Reverend R.A.. Wiggins for the City to go out on bids for gasoline. Motion carried. Councilman Jack A. Stipes told members of City equipment which was being loaned out and stated that he did not want to see any City equipment loaned out unless Arior approval is given by either'Phil Rutherford, E!J_. Kirk or Mayor Nix, and anyone who lends City equipment without prior approval is putting their job,pn the line. The setting,.of#'a salary°on the newly created position of Inventof Control Clerk was held over until the November 14th, 1977 meetin Councilman Sam E. Box moved, seconded by Councilman David E. Bishop, for the,City to proceed with with the project of extend- ing the water lines east of Greeno Rd., south of Highway 104, and along Fairhope Avenue and along the eastern shore down U.S. 98 from the south City Limits along the coast approximately two (2) miles south of Marlow Rd. by getting the Users Agreement signed in order to determine where the users are located and see if they would like the water lines extended. Motion carried. This being the date set for the opening of bids on equipment the following bids were received: Air Compressor: 1. Stipes to take all bids under advisement and evaluate once the Purchasing Agent and Department Heads have looked over the bids with their recommendations to be reported at the November 14, 1977 meeting. All -Quip, Inc. 1-essex roller w/ trailer $ 4,217.25 1- 14-50 WS Maudlin Roller 3,290.00 Councilman Jack A. Stipes moved, seconded by Councilman Billy Don Wiggins, to take the bids under advisement for evaluation by the department head with low bid to be accepted providing it meet specifications. Motion carried. Under O1d'Business,'Councilman Jack A. Stipes said that the garbage dump is slowly but surely filling up and that he felt contractors building homes should not be allowed to dump their debris in the City dumpy.s The status ronl the adirt for they landfill was discussed. Mavor Nix stated that the City was waiting on the School Board's' Attorney, to draw,up,the; necessary papers, and as soon as they. were ready the project could begin. Councilman David E. Bishop brought up the painting of the canopi at the restaurant on the ,Municipal Pier. Councilman Jack A. Sti moved seconded by Councilman David E. Bishop to pay $ 14,00 per hour plus.buy the paint for painting the canopies at the Restaur ,on the Municipal Pier. Motion carried. Councilman Henry G. Bishop moved, seconded by Councilman Jack A, Stipes to hear all remaining business not put on the agenda. Motion carried. Councilman Billy Don Wiggins introduced Ordinance No.597.__r'aisi the pound fees from $ 2.50 to $ 25.00 and the impounding fee for feeding dogs from .50G per day to $1.00 per day. Councilman Billy Don Wiggins introduced Ordinance No•598 stati that any person caught turning loose dogs from the pound be fined $ 250,100, and that the Police Department issue citations for violation of the Dog Ordinance, Councilman Sam E. Box moved, seconded by Councilman Jack A. Stip to replace two radios, one in the water department and one in th electric department, at a price of $ 800.00 per month for the next two (2) months. Motion carried. Councilman Sam E. Box moved, seconded by Councilman Jack A, Stip to appoint Councilman David E. Bishop to be the Council's representative to the Coastal Area Advisory Board. Motion carri Councilman Sam E. Box moved, seconded by Councilman Jack A. Stip to introduce the following Ordinance. Motion carried. Fy t ORDINANCE NO. 599 AN ORDINANCE ANNEXING THE HEREINAFTER DESCRIBED PROPERTY, WHICH SAID PROPERTY IS CONTIGUOUS TO THE CITY LIMITS OF THE CITY OF FAIRHOPE, ALABAMA, SUCH ANNEXATION BY PETITION OF ALL OF THE PROPERTY OWNERS OF SAID PROPERTY. WHEREAS, ROBERT S. BERGLIN and wife, MADELINE C. BERGLIN, being all of the Owners of the hereinafter described property, did Petition, the CITY OF FAIRHOPE, ALABAMA, for annexation, under Act 2228, adopted in the 1971 Regular Session of the Legislature of the State of Alabama, and, WHEREAS, a map of said property is attached to the Petition as required by said Act. NOW, THEREFORE, BE IT ORDAINED by THE CITY COUNCIL OF THE CITY OF FAIRHOPE, ALABAMA that these presents do hereby annex all of the hereinafter described property, which is contiguous to the corporate limits of the CITY OF FAIRHOPE, ALABAMA, and more particularly described as follows, to -wit: From the Southeast corner of Section 19, Township 6 South, Range 2 East, run N 000 05' E, along the East boundary of said Section 19, 1326.6 feet to the POINT OF BEGINNING: