HomeMy WebLinkAbout07-25-1977 Regular Meetings STATE OF ALABAMA COUNTY OF BALDWIN The City Council of the City of Fairhope, Alabama, met in regular session on Monday, July 25, 1977, at 7:00 P.M., at the City Administration Building, 387 Fairhope Avenue, Fairhope Alabama with the following members present: Mayor James P. Nix; Councilmen: David E. Bishop, Henry G: Bisho, Sam E. Box, Jack A. Stipes and Billy Don Wiggins. The minutes of the regular meeting July 11, 1977 were approved. The minutes of the special meeting July 20, 1977 were approved with the following addition: Councilman David E. Bishop moved, seconded by Councilman Henry G. Bishop, to put a letter of reprimand in Sargeant Yohn's ME regarding his recent conduct, and also to put a letter of reprimand in Police Chief Leo Gilheart's file stating that it is the consensus of the Council that such actions be ceased. Also, that the attitude on character -of a Police Officer should be;such,as=to reflect on and off duty a good represen- tative of .the'City-. Motion carried.' Stipes moved, seconded by Councilman Billy Don Wiggins, to authorize Councilman Henry G. Bishop and the City Clerk to evaluate the bids received and see which bid is the most feasible for the City of Fairhope. Motion carried. Mayor Nix informed members of the Council that South Alabama Regional Planning had informed the City that there was an additional slot available for Fairhope under the Senior Aid Program. Councilman Jack A. Stipes moved, seconded by Councilman David E. Bishop,,to accept the additional slot available under the Senior Aid Program. Motion carried. Councilman Sam Box moved, seconded by Councilman David E. Bish to adopt the following Resolution. Motion carried. RESOLUTION BE IT HEREBY RESOLVED BY THE MAYOR AND CITY COUNCIL,OF THE CITY OF FAIRHOPE, ALABAMA; that the following minimum require- ments apply in all zones designated on the FIRM: The following minimum requirements apply in all zones designated on the FIRM: -- - --1. Require permits for all proposed development in any area of special flood hazard. The "development" term is defined to mean "any man-made change to improved or unimproved real estate, including but not limited to buildings or other structures, mining, dredging, filling, grading, paving, excavation or drilling operations. I 2. Review permits for proposed development to assure that all other necessary permits have been received from those governmental agencies from which approval is required by Federal or State law. 3. Require that new construction (including prefabricated buildings and mobile homes) and substantial improvements be anchored to prevent flotation and lateral movement, and be constructed with flood resistant materials and methods. (See Section 1910.3(b)(8) for anchoring standards for mobile homes). 4. Assure that subdivision proposals and proposals for other developments, including their utilities and drainage, are located and designed to be consistent with the need to minimize flood damage. t 5. Require that all subdivision proposals and other proposed new developments greater than 50 lots or 5 acres, whichever is less, include base flood elevation data. ' 6. Require new water and sewer systems (including on -site systems) to be located and designed to avoid impairment. 7. Obtain and maintain records of elevations and floodproofing levels for all new or" substantially improved structures, and whether or not such structures contain a basement. 8. In riverine situations, notify adjacent communities and the State Coordinating Office prior to any alteration or relocation of a watercourse and submit copies of such notifications to FIA. Within the altered or relocated portion of any watercourse, assure that the flood carrying capacity is maintained. The following minimum requirements apply in specific zones designated on the FIRM: 9. In unnumbered A zones, obtain, review, and reasonably utilize base flood elevation data from alternative sources, prior to its being provided by FIA through its Flood Insurance Rate Study, as criteria for requiring that all new residential structures and substantial improvements to existing structures have their lowest floor (including basement) elevated to or above the base flood level, and that new nonresidential structures and substantial improvements to existing structures have the lowest floor (including basement) elevated or floodproofed to or above the base flood level.* 10. In zones Al-30, for new construction and substantial improvements, require that: Residential structures have the lowest floor (including basement) elevated to or above the base flood level, unless the community is granted an exception for the allowance of basements and/or storm cellars by the FIA. r +s = 0 e e Nonresidential structures have the lowest floor (including basement) elevated to or above the base flood level; or be floodproofed to or above that level.