HomeMy WebLinkAbout05-23-1977 Regular MeetingSTATE OF ALABAMA COUNTY OF BALDWIN The City Council of the City of Fairhope, Alabama met in regular session on Monday, May 23, 1977, at 7:00 P.11. at the City Administration Building, 387 Fairhope Avenue, Fairhope Alabama with the following members present: Mayor James P. Nix; Councilmen: David E. Bishop, Henry G. Bishop, Sam E. Box, Jack A. Stipes and Billy Don Wiggins. The minutes of the regular meeting May 9th, 1977 were approved. The minutes of the special meetings May 12, 1977 and May 14, 1977 were approved. This being the date set -for a public hearing on the proposed Street Improvement Program Mayor Nix stated that the purpose of the meeting was to hear any protests or objections and that Council would take one street at a time. Engineer Ack Moore was present at the meeting to answer any questions from the property owners. Laurel Street: The following property owners were present: Ken and Andi Burton of 156 Laurel Street; Mrs. Chaplain 109 Laurel Street; Mr. McKeown 166 Laurel; Mr. Horechny 154 Laurel; Mr. Sloan 150 Laurel; Mrs. Hanson 165 Laurel; Mr. and Mrs. Duck( end of Laurel Street ); Mr. Jones 158 Laurel, Mrs Rocco Gambino 153 Laurel; Mr. B.I. Reynolc of 112 Laurel sent a letter to the Mayor and Council stating that he was in favor of the paving. The Mayor called for a show of hands from all property owners present from Laurel Street in favor of the street improvements. There were fifteen votes in favor and one letter. No one was opposed. Church Street: No one was present to oppose. Chestnut Street: Mr. Melvin Wagner stated that he was opposed, an Mr. Dunn of 372 Pecan street stated that he was opposed. 1Mr. Wagner has 230 feet on Chestnut and Mr. Dunn has 150 feet. Third Street: No one was present to oppose. Fig Street: Mr. Melvin Wagner stated that he was in favor of the street improvement on Fig Street. Mr. Wagner has 100 feet on Fig. Mr. Robert Berglin stated that he was in favor of Fig Street. Wisteria Street: Mr. A.B. Rider of 364 Wisteria stated that he was in favor of Wisteria. J.F. Blazi of 457-% Dogwood stated that he was in favor of the improvements. Mr. Stanley Fant of 363 Wisteria stated that he was in favor of the improvements. Mr. William Gardner of 369 Wisteria stated that he was in favor of the improvements. John Taylor of 356 Wisteria stated that he was in favor of the improvements. Upon a show of hands from all property owners in favor of Wisteria Street all present were in favor. No one opposed. Is School Street: Beth Robinson of 411 S. School St. stated that she was in favor of the improvements. Mr. James Akins of 359'S. School St. stated that he was in favor of the improvements. Mr. J.A. Evans of 360 S. School St. stated that he was in favor of the paving. Mr. Mark Owens of 351 S. School St.. stated that he was in favor of the improvements. No one present was opposed. Lincoln Street: No one present to oppose improve- ments on Lincoln Street. Wood Grove Circle: No one present to oppose improve- ments on Wood Grove Circle. Councilman Jack A. Stipes moved, seconded by Councilman Henry G. Bishop for final adoption of Ordinance No. 587, an Ordinance fixing and 'establishing- the= grade of.'the streets under the new improvement program. Motion carried. Councilman Jack A9 Stipess moved', seconded by Councilman Billy Don Wiggins,'for final adoption of -Ordinance No. 588, an Ordinance to provide for certain improvements on Laurel Street, Church Street`=,IChei'nut`Street,lThird Avenue, Fig Street, Wisteri Street, School Street, Lincoln Street, Wood Grove Circle, Orchard Drive, Spring Run, East Gate Drive, Autumn Drive, Ronforth Drive, and Kurlane Street. Motion carried. Councilman Henry G. Bishop moved to authorize Moore Engineering to proceed with street improvements under Ordinance No. 588, and reaffirm the Mr. Moore,'s contract that he has had with the City since the beginning. Councilman David E. Bishop seconded the motion. Motion carried. Councilman Henry G. Bishop reported on the financial condition o the City's Water and Sewer Department, and handed copies of his report to members of the Council. Mr. Bishop showed how the City's Water and Sewer Department has lost money over the years a.nd the necessity of raising the water rates. Members of the Council discussed the increase of the water rates and agreed upon the following amendment as proposed by Council- man Jack A. Stipes: Each owner of any apartment, condominiums, or business shall be charged with a minimum rate for water and a minimum rate for sewer for each unit, or the proposed rate which ever is greater. Councilman Sam E. Box moved for final adoption of Ordinance No. 586 with the following amendment r Section 6.