� 1 � 1 a t h 7 J , STATE OF ALABAMA COUNTY OF BALDWIN 1 � « r `9 rr f L The City Council of the City of Fairhope, Alabama met in regular session on Monday, September 26, 1977, at 7:00 P.M., at the City Administration Building, 387 Fairhope Avenue, Fairhope, Alabama, with the following members present: Mayor`�,; James P. Nix; Councilmen: David E. Bishop, Henry G. Bishop, Sam E. Box, Jack A. Stipes and Billy Don Wiggins. ` Councilman David E. Bishop question the motion on Page No. 3 of the City Council Minutes for the September 12, 1977 meeting regarding the annexation of Mr. Robert S. Berglin's property. , Mr. Bishop stated that annexation must be done by an Ordinance and wanted to check on the legality of the motion. City Attorney John Duck told Mr. Bishop that Mr. Berglin's petition for annexation will be resubmitted once all of the legal papers have been drawn up. -4 The minutes of the September 12, 1977 meeting were approved. 1' Councilman Henry G. Bishop moved, seconded by Councilman Billy y Don Wiggins, to hear the Library Board. Motion carried. Mr. Jason Kutack, Ms. Dottie Shine, Mr. Bill MacGregor, of the Fairhope Library Board along with Ms. Claire Oates, Director of the Library came before the Mayor and Council to present their budget for the 1977-1978 Fiscal Year. Ms. Oates gave the presentation on behalf of the Fairhope Public Library. Ms. Oates said that library materials and supplies hav( more than doubled and she gave statistics of how the average price of books and the costs of periodicals have doubled, Ms. Oates told members of the Council that they were asking for a ten percent (10%) increase in the City's appropriation over last year in order to provide new and better services to the citizens of Fairhope. The total amount requested from. the City for the 1977-78 Fiscal Year is $ 51,359.00. The Library's proposed budget shall become a part of these minutes.,; W The Council told members of the Library Board that there request will be taken under advisement, since the City was now in the process of preparing the budget for the new fiscal year, Councilman Billy Don Wiggins moved, seconded by Councilman Henry G. Bishop for approval of a beer permit to Mr, R. Roy Reynolds for Lucassen's Grocery Store, with the Fairhope Police Department to keep a closer check on the problems that have previously arose regarding the selling of beer to minors. Motion carried. Councilman Sam E. Box moved, seconded by Councilman Jack A. Stipi for approval` of a beer and liquor permit to Mr. Stanley Vinsant for Julwin's Restaurant. Motion carried. The application for a beer permit by E-Z Pik, Inc. by Edgar R. Sullivan was presented and held over for action at the October loth, 1977 meeting. CouncilmaneJack-A.-Stipes said that the Fairhope Single Tax Corporatonyhad•agreed to participate'in the curb and guttering of Knoll Park. Mr. Stipes said that this will prevent cars from going into:Knoll Park. Mr.. Stipes said that the Colony would pay for the materials and that the'City would provide the labor. Councilman Jack"A. Stipes moved seconded by Councilman Sam E. Box for the City ,to go out.on bid for the curb and guttering of Knoll Park, with+ the bids ,to` include the price of materials and contract labor. Stipes for the City to advertise for a public hearing on thi petition for annexation of Mr. Jack Pope, with the notice t( state that Mr. Pope is requesting annexation of the propert, located on Old Battles Road as R-3, and that all propertyoi within 300 feet will be notified by -mail of the public hear: Motion carried. Councilman Jack Stipes opened a discussion on the City of Fairhope'.'s Licens.e"`Ordinance , Mr. Stipes stated that he felt there were many inequitiesvin4the existing License Ordinance, and that he felt people_ doing business in Fairhope who were located outside of -the City_Limits should be charged more than residents, ,of Fairhope., , Councilman Sam,E. Box moved., seconded by Councilman Jack Stipes to hear Councilman'Billy D..Wiggins. Motion carried. Councilman Billy Don Wiggins moved, seconded by Councilman Sam E. Box, that the City request Parker and White, C.P.A's, do an audit of the Alabama Aircraft books in addition to their annual audit of the City of Fairhope's books. Motion carried. Councilman Billy Don Wiggins moved, seconded by Councilman Jack A., Stipes to hear Mr. Henry Bishop on matters of Old Business. Motion carried. Councilman Henry G. Bishop recommended that the item " Old Business " be placed on each City Council Agenda in the future in order for the Council to discuss the status of past actions. Councilman Bishop asked the status on the purchase of a bush -hog the bids on cleaning the water tank,Fthe building permit of Attorneys -at -Law Taylor, Benton and'Irby, bids on the jettys, the topping of the City Garage, the purchase of a radar unit for the Police Department, the painting project at the pier, the pipe on the George Mc Kean property, the paving of thr road at Fly Creek,�the line on the flag pole at the Pier, the progress on the Street Assessments that were turned over to the City Attorney for collection. Councilman Jack A. Stipes moved, seconded by Councilman Billy Don Wiggins, to bring up the discussion on the Fire Station. Motion carried. Councilman Jack Stipes complimented Mr. Herman