thence run West 477.5 feet to a point in a small gulley; thence continue West, 528.4 feet to an old iron pipe; thence run S 891 52' W, 334.9 feet to an old concrete block marker buried at ground level at the Southwest corner of the Northeast 4 of. the Southeast 4 of said Section; thence run N 89° 44' W, 632.3 feet to an old iron pipe; thence run N 891 48' W, 174.7 feet to a concrete block corner marker; thence run N 00° 01' W, 300.4 feet; thence run West, 120.25 feet; thence run N 000 08' E, 116.9 feet; thence run West 210 feet; thence run N 000 08' E, 222.8 feet; thence run S 890 54' W, 231.1 feet to an old iron pipe corner marker at the "locally accepted" Southeast corner of the North 2 of the Northeast 4 of the Soutwest; thence run N 02° 02' W, along the East boundary of Nelson's Knoll Subdivision, 222.5 feet to a point situ- ated N 021 02' W, 16.2 feet from the Northeast corner of Lot 2 of said Subdivision, thence run S 800 22' E, along the South boundary of property of the Fairhope Single Tax Corporation, 1392 feet to an iron post; thence N 001 25' W, along a fence 60 feet more or less to a point in a gulley; thence Eastwardly up the middle of Big Head Gulley to a point situated N 600 14' E, 580 feet more or less from the last turning point; thence S 260 24' E, 332.9 feet; thence S 740 39' E, 359.3 feet; thence North 710 E, 63.5 feet; thence S 710 25' E, 85.6 feet to an iron pipe; thence N 750 57' E, 201 feet to a point on the Section line; thence run S 000 05' W, 599.2 feet to the Point of Beginning. BE IT FURTHER ORDAINED BY THE CITY COUNCIL OF THE CITY OF FAIRHOPE, ALABAMA, that the CITY does hereby assent to the said annexation to the CITY OF FAIRHOPE, ALABAMA of the hereinabove described property. BE IT FURTHER ORDAINED BY THE CITY COUNCIL OF THE CITY OF FAIRHOPE, ALABAMA, that a CERTIFIED copy of this Ordinance, along with the Peitition, be recorded in the Office of the Judge of Probate of Baldwin County, Alabama. THIS ORDINANCE shall take effect upon its due adoption as required by law. ADOPTED THIS THE DAY OF ► 1977. Nix informed members of the Council that he was told by Mrs. Tommie Werneth of Community.Consultants that the City can get 100 % financing on the Street Markings but the engineer will have to prepare the plans on the street markings but that they will have to be for streets that have not been striped before or are not striped properly and it can not be a state highway and it has to have at least two hund �d and fifty cars using o /o /� the street per Q day. Also on the sign} ` the financing is 70 state and 30 city, for signs and signals. Mayor,Nix.stated that the City needed to update 1 n downtows-ignal. -system and 'that would be included in the pi ns Councilman Jack..Stipes said that he would get 'with Mrs. Wernet] regarding updating the downtown traffic signals in order to determine how -long -it will take and the approximate cost and report back to the Council. Councilman Billy Don Wiggins requested that General Superinten. dent Phil Rutherford sketch one sign that lists all of the regulations at the Municipal Pier rather than having several different signs, and for Mr. Rutherford to report back at the November 14th, 1977 meeting of the City Council. Councilman David E. Bishop moved, seconded by•Councilman Jack A. Stipes for the City to purchase an additional tank for high-test gasoline for supply. Motion carried. Mayor Nix told Council members that the annual employee fish fry would be held at 12:00 Wednesday, October 26, at the Municipal Pier. Councilman Sam E. Box informed'members of the City Council that the City has received a letter from Mr, Larry E. Waldrop Administrator of Gas Pipeline°Safety from the Alabama Public Service Commission commending Mr. Gene Fuqua and his staff for the excellent job which they have done in corrosion work and for the cooperation which they received. This letter shall become.a part of these minutes. There being no further business on a motion duly made, seconder and carried the meeting adjourned. The Council immediately reconvened to consider the request of the Fairhope Single Tax Corporation. All Councilman were stil. present. Mr. Sam Dyson came before the Mayor and Council as a representative of the.Colony Council requesting the approval of the City Council to erect a monument to Henry George to be installed in the park in the band stand area. Cpuncilman Jack A. Stipes moved, seconded by Councilman Billy Don ?Huggins to approve the installation of a monument to Henry George in the park by the band stand. Motion carried.