-Each owner of any apartment, condominimums or business shall be charged with a minimum rate for water and a minimum rate for sewer for each unit, or the proposed rate whichever is greater. Councilman Billy Don Wiggins seconded the motion. Upon being put to vote the following vote was recorded: AYES: David E. Bishop, Henry G. Bishop, Sam'E. Box, and Billy Don Wiggins. NAPES: Jack A. Stipes. Motion carried. Councilman Billy Don Wiggins moved, seconded by Councilman Jack A. Stipes for final adoption of Ordinance No. 589; an Ordinance to prohibit any firm, corporation, or agents thereof, from using the Garbage Dump of the City of Fairhope. Motion carried. Councilman Sam E. Box moved, seconded by Councilman Billy Don Wiggins, for approval of the application of Juanita Love for a beer and liquor permit for Love's Place ( formerly Big Daddy's Motion carried. The application of Pizza Hut for a beer and wine permit was held over for action at the June 13th, 1977 meeting of the City Counci Tom Davis and James Keller came before the Mayor and Council rperesenting the Montrose property owners. Mr. Davis asked the Mayor and Council if the City of Fairhope would provide Police and Fire protection if Montrose were to incorporate. Mayor Nix told Mr. Davis and Mr. Keller that he had checked with the Alabama ,League of Municipalities regarding the legal aspects of providing police and fire protection outside the City limits and was 'told by the staff attorney that while it wasn't illegal for a Municipality to do this it would leave the municipality open for a tremendous liability, and that he did not fell Fairhope would go outside of its Police Jurisdiction to provide these services. Mr. Leon Harris of the Bay Area Regional Alcoholic Council came before the Mayor and Council requesting an appropriation of $ 500.00 for his program. Mr. Harris explained the Bay Area Regional Alcoholic Council's program and budget to members of the Council. Councilman Billy Don Wiggins moved, seconded by Councilman Jack A. Stipes, to lay over on the request from the Bay Area Regional Alcoholic Council for a $ 500.00 appropriation. Motion carried. Mayor Nix informed members of the Council on the Senior Aid Program which would employ one person for twenty hours per week over the age of fifty-five. The cost to the City would be $ 286.41 for the total year with the Government paying the remainder of the salary. Councilman Jack A. Stipes moved, seconded by Councilman David E. Bishop, for the City to partici- pate in the program, with the provision that it be brought back before the Council at a later date. Motion carried. Mr. Joe Odom of the National Guard came before the Mayor and Council and requested that the City grant military leave with pay for the men who go to camp. Councilman David E. Bishop moved, seconded by Councilman Jack A. Stipes, for the City to pay the difference between National Guard pay and normal pay for the men who attend camp. Motion carried. Councilman Jack A. Stipes reported on the drainage problem on the Kilgore property. Mr% Stipes said that Mr. Kilgore had agreed to give an easement across"his property to a point where it comes into Section Street. Councilman Stipes recommended that the City see about obtaining an easementtfrom the adjoining property owner in order to take care*of the drainage problem. Councilman Jack A. Stipes introduced,,the following Ordinance: \. le+'1 .Y^ ORDINANCE NO. 10 AN ORDINANCE TO PROHIBIT_ANY MOTOR VEHICLE FROM ENTERING INTO THE BEACH PARK OF. THE CITY OF FAIRHOPE, FAIRHOPE, ALABAMA WITHOUT PAYING THE ENTRANCE.FEE THEREFOR AND ESTABLISHING A MINIMUM AND MAXIMUM FINE FOR VIOLATION OF THE SAME. SECTION I - It shall be unlawful for any person to drive any type of motor vehicle into the beach park of the City of Fairhope, Fairhope, Alabama without paying the entrance fee therefor. SECTION II - Any person found to be in violation of this Ordinance shall be punished by a fine of not less than $5.00 nor more than $25.00 at the discretion of the Court. Mr. Warren Willard came before the Mayor and Council requesting approval for the opening of a non -liquor discotheque to be open from 7:00 P.M. to 12:00 A.M.. Councilman Billy Don Wiggins moved, seconded by Councilman David E. Bishop to hold over on consideration of Mr. Willard's request until the May 23rd, 1977 meeting of the City Council. Motion carried. The application for a beer and liquor license for Love's Place formerly " Big'Daddy's " was presented for the first time and held over for action until the May 23rd, 1977 meeting. Mayor Nix told Council members that Dr. Diegman has bought the pipe to be installed across his property for drainage and has requested the use of City labor. ! Councilman,Sam E. Box moved, seconded"by Councilman Billy Don Wiggins, to install the pipe `across Dr'. Diegman'.s property in order to save the drainage. Motion carried. 