HomeMy WebLinkAbout06-13-1977 Regular MeetingSTATE OF ALABAMA COUNTY OF BALDWIN The City Council of the City of Fairhope, Alabama met in regular session on Monday, June 13th, 1977, at 7:OO P.M., at the City Administration Building, 387 Fairhope Avenue, Fairhope, Alabama with the following members present: Mayor James P. Nix; Councilmen: David E. Bishop, Henry G. Bishop, Sam E. Box, Jack A. Stipes and Billy Don Wiggins. The minutes of the May 23, 1977 meeting were approved with the following addition: Councilman Henry G. Bishop moved to authorize Moore Engineer- ing to proceed with street improvements under Ordinance No. 588, and also to reaffirm the City's contract with Moore Engineering that has been in effect since March 9th, 1970. Councilman David E. Bishop seconded the motion. Motion carried. Mr. Jason Kutack introduced the new Director of the Fairhope Public Library, Ms. Claire Oaks, to the Mayor and Council. Councilman Sam E. Box moved, seconded by Councilman Billy Don Wiggins, to grant a beer and wine permit to the Pizza Hut Restaurant. Upon being put to vote the following vote was recorded: AYES: -Henry G. Bishop, Sam E. Box, Jack A. Stipes, Billy Don Wiggins. NAYES: David E. Bishop. Motion carried. Councilman Henry G. Bishop moved, seconded by Councilman Sam E. Box to grant a beer permit to the Montrose Tennis Club, once the construction of the building is completed. Motion carried. i c ( .1 46 The Mayor and Council received a letter from Mr. Lee Parker requesting that. -the City,,complete the drainage project on his property on lvlorphy Avenue now' -that the weather is drier. This letter' `shall •become a -part of these minutes. Councilman Jack A. Stipes moved, seconded by Councilman David E..,'Bishop, to proceed,'with the drainage project on r' Mr. Lee Parkes property once the City'has received a letter from Mr. Parker stating that .the City will not be responsible for any damages that might occur to his land. Councilman David E. Bishop seconded the motion. Motion carried. Councilman Billy Don Wiggins moved, seconded by Councilman Jack A. Stipes to open the bids received on a backhoe and gas metering equipment. Motion carried. The following bids were received on the Backhoe: 1. Foley Tractor $ 16,882.00 2. Carl Grant Tractor 16.,341.55 3. Lee -Roy Jordan 15,591.00 Councilman Sam E. Box moved, seconded by Councilman Jack A. Bishop, to accept the low bid providing it meets specifications, ,and have Owen S. Posey and Associates, Engineers, evaluate the bids with the City's Superintendent. Motion carried. Councilman Henry'G. Bishop moved, seconded by Councilman Billy Don Wiggins, to adopt the following Resolution: Motion carried. WHEREAS, RESOLUTION FRANK J. MANCI was a long-time walued citizen of the CITY OF FAIRHOPE, and WHEREAS, FRANK J. MANCI served long and faithfully as a member of the Board of Adjustment of the CITY OF FAIRHOPE, and WHEREAS, FRANK J. MANCI departed this life on the 29th day of May, 1977, NOW, }THEREFORE, BE IT RESOLVED,` That the Playor and City -Council of the CITY OF FAIRHOPE mourn the passing of FRANK J. MANCI and extend to his �. 1" k Ens wife and other members of�his,.family; their deepest sympathy, and BE IT FURTHER RESOLVED, that this Resolution be spread upon the Minutes of the Council of the CITY OF FAIRHOPE, ALABAMA, in honor and memory of FRANK J. MANCI, and BE IT FURTHER RESOLVED that a copy of this Resolution be sent to the wife of FRANK J. MANCI. ATTEST: CI ADOPTED THIS THE 13th day of June, 1977. 0 Councilman Henry G. Bishop nominated Mr. Peyton M. Walker to fill the unexpired term of Mr. Frank J. Manci, on the Board of Adjustments and Appeals. Councilman Jack A. Stipes moved, seconded by Councilman David E. Bishop, that the nominations be closed. Motion carried. Mr. Peyton M. Walker was appointed to serve as a member of the Board of Adjustments and Appeals until October of 1978. Councilman David E. Bishop moved, seconded by Councilman Billy Don Wiggins, for the City to reject a counter offer of $ 8,000.00 for the purchase of the property adjacent to the substation on the corner of Twin Beech and Young Street from Alma Jordan. Motion carried. Mayor Nix told members of the Council that a decision would have to be made regarding the slot available on the Senior Aid Program. Councilman David E. Bishop recommended contacting the various Senior Citizen's clubs for their suggestions re- garding the usage of the twenty hours per week. Mayor Nix appointed Councilmen David E. Bishop and Jack A. Stipes as a committee to contact the senior citizens groups for an input as to how the City can best utilize the slot available under the Senior Aid Program. Mrs. Leona Newman came before the Mayor and Council and regard- ing the beach area in Fairhope. Mrs. Newman offered the following suggestions to members of the council as ways to improve the beach: 1. Restrict the park after ,dark. 2. Restrict parking all along the bayside of the road of the park. 3. Paint the trash cans bright orange or yellow to help with the trash problem. 