Alabama,w th� the fol'lowing,membe'rs present, 4_f Mayor James P. Nix; Councilmen: David E. Bishop, Henry-G, , Bishop, Sam'E - Box; Jack A. Stipes and Billy Don Wiggins.•f The minutes of the September 26, 1977 meeting were approved. Mayor Nix presented Dianne Trengove an exchange student from Australia attending Fairhope High School with an Honorary Citizenship to the City of Fairhope, and welcomed her to Fair - hope. This being the date set for a public hearing on the annexation request of Mr. Jack E. Pope, Mayor Nix called the hearing to order'. Mr. Pope was present at the meeting to represent his petition. Mr. Pope was seeking annexation of three and a half acres (32) on the north side of Nelson Road, east of the Junior Food Store and the Square Rigger Restaurant and Antique Shop, This three and a half acres is the only contiguous point on the north edge adjacent to the south edge of Paddock Estates. Mr, Pope's annexation request was for annexation into the City Limits as R-3 Multi -Family Dwellings, Mr. Pope presented a drawing of his proposed development which showed the entrance off of Nelson Road, Mr Pope stated that his development would have the design appeal of single family residences from the road but that there would be four (4) units per structure. Mr. Pope said that he would like to rent his. units to retired persons and widow women. The following persons present at the hearing voiced their feelings regarding the annexation at R-3: 1. Mrs. Fred Hall „----Opposed 2. M/M C.F. Volking --- In favor of annexation. 3. Mr. Billy Weston---- In favor of annexation. 4. Mark Owens-- in favor if restricted to single family residences. 5. Bill MacGregor----- Opposed. 6. Russell. Belisle---- Opposed. Also two (2) letters one from Mr. John Evans and the other fro Mrs. George Stacey stated that they were opposed to annexation at R-3. Both letters shall become apart of these minutes. Mayor Nix told Council members that the Planning Commission had recommended annexation and zoned R-3 but limited to single family residences. Councilman Sam E. Box moved, seconded by Councilman David E. Bishop to annex Mr. Pope's property into the City Limits at P.- with the restriction that it be'limited to single family dwellings. Sullivan, E-Z Pik Grocery, Inc. for a beer permit was brought before the Mayor and Council. Mr. Sullivan was present at the meeting to represent his ape �a-i tion, and stated that he would like to have his license beK the store opened in order to have everything set up on the` C day of business. Councilman Billy -Don Wiggins moved, seconded by Councilman A. Stipes, to grant a beer permit to E-Z Pik Grocery, Inc. Upon being put to vote the following vote was recorded: �... AYES: David E. Bishop, Henry G. Bishop, Jack A. Stipes and "" f Billy Don Wiggins. NAYES: Sam E. Box. Motion carried. Councilman Sam E. Box moved, seconded by Councilman Sam E. Box ,to open the bid received from �Talta Construction Companv for Curb and Guttering the west side of Bayview Street. Motion carried. Bid on curb and guttering Bayview; Valta Construction Company; $ 6,741,45 Councilman Billy Don Wiggins moved, seconded by David E. Bishop to reject the bid from Valta Construction Company. Motion carri Councilman Jack A,, Sytipes.moved,. seconded by Councilman Henry G. Bishop for the.City to go`out�on bid for a compressor with a pa.,cker; chipper; and a one ton loader with hose that can be used by street, gas and water departments. Box for the adoption of the following Resolution: RESOLUTION WHEREAS, our nation faces serious energy shortages both present and long range; and WHEREAS, energy conservation policies and programs are bei established and pursued through agencies established at the national and state levels, and WHEP.EAS, the success of our national energy conservation effort depends on the success of the conservation practices and programs which are actively applied at the local level; and WHEREAS, it is desireable and necessary. that local govern- ments establish active and ongoing energy conservation practices in the operation of local government and in providing assistance to local industries, businesses and citizens to the same end; an WHEREAS, there is a need for each local government to establish a permanent office_,within i-=s organization for the management of its conservation effort and for the purpose of coordinating this effort with State and Federal Conservation agencies; and WHEREAS, it is recognized that energy conservation_ practice �at the local level will not only provide a savings in valuable energy resources but also financial resources of the governments unit; and V October 10, 1977 Fairhope City Council minutes Page No. 3' ` WHEREAS, the governing body of the City of Fairhope, bama, does ehreby deem it wise and expedient to establish ongoing program of energy conservation now therefore I� Ala - an • J 7 J ' ItBE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF FAIRH, c ALABA14A, that the City Council of the City of Fairhope, A14b a, does hereby establish an Office of Energy Conservation,for.. City of Fairhope, Alabama, which office shall be responsibl for - the preformance of the following duties: t 1. To act as liaison between the City of Fairhope, Alai and the Federal Energy Department, State Energy.Commi.ssi.on, Alabama League of Municipalities, public utilities, petroleum industries,, and all agencies devoted to the energy conservation effort. ► z ,: 'A 2. To survey pasts energy conservation practices of the municipality and to make recommendations to the municipal govern- ing body for its consideration in -implementing energy conserva- tion practices for the City of Fairhope, Alabama, 3. To monitor regularly the energy conservation performanc( of the municipality and to report monthly to the governing body of the City of Fairhope Alabama relating to the progress being made in implementing the practices established by the governing body. 4. To determine what technical and financial assistance might be available to the City of Fairhope, Alabama, in its conservation effort and to make recommendations to the govern- ing body relating to such assistance. 