4 ' Councilman David-E.,Bishop moved,to -introduce the following Ordinance: ' GRADE ORDINANCE*•'NO. AN ORDINANCE FIXING AND ESTABLISHING THE GRADE OF A CERTAIN PORTION OF LAUREL STREET, CHURCH STREET, CHESTNUT STREET, THIRD AVENUE, FIG STREET, WISTERIA STREET, SCHOOL STREET, LINCOLN STREET, WOOD GROVE CIRCLE, ORCHARD DRIVE, SPRING RUN, EAST GATE DRIVE, AUTUMN DRIVE, RONFORTH DRIVE, AND KURLANE STREET. 1 BE IT ORDAINED BY THE City Council of the City of Fairhope, labama as follows: SECTION 1, That the grade of Laurel Street, Church Street, Chestnut Street, ,Third Avenue, Fig Street, Wisteria Street, School Street, Lincoln Street, Wood Grove Circle, Orchard Drive, Spring Run, East Gate Drive, Autumn Drive, Ronforth Drive, and Kurlane Street, be and the same are hereby fixed and established as shown on the plans heretofore exhibited to the City Council and now on file and open for inspection in the Office of the City Clerk. BE IT ORDAINED by the City Council of the City of Fairhope, Alabama as follows: SECTION 1, That the following described streets in the City of Fairhope, Alabama shall be improved as hereinafter provided between the respective terminal points hereinafter set forth: (a) LAUREL STREET: From the east edge of the pavement on Laurel Street, at its intersection with Satsuma Street, easterly approximately 1400 linear feet, more or less, to the east end of a temporary turn around. (b) CHURCH STREET: From the south edge of the pavement at the intersection with Fig Street, south approximately 600 linear feet, more or less. (c) CHESTNUT STREET: From the south edge of pavement on Pecan Street, south to Fig Street, approximately 1080 linear feet, more or less. (k) SPRING RUN: From the east edge of pavement on Greeno Road, easterly approximately 1200 linear feet, more or less, to East Gate.Drive in East of the Sun Subdivision. (1) EAST GATE DRIVE: From the east end of Spring Run, south approximately 1100 linear feet, more or less, to the east end of Autumn Drive in East of the Sun Subdivision. (m) AUTUMN DRIVE: From the south end of East Gate Drive,' westerly to the east edge of pavement of Greeno Road, approx— imately 1200 linear feet, more or less, in East of the Sun Subdivision. (n) RONFORTH DRIVE: From the north end of the pavement on Ronforth Drive northerly to the south edge of pavement on Fairwood Blvd., approximately 600 linear feet, more or less. (o) KURLANE STREET: From the west end of the pavement on Kurlane Street, southerly approximately 650 linear feet, more or less, to an intersection with Ronforth Drive. Improvements to the hereinabove described streets shall be as follows; (a) Both edges of a 25 foot roadway, the centerline of which shall be approximately in the center of the dedicated right of way shall be curbed and guttered with Portland,Cement Con— crete combined curb and gutter 6 inches thick and 2.5 feet wide; the curb lines of said gutters shall be connected with the curb lines of all intersecting streets, with Concrete combined curb and gutter as above described, o,f,suitable radius and the surface between the gutters to be constructed- -2— shall be ....,jroved by paving with Bituminous Plant M 1 inches thick on a 6 inch compacted sand clay foundation; said improvement shall include grading, paving, and all neces— sary drainage structures, including concrete culverts, con— crete pipe, valley gutters and drop inlets; manholes of brick with cast iron covers shall be constructed or reconstructed Where needed. (b) Where sanitary sewer lines are included as a necessary part of the street improvements, the said sewer lines shall be constructed with Vitrified Clay Sewer Pipe, to the diameter, location, and grade as shown on the plans and specifications; said improvement shall include all sewer lines, laterals, manholes, fittings, pump stations and force mains, trenching and trench bracing, backfilling and restoring the site and roadway surfaces, as necessary, to complete the work. (c) Where water lines are included as a necessary part of the street improvements, the said water lines shall be constructed with class 150 cast iron or ductile iron pipe, or class 160 P.V.C. pipe, to the diameter and location as shown on the plans and specifications; said improvement shall include all water lines, service lines and connections to the water main, Fire Plugs, valves and fittings, tren— ching, backfill and restoring the site and roadway surfaces as necessary to complete the work. SECTION 2. That the full details, drawings, plans, speci— fications and surveys of the above described work and estimates which have been prepared by Moore Engineering Company, who has been duly designated and appointed City Engineer by this Council, have been fully considered and studied by this., Council and hereby are adopted. Said details, drawings, plans, specifications, surveys and estimates shall be immediately placed on file in the Office of the City Clerk of the City of Fairhope, Alabama, where property owners who may be affected by such improvements may see and examine them. SECTION 3. That improvements hereinabove described