4. Put up a cable. 5. Have parking attendent remind people as the enter park that there are no alcoholic beverages allowed. 6. Have constructive editorials in the Courier to bette educate the citizens. Mrs. Newman said that she was representing the people on North'Bayview , and that they were suggesting these things in an effort to save the City's beach area for the future. The Mayor and Council discussed the extension of the City's water lines down Mosely Road, out east of Fairhope, and out east on Fairhope Avenue and possibly down Highway 98. The Mayor stated that West Baldwin Water Authority is also considering the extension of lines in these areas and the City needed to decide if they wanted to extend the lines themselves. Councilman David E. Bishop moved, seconded by Councilman Billy Don, Wiggins, to authorize Moore Engineering to conduct a feasibility study regarding the extension of the City's water lines. Motion carried._ Councilman -David E. Bishop moved, seconded by Councilman Jack A. Stipes.to deny the request of=Mr. Leon Harris for an appropriation of $'50.0.00 for the Bay Area Regional Alcoholic Council. Motion carried. i S Councilman Sam E. Box introduced the following Ordinance: k Ordinance Nq.�s� AN ORDINANCE TO AMEND ORDINANCE NO. 586 TO ESTABLISH THAT ALL CUSTOMERS USING A 2 INCH, 3 INCH, AND 4 INCH CONNECTIO: SHALL PAY FOR THE ENTIRE COST OF METERS AND TO PAY THE COSTS OF INSTALLATION OF THE SAME. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FAIRHOPE FAIRHOPE, ALABAMA: That Ordinance No.- 5,86 be, and the same is hereby AMENDED } f to read as follows: s Any customer desiririg'to'connect with the City's water supply 'on �a 12, inch', 2-inch, 3-inch or 4-inch connection or larger, shall pay to the CITY OF FAIRHOPE the costs of the meter and to pay all costs of installing the same, in addition to the regular rates as set out in the Original Ordinance No. RM Any and all other Ordinances in conflict herewith, be, and the same are hereby REPEALED. This Ordinance shall take effect upon its due adoption and publication as required by law. ADOPTED THIS THE yV OF , 1977. Councilman Jack A.'Stipes moved, seconded by Councilman Henry G. Bishop, to hire an extra man at the beach during the peak period. Motion carried. A , 4 Councilman Henry G. Bishop introduced the following Ordinance: ORDINANCE, NO. o-5 0— BE IT ORDAINED BY THE CITY COUNCIL OF FAIRHOPE, ALABAMA, AS FOLLOWS: Section I. Purpose I E There is hereby established a personnel'.system for the City of Fairhope. Such system shall be established on the following merit principles: (a) Recruiting, selecting,and advancing employees on the basis of their relative ability, knowledge, and skills, includi open competition of qualified applicants for initial appointment; (b) Establishing pay rates consistent with the principle of providing comparable pay for•comparable work; (c) Training employees, as needed to assure high quality performance, (d) i Retaining employees on', the basis of the adequacy of their�performance,,correcting inadequate performance and separ- atin, employees�whose,inadequa'te performance can not be correctec (e). As.suring fair treatment of applicants and employees in all aspects of personnel administration without regard to political affiliation, race, color, creed, national origin or ancestry, sex or religion. Section II Classified service, exceptions The classified service shall include all employees serving in continuing positions in the municipality except the following: (a) Members of the municipal governing body and other elected officials; (b) Members of appointed boards, commissions, municipal judges and municipal attorneys; (c) Persons -employed to work less than full-time; (d) Volunteer personnel who receive no regular compensatior frog .the municipality; 0 Section II Classified service, exceptions (con't.) (e) jemporary-positions�scheduled for less than one F year's duration unless specifically covered by the action I f ' the mayor 'and, muri .cipal council; (f) Persons preforming work under contract for the r R E municipality who are not carried on the payroll as employees; Nothing herein shall be construed as precluding the ma and/or municipal Governing Body from filling any excepted positions in the manner in which positions in the classified service are filled. Section III Personnel Officer The Mayor is hereby designated to perform the duties of personnel officer. He may have other staff members designated to assist him or may designate any member of his staff to assist him. Section IV Duties of the Personnel Officer The personnel officer shall be responsible for the personnel administration system and shall direct all of its administrative and technical activities. His duties shall include, but not be limited to, the following: (a) encourage and excercise leadership in the 'develop- , ment of effective personnel administration practices within the municipality; (b) investigate from time to time the operation and effect of this -law and the policies made thereunder and to report his findings and recommendations to the mayor and municipal Governing Body; 1 4 n (c) establish and maintain comprehensive personnel records for each employee in the municipality's service including for each-employee,his classification, pay rate, date of employment and other relevant data.; '-,(d)" .'advise°' -.the mayor and municipal Goevrning Body regard- ing the most -effective manpower.resources; 9 { - F , (e) make an annual report to the mayor and municipal Governing Body regarding the status of the personnel administra- tion program. Section V Preparation of Personnel Rules and Regulations The personnel officer shall not more than ninety (90) days after the effective date of this ordinance draft or cause to be"drafted the personnel rules and regulations for the municipality. Such rules shall become effective upon passage of an appropriate ordinance by the municipal Governing Body. The policies shall provide for: (a) The classification of all positions, based on duties, authority and responsibility of each position, with adequate provisions for reclassification of any -positions warranted by changed circumstances; (b) A pay plan for classified vacancies and acceptance of application for employment; (c) announcement of employee vacancies and acceptance of application for employment; (d) preparation and administration of examinations, if appropriate; (e) establishment and use of eligibility lists, if appropriate; (f) establishment of promotion policies and procedures; (g) transfer, promotion and reinstatement of employees; (h) performance evaluations of employees, including those on probationary periods; ' (i) separation of employees from the classified service by resignation, suspension, dismissal, layoff, or incapacity to perform duties; IISection V Preparation of Personnel Rules and Regulations(cont.) (j) grievance and appeal procedures; (k) establishment of hours of work, holidays, vacations, leave regulations and procedures; (1) outside employment of municipal employees; (m) establishment of a probation period for all employees prior to final appointment; (n) development of employee morale, safety and training programs; (o) such other matters as may be necessary to carry out thel intent and purpose of this ordinance. Section VI. Pavroll verification The personnel officer or his authorized agent shall be responsible for the certification of the payroll vouchers that the persons named therein have been appointed and employed in accordance with the provisions of this ordinance and the policies thereunder. The disbursing officer of the municipality shall not make or approve"or take part in making or approving any payment for the personal service to any person holding a position in the municipality unless said payroll voucher or account of suc pay bears the certification of thelpersonnel officer or his authorized agent. ecti—_ V.II Repealer r That any ordinance or part thereof in conflict with this ordinance be'and the same is hereby repealed. :SECTIQN: VIII ` Severabilit If any section or provision of this ordinance be declared to be invalid or unconstitutional by judgement or decree of a court of competant jurisdiction such judgement or decree shall not affect any other section or provision of this ordinance.