5. To establish a conservation committee comrosed of representatives from business, industry and residents of the City of Fairhope, Alabama, for the purpose of esatblishir_g a community -wide energy conservation program throughout the municipality, 6. To establish a timetable for the performance of energy conservation practices and for the accomplishment of goals established by the municipal governing body. 7. To make reports as might be requested by the State Energy Commission relating to energy conservation efforts on the part of the municipality. BE IT FURTHER RESOLVED by the City Council of the City of Fairhope,-Alabama, that Councilman David E. Bishop, be and is .hereby appointed as council liaison for all activities relating to energy conservation for the municipality and that Phil Rutherford, General Superintendent of the municipality, be and is hereby designated as Superintendent of the City Energu Conser- vation Office in addition to his present duties, and that the mayor of the City of Fairhope, James P. Motion carriec RESOLUTION Z BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF FAIRHOPE, ALABAMA, that effective immediately the following personnel will hereby assume the positions as stated herein: Mr. E.J. Kirk will assume the duties of both Personnel Officer for the City of Fairhope and Executive Admini.st?74tor, Mr. Phil Rutherford will assume the duties of General Superintendent for the City of Fairhope. Mr. Aaron Norris will assume the duties as Superintendent of the Electrical Department of the City of Fairhope.. ADOPTED THIS THE DAY OF' 1977, Councilman Jack A. Stipes moved, seconded by Councilman Billy Don Wiggins to hear Geoff Cain's request.. TIiotion carried. Councilman Stipes told members of the Council that Mr. Geoff Cain has requested that as the Citv builds the flume on School Street if they would `pour the .footings -for' his bridge if he provides the materials. Councilman'Jack--Stipes moved, ­seconded -by Councilman Billy Don Wiggins, for"the City to"do,'t-he work as requested by Mr. Cain, providing a contract"is drawn up Ibetween Geoff Cain and the Citv of Fairhope stating that Mr. Cain will pay for the materials and state in the dontr.act.that the Ctv''of Fairhope will not assume any liability on the bridge. Motion carried. Old Business: J.R. Kilgore Chairman of the Fairhope Airport Board told members of the Council that as of 7:OO A.M., Ocotber loth, 1977 the Airport was colsed for traffic until repairs and expansion work is completed. Councilman Sam E. Box moved, seconded by Councilman Henry G. Bisho, to hear Councilman Jack Stipes. Motion carried. Councilman Jack Stipes told members of the Council that the Harbor Board was having trouble securing the rubble from the old bridges on the Causeway. Mr. Stipes stated that Mr. Bass of the State Highway Department was under the opinion that the rubble was wante for -.the Yacht Club rather than by the City of Fairhope. Mr. Stipes requested that a copy of the Resolution be sent to Mr. Bass to the Highway Department, showing that the City of Fairhope has•requeste the rubble. it r 11 s3 October �10`, 1977, Fairhope City Council minutes Page No. 5' -� Councilman Sam E. Motion carried, Councilman Stipes moved to authorize up to $ 5 000,00 for the completion of the flume at the sewer plant and that authoriza.,:, 4 Lion be given to start the project. Councilman Sam E. Box -' seconded the motion. Motion carried. Councilman Jack A. Stipes moved, seconded by Councilman Henry G, Bishop, for the City to go ahead and adopt the Traffic Study'T and Operations�Study and for the City to proceed with either Plan A B or C, Potion carried. Councilman Jack A. Stipes moved, seconded by Councilman Billy. Don Wiggins, to approve the bills for payment as presented, Motion carried. Councilman Henry G. Bishop moved, seconded -by Councilman Billy for adoption of the following Resolution. Mr. Dave 'I Darwin of this office made an inspection of the Fairhope Gas System on October 13, 1977, and reported that the gas system has met their dead- line and is now in compliance with corrosion control. Mr. Gene Fuqua and his staff are to be commended for the excellent job they have done in corrosion work. It has been a long, frustrating, hard job but they kept to the task until completion. We certainly want to thank you, Mr. Sam Box, and each Councilman for the cooperation that has been given to the gas system. Without this cooperation,,the'Job,.could not have been completed. ` This office is proud of the cooperation we received and the interest shown in gas pipeline safety. I''• i The Mayor an&,C. uncil.discussed the new budgets on the Gene., Electric,' Gas and Watei and Sewer Departments for the 1978 Fiscal Year Mayor Nix told Council members that the budge - included a ten percent raise for all City Emplovees, a new air compressor for the Street Department a ten percent raise in the Fairhope Public Library Appropriation, the hiring of an Inventory Control Clerk at a salary of $ 12,000.00 per vear, a seven percent inflationary increase on all supplies and materials, a six percent increase in employees medical insurance, the hiring of two additional patrolmen in the P61ice Department, and the raise of one existing Patrolman to Sargeants pay, and two new police cars as needed. The total Revenues for all funds are anticipated as $4,476,074, 6 against anticipated expenditures of $ 4,319,974,,05 a total anticipated excess of revenues over expenditures of $ 1561100,8!.. Councilman Henry G. Bishop moved, seconded b17 Councilman Billy Don Wiggins, to adopt the new budgets for the 1977-1978'Fiscal Year with the following changes:` Increase the appropriation to the Fairhop'e Harbor Boar from. 380..00 to 1,200.00 Remove the 100.00 from the General Fund for the Chamber of Commerce membership fees and pro rate the dues over the three utilities. Motion carried. The Mayor and Council discussed the ten percent raise to City .Employees. Councilman Henry G. Bishop stated that he was not in favor of across the board raises and said that he felt raises should be given on the basis of the employees work performance record. Councilman Sam E. Box moved, seconded by Councilman Billy Don Wiggins, to give the pay raise on a one or two step basis at the discretion of the Department Head. Motion carried.
