COUNTY OF BALDWIN
The City Council of the City of Fairhope, Alabama met in regular
session on Monday, September 12, 1977, at 7:00 P.M., at the
City Administration Building, 387 Fairhope Avenue, Fairhope,
Alabama with the following members present: Mayor James P. Nix;
Councilmen: David E. Bishop, Henry G. Bishop, Sam E, Box,
Jack A. Stipes and Billy Don Wiggins.
The minutes of the August 22, 1977 meeting were approved.
Tommie Werneth, President of Community Consultants came before
the Mayor and Council to discuss the agreement between the City
of Fairhope and Community Consultants, whereby Community
Consultants would make applications on behalf of the City for
monies available through federal grants, state grants and local
grants, and other sources for the growth and development of
Cities.
Councilman Henry G. Bishop moved, seconded by Councilman Sam Box
for the City of Fairhope to engage the services of Community
Consultants, and to authorize the Mayor and City Clerk to execut
the agreement with the amendment that either party may terminate
the contract by giving the other party 30 days written notice.
Motion carried.
Mr. Geoff Cain came before the Mayor and Council to find_out_how
long it would be before the City will start on his drainage
project. The Council told Mr. Cain that the City was about
to complete the drainage project on the Kilgore property and tha
as soon as the pipe arrived they will start on his property.
Councilman Henry G. Bishop moved, seconded by Councilman Sam E,
Box, for the City to have membership as a commercial member in
the Chamber of Commerce, since the City is a business, with
Councilman David E. Bishop to be the representative. Motion
carried.
Councilman Jack A. Stipes moved, seconded by Councilman David E.
Bishop that any accidents with City vehicles and equipment must
be reported to the Council. Motion carried.
Councilman Sam E. Box moved, seconded by Councilman Henry G.
Bishop, for the City to send Don Odom and Johnny Bishop to Gas
School in Tuscaloosa. Motion carried.
This being the date set for the opening of bids on a Bush -hog,
the following bid was received:
Foley Tractor Company
1,057.00
Councilman Jack A. Stipes moved, seconded by Councilman Billy
Don Wiggins, for the City to accept the bid received .from
Foley Tractor Company once Councilman. Stipes and City Superinten
dent E.J. Kirk evaluate the bid. Motion carried.
Councilman Sam E. Box moved, seconded by Councilman Jack A. Stip
for the City to go out on bid to have the large water tank
cleaned and painted, with the schedule that this tank will be
shut down during the months of November and December. Motion
carried.

Mr. Lloyd Taylor, Mr. Dan Benton and Mr. Sam Irby, Attorneys -at -
Law, came before the Mayor and Council regarding their applica-
tion for a building permit..
Mr.,Benton told members of the Council that there was nothing in
the City's Zoning Ordinance that stated a building permit must
come before the Planning and Zoning Commission. Mr. Benton said
that the area in which they hope to construct the building was
calssified as Fire District 1, which states in Section 5.6 of
the City Code that building permits in this fire district must
be submitted to the City Council..
Mr. Benton was informed that building permit applications have
have always gone before the Planning and Zoning Commission, if
they were for a commercial building, Mr. John S. Parker, Chair-
man of the Fairhope Planning Commission was present at the meeti
and stated that the Planning Commission would be glad to hold a
special meeting at any time to hear the application.
Councilman Jack A. Stipes moved,- seconded by Councilman Sam E.
Box, for the application for a building permit by Taylor, Benton
and Irby, Attorneys -at -Law, to be referred to the Fairhope Plan-
ning Commission whereby a special meeting will be held to review
plans for the issuance of a building permit, Motion carried..
After a discussion on the materials being used to construct the
building regarding fire safety, the Council decided to get
the information regarding fire safety on fire -proof foams.
Councilman Billy Don Wiggins moved, seconded by Councilman Jack
A. Stipes that once the Fire Marshall has approved the materials
for construction regarding fire safety and once the Fairhope
Planning Commission okays the plans, a building permit will be
issued with Council approval and will not have to be resubmitted
to the City Council. Motion carried.
Councilman Jack A. Stipes moved, seconded by Councilman David E.
Bishop, for the City to establish the following rates on work
done by the City for labor on the work orders:

Motion carried.
Mayor Nix told members of the Council that Judge Roy White has
asked not to serve on a case due to the fact that one of his
relatives will be a witness. Councilman Sam E. Box moved, seconc
by Councilman Jack A. Stipes, that Greg Jones of Silverhill be
appointed to hear the case from which Roy White has asked to be
excused. Motion carried.
Councilman Billy Don Wiggins moved, seconded by Councilman Jack.
A. Stipes, for the City to purchase one (1) new up to date
radar unit for the Police Department. Motion carried.
Councilman Stipes requested a progress report on the following
items:
1. Painting of pier
2. Pipe on George McKean's building.
3. Paving of road at Fly Creek
4. Welding of top on garage area.
5. Stenzel drainage.

for Julwins Restaurant was presented. It was held over for
action until the September 26, 1977 meeting.
Councilman Jack A. Stipes moved, seconded by Councilman Sam E.
Box to hear the request of Mr. Robert Berglin and Mr..Jack Pope
for annexation into the City of Fairhope. Motion carried.
Ciuncilman Jack A. Stipes moved, seconded by Councilman Sam E,
Box to accept the recommendation of the Fairhope Planning Commis-
sion for annexation into the City of Fairhope 30 acres of land
south of the Big Head Gulley as R-3 with the restriction that .
the area will be developed with single family residences and
to annex into the city limits a five (5) acre tract on the west
side of South Section Street opposite the City Land Fill area as
a B-1 zone, as petitioned by Mr. Robert Berglin.
Upon being put to vote the following vote was recorded:
AYES: Henry G. Bishop, Sam E.. Box, Jack A. Stipes and Billy Don
Wiggins.
NAYES: David E. Bishop.
Motion carried.
Councilman Billy Don Wiggins moved, seconded by Councilman Jack
A. Stipes to receive the bids on painting at the pier as submitte(
by Mr. Bob Pope. Motion carried.
The following bids were received for painting on the pier;
1. Gorden Lindsey 568.70
2. McCrory's 796.00
3. Frank Mason 750,00
Councilman Jack A, Stipes moved, seconded by Councilman Billy Don
Wiggins, to accept the7 low bid with the bill to be paid for out
of the General Fund. Motion carried.
Councilman Jack A. Stipes requested that Mr. Pope fly the flag
on the pier as per the lease. Mr. Pope stated that at this time
there was no line on which to erect the flag. Mr. Rutherford
Electric Department Superintendent was asked to look into the
matter.
Councilman Billy Don Wiggins stated for the record that he felt
there was a need for the Physicians in Fairhope to have a working
agreement with the Police Department in emergency situations.
Councilman Henry G. Bishop moved, seconded by Councilman Jack A.
Stipes to pay the bills as presented. Motion carried.
There being no further business, on a motion duly made, seconded
and carried, the meeting adjourned. It
