COUNTY OF BALDWIN
The City Council'of the City of Fairhope, Alabama met in regular
session on Monday, April 25th, 1977, at the City Administration
Building, 387 Fairhope Avenue, Fairhope, Alabama at 7:00 P.M., with
the following members present: Mayor James P. Nix; Councilmen:
David E. Bishop, Henry G. Bishop, Sam E. Box, Jack A. Stipes, and
Billy Don Wiggins.
The minutes of the April 11th, 1977 meeting were approved with the
following additions:
1. Councilman Henry G. Bishop moved, seconded by Councilman
Jack A. Stipes, to purchase the property adjacent to the
substation on the corner of Twin Beech and Young Street,
two (2) acres ( more or less ), for the price of $ 7,000.00,
from Alma Jordan, subject to a full warranty deed with Title
Insurance, •to be paid for out of the City's land fund. Motion
carried.
2. Councilman Sam E. Box moved, seconded by Councilman Jack A. Stipes,
to authorize the Mayor to send a letter to Ciba-Geigy, stating
that the City will take the new gas no later than September 1, 1977,
at the price of $ 2.17 per cubic foot plus 20.4 ¢ for United Gas
Pipeline and .12¢ to Clark -Mobile for transportation, subject to
approval of the Federal Power Commission and subject to this being
an eight (3) year contract ( March of 1985 ), and transporting
agreement. Motion carried.
Councilman Henry G. Bishop gave a report on the financial condition of
the General Fund for the six month period ending March 31, 1977. This
report shall become a part of these minutes. Councilman Bishop stated
that if the City continued to operate as it has for the first six month
period, that the result would be an approximate $ 50,000.00 deficit in the
General Fund -for the_E-iscel Yepr;1977.,.
Councilman Henry G. Bishop told members of the Council that steps were
being taken to collect taxes on automobile tags which have not been paid
by City Residents. Councilman Billy Don Wiggins requested that the
minutes reflect that the taxes which have not been paid on automobiles
was not a reflection on City Hall.
The Council discussed the gas usage by the Town of Daphne, and the penalty
situation which could result from over usage. Councilman Sam E. Box and
Mayor Nix decided that they would meet with the Utilities Board of the
Town of Daphne, and go over the penalty situation with them.
Councilman Henry G. Bishop recommended to members of the Council that the
Recreation Board take over the payment of the Colony rent on Stimpson
Field in the amount of $ 1,906.50, since they were now able to pay this
due;to the additional revenues the Recreation Board received from the
beer and cigarette tax increase,i.n71975. Councilman Billy D. Wiggins
said that he would refer this matter to the Recreation Board at their
next regular meeting.
Councilman David E. Bishop opened a discussion on the City's delivery
and business licenses, regarding inequities in the monies received from
various businesses. Mayor Nix told members of the Council that the
main reason for the difference was that when the Business License
Schedule was adopted the Council amended it with an option to either
pay three (3) times the amount paid prior to the new license schedule or
base their license on their gross receipts.
Councilman Jack A. Stipes moved, seconded by Councilman Billy D. Wiggins,
for the City to proceed with the drainage project on School Street by
installing approximately 600 feet starting behind the Methodist Church
along Morphy to School Street with a ten (10) foot culvert, and using
City labor , for a cost of up to $ 3,700.00, providing the City can
get the necessary easements from start to finish, with the monies to be
paid out of the City's Gasoline Tax Account. Motion carried.
Mayor James P. Nix ,informed Council members of the resignation received
from Mr. Joe Osterberger on the Recreation Board.
Councilman Billy D. Wiggins moved, seconded by Councilman Jack A. Stipes,
to nominate Mr. Ed Nelson to serve in the place of Mr. Joe Osterberger,
on the Fairhope Recreation Board. Motion carried.
Mr. Ed Nelson was appointed to serve as a member of the Fairhope Park
and Recreation Board until March of 1982.
Councilman Henry G. Bishop nominated Mr. George McKee for re -appointment
to the Fairhope Harbor Board until April of 1979. Councilman Billy D.