* 11. In zone A0, for new construction and substantial improvements, require that: Residential structures have the lowest floor (including basement) elevated above the crown of the nearest street to or above the depth number specified on the community's FIRM. Nonresidential structures have the lowest floor (including basement) elevated above the depth number specified on the community's FIRM; or be floodproofed to or above that level.* 12. In zones Al-30 and A0, where floodproofing is used in lieu of elevation, require that a registered professional engineer or architect certify that the floodproofing methods used are adequate to withstand the forces associated with the base flood and submit such certification to the community; or submit to the FIA for approval, local regulations containing detailed floodproofing specifications which meet the watertight performance standards of Section 1910.3(c). 13. In zones Al-30, for new, substantially improved, or expanded mobile home parks or subdivisions and for mobile home placement not in existing mobile home parks or subdivisions, require: that stands or lots are elevated to or above the base flood level, that adequate access and drainage is provided, and, if pilings are used for elevation, that the construction standards for elevation on pilings are met (see Section 1910.3(c)(5)(iii)). 14. Adopt a regulatory floodway and assure that it is designed to carry the waters of the base flood without increasing the base flood level more than one foot at any point. 15. In the regulatory floodway, prohibit any development or encroachment (including fill) which would result in any increase in flood levels during the base flood discharge. 16. In the regulatory floodway, prohibit the placement of mobile homes, except in existing mobile home parks or subdivisions. 17. In zones V1-30, require that all new construction and substantial improvements: A. are elevated and secured to adequately anchored pilings and columns to that the lowest portion of the structural members of the lowest floor (excluding pilings or columns) is elevated to or above the base flood level and is certified by a registered professional engineer or architect that the structure is secured to adequately anchored pilings or columns in order to withstand velocity waters and hurricane wave wash, and B. have space below the lowest floor free of obstruction or constructed with "breakaway walls" intended to collapse under stress without jeopardizing the structural support of the structure. 18. In zones V1-30, assure that all new construction is located landward of the reach of mean high tide. 19. In zones V1-30, prohibit the placement of mobile homes, except in existing mobile home parks or subdivisions. 20. In zones V1-30, prohibit the alteration of sanddunes and mangrove stands which would increase potential flood damage. *The term'"floodproofed" is defined to mean "watertight with walls substantially impermeable to the passage of water and with structural components having the capability of resisting hydrostatic and hydrodynamic loads and effects of buoyancy." Section 1910.3(d) and (e) - Summary Jai wary 1977-- ADOPTED THIS THE DAY 0 'TEST : CI EE Councilman. Jack A. Stipes moved, seconded by Councilman Sam E. Box, for the City to go out on bid for a new one half ton truck for the meter department, with bids to be quoted with and without trade in of the old truck. Motion carried. Councilman Jack A. Stipes told members of the Council that he felt there was a need for additional rest rooms at the north end of the beach. Mr. Stipes stated that the cost would be approximately $ 9,000.00 to construct a rest room with an area in which to change clothes. City Superintendent E.J. Kirk was instructed to work up a cost estimate on constructing the rest rooms and report back at the August 8, 1977 meeting of the Council. A petition for annexation from Jack Pope, Mannich Realtors agent, was referred to the Fairhope Planning Commission for their recommendations. Councilman Henry G. Bishop moved, seconded by Councilman Jack A. Stipes to adopt the following Resolution. Motion carried. RESOLUTION WHEREAS, John Coleman was a highly valued employee of the City of Fairhope, and WHEREAS, Jqhn Coleman served with dedication as head mechanic of the City of Fairhope for fourteen years, and WHEREAS, John4Coleman departed this►jife on the 22nd day of July, 197� NOW, THEREFORE, BE IT RESOLVED, l ' ►, -Tha f?the +Mayor and •Council of the City of Fairhope mourn the passing of John Coleman and extend to his wife and members of his family, their deepest sympathy, and, BE IT FURTHER RESOLVED, That this Resolution be spread upon the minutes of the Council of the City of Fairhope in honor and memory of John Coleman,, and, BE IT FURTHER RESOLVED, .t That a copy