COUNTY OF BALDWIN
The City Council of the City of Fairhope, Alabama met in special
session on Wednesday, July 20th, 1977, at 5:30 P.M., at the
City Administration Building, 387 Fairhope Avenue, Fairhope,
Alabama, with the following members present: Mayor James P. Nix;
Councilmen: David E. Bishop, Henry G. Bishop, Sam E. Box, Jack
A. Stipes.
Members absent: Councilman Billy Don Wiggins.
The purpose of the special called meeting was to act upon person-
nel problems in the Fire and Police Departments.
Mayor James P. Nix told members of the Council that Robert T.
Hawkins had been layed off for two (2) weeks for the following
reasons:
1. Actions unbecoming;a City Employee.
2. Neglect of duties, at the Fire Station.
Mayor,Nix told Council, members. -that after investigating the
situation regarding Robert Hawkins and based on the information
obtained from the investigation, he could not recommend the re-
instatement of Robert Hawkins.
Councilman Jack A. Stipes moved, seconded by Councilman Sam E. Bc
to accept the recommendation of Mayor Nix and terminate Robert T.
Hawkins on a permanent basis. Motion carried.
Mayor Nix informed members of the Council on the'investigation of
Sargeant Walter Mack Yohn regarding his two (2) week lay off from
the Police Department. Mayor Nix stated that Officer Yohn was
layed off from the Police Department due to inattentiveness of
duties when in the presence of a certain individual, which was
causing disruption in the Police Department. Also, Officer Yohn
has invited a person not connected with the Police Department to
witness a P.E.I. Test which is against Department rules.
Mayor Nix told members of the Council that he felt the recent two
week lay off of Officer Yohn was as severe a reprimand as could
be given based on the evidence obtained after investigating the
situation.
Police Chief Leo Gilheart and Sargeant Yohn were present at the
meeting to answer the questions of the Council regarding the
allegations.
The Mayor and Council questioned Officer Yohn about the various
circumstances involved in his -two week lay off. After a lengthy
discussion between members of the Council and Officer Yohn, it
was the general consensus of the Council that there was not
enough concrete evidence to terminate Officer Yohn on a permanent
basis.
Councilman David E. Bishop moved, seconded by Councilman Henry
G. Bishop, to put a letter of reprimand in Sargeant Yohn's
personnel file regarding his recent conduct, and also to put
a letter in Police Chief Leo Gilheart's file stating that it is
the consensus of the Council that such actions be ceased. Also,
that the attitude on character of a Police Officer should be
such as to reflect on and off duty a good representative of the
City. Motion carried.

seconded and carried, the meeting adjourned.