Wiggins moved, seconded by Councilman Jack A. Stipes that the nominations
be closed. Motion carried.
Mr. George McKee was re -appointed to serve as a member of the Fairhope
Harbor Board until April of 1979.
Mayor Nix informed Council members of a request from the Baldwin County
Mental Health Center for the City to appoint a member to serve on the
advisory committee.
Councilman Billy Don Wiggins recommended the following two (2) people for
the Council's consideration for appointment to the Mental Health Advisory
Board:
Mrs. Linda Stewart
Mrs. Jean Kutack
Councilman Henry G. Bishop moved, seconded by Councilman Jack A. Stipes,
to nominate Mrs. Jean Kutack to serve on the Advisory Committee of the
Baldwin County Mental Health Board. Motion carried.
Councilman David E. Bishop moved, seconded by Councilman Billy Don Wiggins,
i to allow residents within the police jurisdiction a red sticker for
! admission to the beach only. Upon being put to vote the following vote
was recorded: AYES: David E. Bishop, Henry G. Bishop and Billy Don Wiggins.
NAYES: Sam E. Box and Jack A. Stipes.
Motion carried.
Councilman Sam E. Box moved, seconded by Councilman Henry G. Bishop, for the
City to hire an extra policeman starting May 7, 1977 thru Labor Day, to
work the beach at a salary of $ 3.50 per hour. Motion carried.
Councilman Sam E. Box moved, seconded by Councilman Jack A. Stipes for the
City to hire two (2) Toll -Workers for Friday, Saturday and Sundays from
May 7th, 1977 thru Labor Day at the beach, at $ 2.30 per hour. Motion
carried.
Mayor Nix stated that the City would receive Insurance Proposals for the
City's Casualty Insurance up until the May 9th, 1977 meeting of the Council.
Councilman Sam E. Box moved, seconded by Councilman Henry G. Bishop, to
hire a new man in the Gas Department. Motion carried.
Mayor James P. Nix read a letter from the West Baldwin Water and Fire
Protection Authority regarding a contribution of $ 1,500.00 in order to
purchase the necessary equipment for two (2) trucks enabling them to
combat chemical fires. Councilman Sam E. Box moved, seconded by Councilman
Jack A. Stipes, to accept with appreciation the letter from West Baldwin
Water and Fire Authority for a donation of up to $ 1,500.00 for equipment
for the fire department. Motion carried.
Councilman Jack A. Stipes recommended that the City discontinue the policy
of providing free coffee for City employees, due to the rising cost of
coffee. The matter was held over until the May 9th, 1977 meeting of the
Council.
Councilman Jack A. Stipes requested that the City's policy of not allowing
private or personal work on City property with City equipment be enforced.
Councilman Jack A. Stipes gave members of the Council a copy of a sample
Ordinance on the City's policy on accepting streets. City Attorney John
V. Duck told members of the Council that the City was not bound to accept
streets for maintainence. Mr. Duck said that the City already.had an
existing Ordinance adopted in 1959, and recommended the City writing a
letter to the Fairhope Planning Commission stating that this was the
City's minimum paving specification Ordinance, and that once the Planning
Commission approves a subdivision they must require the subdivider to
pave according to the plans and specifications and his engineer must
bring back a certification before the subdivider will be released from
his performance bond,and make this a provision of the bond. Mr. Duck
further recommended that the City Engineer review the 1959 Ordinance and
see if the specifications still hold today, since the Ordinance may need
to be brought up to todays specifications.
Councilman Jack A. Stipes said that he would like to see the trash pickup
Ordinance enforced..Mr. Stipes said that people were putting pieces of
bicycles, tires, etc. in with their leaves and limbs, and requested that
the City Superintendent check to make sure the trash pickup ,Ordinance is
enforced.
Councilman Billy D. Wiggins moved, seconded by Councilman Jack A. Stipes,
to authorize the City Attorney to draw up an Ordinance on Contractors
hauling trash to the City Landfill. Motion carried.
Councilman Jack A. Stipes brought up the question of the penalty on dog
tax. The City Attorney told members of the Council that the penalty on
violation of the Dog Tax Ordinance was left up to the discretion of the
Judge.