of this Resolution be sent to the wife of John Coleman. ADOPTED THIS THE DAY OF 1977. MAYOR ATTEST: i Councilman Sam E. Box moved, seconded by Councilman Henry G. Bishop to act upon the request of Les Boone regarding the water rates at Winterhaven Trailer Court. Motion carried. Councilman Sam E. Box moved, seconded by Councilman Henry G. Bishop that Mr. Boone's request to have the Council revise the water rates at Winterhaven Trailer Court be denied. Motion carried. Councilman Jack A. Stipes moved, seconded by Councilman Billy Don Wiggins, to hear the request of First Southern Federal. Motion carried. Mayor Nix told members of the Council that he had received a request from First Southern Federal for the City to swap thirteen feet along Greeno Road for thirteen feet on the south side of their property. After a discussion, the matter was turned over to the City Attorney for research and for his recommendation to the Council regarding the request of First Southern Federal. Mr. Les Boone requested that he go on record as stating that if there is a flood in the Winterhaven Trailer Court part of the determining factor will be the drainage that the City is installing on the Cain property. There being no further business on a motion duly made, seconded; and carried, the meeting adjourned. r ATTEST: tis Councilman Henry G. Bishop moved, seconded by Councilman David E. Bishop that the Clerk and the Mayor be authorized to transfer money from the General Obligation Electric Warrant sinking fund in the amount that had been overpaid since July 1, 1975, to the Electric Fund Operating Account, to pay for the new transformer for the electric system. Motion carried. Mayor Nix told members of the Council that he had received a price from the State Highway Department regarding the installa- tion of a traffic light on Highway 98 and Gayfer Street. The State Highway Department said it would cost $ 16,819.00 for the installation of the light. Councilman Billy Don Wiggins moved, seconded by Councilman Jack A. Stipes, for the City not to proceed with the installation of a traffic light on Highway 98 and Gayfer Street due to the extreme cost quoted by the Highway Department for the installa- tion of .the light. Motion carried. Councillman Billy Don Wiggins'moved, seconded by Councilman Henry G. Bishop,' to :authorize the 'Ci't=y` Clerk to go out on bid for a new copy machine for the City. Motion carried. Counci-lman Jack A'.."Stipes asked about the City's procedure in installing water pipes for';West Baldwin ?.-?ater' Authority, regard- ing how the City charges ]F four the installation of pipe. Councilman Jack A. Stipes moved, seconded by Councilman Billy Don Wiggins for the {Council to hear a Performance Bond on Hawn Developers, Inc. and the Kilgore drainage. Motion carried. Councilman Jack A. Stipes moved, seconded by Councilman David E. Bishop, for the City to accept a Performance Bond,on Hawn Developers, Inc. in the amount of $ 60,000.00 for install- ation of improvements in Fairuaood Subdivision Unit No. 20. Motion carried. Councilman Jack A. Stipes moved, seconded by Councilman Henry G. Bishop, for the City to correct the drainage problem on the Kilgore property for the approximate cost of $ 4,300.00. Motion carried. Councilman David E. Bishop moved, seconded by Councilman Jack A. Stipes to approve the bills for payment. Motion,carried. Councilman David E. Bishop told members of the Council that the Dixie Youth State Tournament will be held in Fairhope from August 1st thru August 6th, 1977. ___-- Councilman David Bishop told members of the Council'of a letter which he had received regarding the erratic manner in which the meters were being read._ The letter was turned over,to City Superintendent Jack Kirk-fo-`look into the situation., Mr. Herb Pierce came before the Mayor and Council regarding the erection of a sign at Herb's restaurant. Mr. Pierce said that he had invested a great deal of.money in the sign and due to the setback requirements of the'Zoning Ordinance he was now unable to erect the sign. The Council recommended that Mr. Pierce appeal to the Board of Adjustments and Appeals for a variance. There being no further business on a motion duly made, seconded and carried, the meeting adjourned. The Honorable Mayor and Council of the City of Fairhope Gentlemen: I own property on Morphy Avenue along a low lying area that drains water from the Middle School area- Fairhope's new water well # 1 and Fairhope Avenue Baptist Church. I requested some help to open this drainage when the new well was being pumped to waste in order to clean the well, and did receive this help until the tractor became stuck in the mud several times. At that time it was decided to wait until the weather was drier. Now that the dry weather is here I would like to request that the job be 'completed . Sincerely, L e Park V