Taylor on his work in cleaning up at the fire station and said that there was a leakage problem which was'ruining City equipment, and that it needed to be repaired. Councilman Jack A. Stipes moved, seconded by Councilman Billy Don Wiggins, for the leakage at the Fire Station to be repaired. Motion carried. Councilman Sam E. Box moved seconded by Councilman Billy Don Wiggins, to act on appointing Mr. Henry G. Bishop to the Fairhope Planning and Zoning Commission. Motion carried. Councilman Sam E. Box moved, seconded by Councilman David E. Bishop „to appoint Councilman Henry G. Bishop to the Fairhope Planning and Zoning Commission for a term beginning October 1, 1977 to September 3.0, 1978. Motion carried Councilman David E. Bi`shop-moved, seconded by Councilman Jack A. Stipes to bring up thei'matter of the City Judge. Motion carried. Greg Jones of Silverh., who had been appointed at the September 12, 1977 meeting to hear a case from -which Judge,Roy,White had asked to be excused. i has been hospitalized and woul:d.be unable to hear the case. Mayor Nix recommended to the Council that Mr. Leonard Oppenheim be nominated as Associate Judge Councilman Sam E. Box moved, seconded by Councilman Jack A. Stipes, to appoint Mr. Leonard Oppenheim as Associate Judge. Motion carried. Mayor Nix informed members of the Council that the newly created Personnel Board had held its organizational meeting and that Mr. Robert S. Berglin was appointed Chairman, Mr. Bill Johnson waIs appointed Vice -Chairman, and Mrs. Jean White was appointed Secretary of the Personnel Board. Mayor Nix told members of the Council that he had met with Mrs. Tommie Werneth of Community Consultants regarding grants available from the State of Alabama Highway Department for 100% funding on street markings and 70 % funding.on signs if the Council adopts the Safety Study and Proposal that was done by the Highway Department. The Council took the matter under advisement for study and action at the October 10th, 1977 meeting. Mayor Nix reported to members of the Council on a slight acciden with the fire truck where it was dented while backing up, and_ also of a dent in the side of the fire truck from a ladder hit- ting the side of the truck. Mayor Nix said that Fairhope Paint and Body Shop has quoted $ 48.00 as the price for fixing the dent in the side of the fire truck and $ 183.00 for fixing the dent in the back of the fire truck. J. Russell Kilgore brought members of the Council up to date on the Airport Expansion Project. Mr. Kilgore said that the contractor had been given the notice to proceed. Mr. Kilgore said that the Airport would be closed for three to five weeks during the paving time while the asphalt is being laid, and that all of the operators have been notified that the anticipated closing date is scheduled for around October 10, 1977. Councilman Jack A. Stipes moved, seconded by Councilman Billy Don Wiggins, to hear the recommendations from Moore Engineers, on the Street Improvement Project. Motion carried. Mr. Ack Moore of Moore Engineering told members of the Council that the bid opening on the Street Improvement Project had been held at 10:00 A.M., Monday, September 26th, 1977, at Cite Hall, and that the following were'the low bidders: Division A- Paving and Drainage Valta Construction Company $ 229,546.74 Division B- Sewer and Water Fairhope Paving Company, Inc 117,862.45 Mr. Moore recommended that the above bids be accepted and award- ed to the above named contractors. Councilman Jack A. Stipes moved, seconded by Councilman Billy Don Wiggins, to accept the recommendation of Moore Engineers and accept and award the bid on Division A -Paving and Drainage to Valta Construction Company in the amount of $229,546.74 and to award .the bid on ftvisiori B-Sewer' and Water to Fairhope Pavi Company in the amount of $ 117,,862'."45. Motion carried. !r r ai Fairhope City Council Minutes for 9-26-77 meeting Page No. 4 �r Mr. Thad Ingram submitted a tabulation of all of the bids received for the Street Improvement Project and these tabulations will will become a part of these minutes along with the letter of recommendation from Moore Engineering. Mayor Nix told members of. the Council :that Mrs. Voncille Halfner of the South Alabama Regional Planning Commission said that there was an additional slot available for Fairhope under the Senior Aid Program. Councilman David E. Bishop moved, seconded by Councilman Henry G Bishop for the City to accept the additional slot available under the Senior Aid Program, and to place the Senior Aid at the Fairhope Health Center. Motion carried.. Mayor Nix told members of the Council that the Radar Gun which was approved for purchase at the September 12, 1977 meeting for the Police Department in the amount of $ 895.00 was not the unit that they wanted and that -there were 50-50 State funds available for the purchase of the type of Radar Unit needed, whic would save the City money. Councilman Jack A. Stipes moved, seconded by Councilman.David E. Bishop for the City to proceed with applying for the 50-50 fund! from the State for the purchase of a Radar Unit for the Police Department. Motion carried; Councilman Jack A. Stipes recommended that the City look into an Ordinance which would require all new homes to have smoke alarms installed.