shall be made in accordance with the grades heretofore established by Ordinance and according to the full details, drawings, plans, specifications and surveys of said work and estimates herein adopted, all under the supervision of the City Engineer. Irv•10 shall be assessed against the property abutting on the por— tions of these streets so improved, provided: (a) That the cost of street improvements, including curbing and guttering on street and avenue corners shall be assessed against the lots or.parcels of land abutting on or nearest to said improvements, and the cost of street improvements, including curbing and guttering at the intersection -of any alley with a street, avenue or other highway shall be asses— sed in fair proportion against the respective lots or parcels of land abutting or cornering on the alley at such inter— section. (b) That no assessment shall exceed the cost of the improve— ments or the increased value of such property by reason of the special benefits derived from such improvements. SECTION 5: That the City Council shall meet on the 23rd day of May, 1977 at 7:00 P.M., at the City Hall in the City of Fairhope, Alabama, to hear any objections, remonstrances or protests that may be made against said improvements, the manner of making the character of materials to be used. SECTION 6: This Ordinance shall be published once a week for two (2) consecutive weeks in the Fairhope Courier, a newspaper published and of general circulation in the City of Fairhope, Alabama, the date of the first publication to be not less than two (2) weeks before the 23rd day of May, 1977. SECTION 7: A copy of this Ordinance shall be sent by Regis— tered Mail, Postage prepaid, to the persons last assessing for City taxation the property which may be assessed for said improvements, at their last known addresses, said noti— ces to be so mailed by the City Clerk not less than ten (10) days prior to the 23rd day of May, 1977. SECTION 8: This ordinance shall become affective, upon its due addoption and publication as required by law. ADOPTED This the 23rd day of May, 1977. Jas. P. Box moved, seconded by Councilman Billy Don Wiggins, to adopt the following Resolution: RESOLUTION BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF FAIRHOPE, ALABAMA, THAT THE POSITION OF ASSISTANT SUPERINTENDENT OF THE GAS DEPARTMENT PAY SCALE BE INCREASED FROM $ 4.11 PER HOUR TO $ 5.50 PER HOUR PAYABLE 1/3 NOW, AND 1/3 IN SIX (6) MONTHS AND THE BALANCE IN ONE (1) YEAR. BE IT FURTHER RESOLVED, THAT THE POSITION OF WELDER BE INCREASED FROM $ 3.78 PER HOUR TO $ 5.00 PER HOUR, PAYABLE 1/3 NOW 1/3 IN SIX (6) MONTHS AND THE BALANCE IN ONE (1) YEAR. Mayor Nix voted aye to break the tie. Motion carried. Councilman Billy'Don Wiggins moved, seconded by Councilman Henry G. Bishop to adopt a Resolution giving the Airport Board the -authority to sign preliminary contracts. Upon being put to vote the following'vote`,was recorded: AYES: Billy Don Wiggins„+Henry G..,,Bishop NAYES: -Sam E. Box, David E. Bishop Mayor Nix voted nay to break the tie. Motion denied. Mr. William Bedard came before -the Mayor and Council regarding various;traffic control devices in the City of Fairhope. Mr. Bedard stated that he felt it was not necessary for,,the City to have red lights at night and fekt,flashirig yellow lights would be better. Mayor Nix asked Phil gutherford, Electric Department Superintendent, to look into the cost of installing heads on the four (4) corners in order to have the lights flash yellow at night. Councilman Sam E. Box moved,to introduce the following Ordinance: ORDINANCE NQO� - AN ORDINANCE TO PROHIBIT ANY FIRM, CORPORATION, OR AGENTS THEREOF FROM USING THE GARBAGE DUMP OF THE CITY OF FAIRHOPE, ALABAMA, TO DISPOSE OF CLEARINGS FROM ANY VACANT LOT, DEMOLITION OF ANY HOUSES, OR OTHER STRUCTURES, AND TO PROHIBIT THE DISCHARGE OF ANY OTHER UNLAWFUL WASTE INTO THE GARBAGE DUMP OF THE CITY OF FAIRHOPE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FAIRHOPE, ALABAMA: SECTION 1- It shall be unlawful for any firm or corporation or any agent thereof, to use the garbage dump of the City, of Fairhope, for the disposal of the clearings of any.vacant lot, including but not limited to trees, limbs, stumps, trash, or other debris, or the dumping of any lumber, brick, stones, mortal or any other debris from the demolition of any house, building, or other structure, or to use the City Dump,for the disposal of any unauthorized disposable trash and garbage, without prior approval of the City. SECTION 2- Any person_ found to be in violation of this Section shall be punished by a fine of not more than $ 200.00 or by imprisonment at hard labor for not more than 6 months, ,or both, such fine and imprisonment at the discretion of the Court. SECTION 3. This Ordinance shall take effect upon its due adoption and publication as required by law. ADOPTED THIS THE _�,? DAY OF 1977.