Councilman Henry G. Bishop moved, seconded by Councilman Billy D. Wiggins,
to appoint Councilman Sam E. Box to serve as a member of the Organic
School Board until May of 1978. Motion carried.
Councilman Henry G. Bishop moved to appoint Mrs. Mae Moss Parker to
serve on the Organic School Board until May of 1980, seconded by
Councilman Billy D. Wiggins. Motion carried.
Councilman David E. Bishop moved, seconded by Councilman Jack A. Stipes,
to hear a letter from Alabama Power Company on the rate hearing. Motion
carried.
Mayor Nix said that Alabama Power Company had offered to settle for 50
plus interest which would be $ 12,604.70 plus $ 4,716.58 interest and
stated that it was the recommendation of the Attorney and Engineer that
the City accept this offer from Alabama Power Company. Councilman David E.
Bishop moved, seconded by Councilman Billy D. Wiggins to accept the settlemen,
offer from Alabama Power Company. Motion carried.
Councilman Henry G. Bishop moved, seconded by Councilman Jack A. Stipes to
hear Councilman Billy D. Wiggins on the signal light at Gayfer and Section.
Motion carried.
Councilman Billy D. Wiggins moved, seconded by Councilman Sam E. Box, for
the City to ask for permission from the State Highway Department to install
a red light at Gayfer and Section Street and state that the City will pay
for the installations"of the light. Motion carried.
Councilman,Jack A. Stipes moved, seconded by Councilman Billy D. Wiggins,
to hear' the request of the Jaycees.4'Motion carried.
Dr. Hoyt Childs came before the Mayor and Council on behalf of the
Eastern Shore Jaycees, to request the use of the beach for the fourth
of July celebration. Councilman Jack A. Stipes moved, seconded by
Councilman Henry G. Bishop, to allow the Jaycees the use of the beach
for the fourth of July celebration. Motion carried.
Mr. Gary Sandell came before the Mayor and Council regarding dangerous
bicycle practices in the City of Fairhope. City Attorney John Duck
said that bicycles are governed -'by the same rules as automobiles.
Councilman Henry G. Bishop moved, seconded by Councilman David E. Bishop,
to pay the bills as presented. Motion carried.
Mayor James P. Nix reminded members of the Council that the opening of
bids on the Middle Street Sewer Project would be on May 3,1977, at
2:00 P.M., and also that the Ethics Reports were due by the first of
the month.
Councilman David E. Bishop moved, seconded by Councilman Billy D. Wiggins,
to adopt the following Resolution: Motion carried.
RESOLUTION
WHEREAS, Lynn Adams was appointed City Clerk October 4, 1976, and
WHEREAS, Lynn Adams has served the City faithfully and with honor,
WHEREAS, MAY 9-15 is to be observed nationally as City Clerks week,
NOW, THEREFORE, BE IT RESOLVED, that Lynn Adams be commended for her
dedicated service to the City of Fairhope.
City Engineer Ack Moore told the Mayor and Council that there would have
to be a public hearing on the Street Paving Program at the second meeting
in.May of the City Council and that notice of the public hearing would
have to be advertised in the newspaper for two (2) consecutive weeks.
Councilman Jack A. Stipes moved, seconded by Councilman Billy D. Wiggins,
to advertise for a public hearing on the Street Paving Program for the
second meeting in May of the City Council. Motion carried.

The West Baldwin Water and Fire Protection Authority realizes
the necessity of a well equiped Fire Department and the effort put
forth by the City and its volunteers. At this time, we understand
that the the City is contemplating up -dating two of its trucks with
special equipment which will insure our community better fire
protection. We, as a Water and Fire Protection Authority realize
our responsibility and want to aid you in your goal.
Therefore in the April 12, 1977 meeting our board members moved
to contribute an amount not to exceed $1,500000 in order to purchase
the necessary equipment for two trucks enabling them to combat chemical
fires.
We are glad to take this opportunity to do our part in the
betterment of Fairhope.
