COUNTY OF BALDWIN
The City Council of the City of Fairhope, Alabama met in regular session
on Monday, April 11th, 1977, at 7:30 P.M., at the City Administration
Building, 387 Fairhope Avenue, Fairhope, Alabama, with the following
members present: Mayor James P. Nix; Councilmen: David E. Bishop,
Henry G. Bishop, Sam E. Box, Jack A. Stipes and Billy Don Wiggins.
The minutes of the regular meeting March 28th, 1977 and the special meeting
March 30th, 1977, were approved.
Councilman Billy Don Wiggins moved, seconded by Councilman Jack A. Stipes,
to authorize the City Attorney to assess Lots 7,14,15 & 22 of the Phillip
Stenzel subdivision at the total assessment of Blue Island cost, to be
equally divided, with the attorneys fees to be paid by the property owners.
Motion carried.
Mayor Nix informed members of the Council of the new CETA Program available
whereby the City could obtain CETA workers to perform specific projects.
No action was taken at this time.
Mayor."Nix told.Council members,of a•request from Mrs. Crittenden to install
a pay telephone at the Little League field. The Council recommended that
this matter be turned over to the Recreation Board for their consideration.
Councilman Henry G. Bishop moved, seconded by Councilman Jack A. Stipes,
to purchase the property adjacent to the substation on the corner of
Twin Beech and Young Street, subject to a full warranty deed with title
insurance, to be paid for out of the City's land fund. Motion carried.
Councilman Jack A. Stipes asked if there was an Ordinance against helicopters
landing in Fairhope. Mr. Stipes was told that there was no such ordinance,
and felt that the,pilot would be held liable for any damages from landing
a helicopter.
Councilman Jack A. Stipes told Council members that there were dogs running
in packs living in the gulley behind the City dump, and felt that something
needed to be done to correct the problem.
Councilman Jack A. Stipes discussed the City's policy on unstopping a drain
line on City property. City Superintendent E.J. Kirk said that once a call
is received regarding a stopped up drain the City checks to see if it is on
City property if not than the property owner is responsible for getting a
plumber to unstop the drain. The Council said that they were satisfied with
the present policy.
Councilman Jack A. Stipes said that he would like to see the Ordinance
changed on accepting streets, whereby the contractor would put up a
Performance Bond that once the City accepts the streets the City will be
free from faulty workmanship and material for a period of"five (5) years.
City Attorney John Duck said that he would research the possibility of
drafting such an Ordinance and come up with a proposed sample Ordinance
for the April 25th, 1977 meeting.
Councilman Jack A. Stipes gave a report on the drainage problem on School
and Fels. Councilman Stipes said that he looked over the situation with
City Engineer Ack Moore and stated that he felt the City could use their
crews and work on this project a little at a time as the monies become
available. The Council decided to lay over on this project until all
members of the Council could look over the budget reports and come back with
ways and means to pay for the project.

Councilman Jack A. Stipes gave a report on the drainage situation on the
Kilgore property. Mr. Stipes stated that there was not any way to divert
,the water back towards Section Street and felt the only way to eliminate
this problem was for the City to get an easement across the Kilgore
property in order to drain the underground pipes. Mr. Stipes said that
he felt the City needed to contact Mr. Kilgore about obtaining an easement.
Mayor Nix appointed Mr. Jack A. Stipes and Mr. Billy Don Wiggins to the
Committee to work with Mr. Kilgore about obtaining an easement.
Councilman Jack A. Stipes gave a report on Knoll Park and stated that he
has informed Mr. George McKean that there could only be parallel parking,
and that he had talked with the Colony and that the engineer of the Colony
was looking into the situation to see how far back they can come back on
the drainage situation, and would.report back_.at'a later date.
Councilman Henry G. Bishop moved, seconded by Councilman David E. Bishop
to hear Councilman Billy Don Wiggins regarding the traffic situation on
Gayfer and Section Street. Motion carried.
Councilman Billy Don Wiggins stated that the traffic situation on Gayfer
and Section Street was so dangerous that he wanted every possible means
checked out regarding the installation of a traffic light at Gayfer and
Section Street. Councilman Billy Don Wiggins moved, seconded by Councilman
Jack A. Stipes to adopt a Resolution to present to the State Highway
Department by the Mayor requesting that a signal light be put at Gayfer and
Section Street. Motion carried.
Councilman Jack A. Stipes moved, seconded by Councilman David E. Bishop
to hear Councilman Sam E. Box on the new gas situation. Motion carried.
Councilman Sam E. Box moved, seconded by.Councilman Jack A. Stipes, to
authorize the Mayor to send a letter to CIBA-GEIGY stating that the
City will take the new gas no later than September 1, 1977, subject to
approval of the Federal Power Commission and subject to this being an
eight (8) year contract ( March of 1985 ).and transporting agreement.
Motion carried.
Councilman Sam E. Box moved, seconded by Councilman Jack A. Stipes to hear
the Performance Bond of McLean Realty for paving. Motion carried.
Councilman Sam E. Box moved, seconded by Councilman Jack A. Stipes to
accept the Performance Bond of McLean Realty Corporation in the amount of
$ 18,000.00 in lieu of actual completion of the required subdivision
improvements of Parker Road subdivision. Motion carried.
Councilman Billy Don Wiggins moved, seconded by Councilman Sam E. Box,
to pay the bills for the month as presented. Motion carried.
Councilman Jack A. Stipes moved, seconded by Councilman Sam E. Box to
consider the application of Building Inspector and Draftsman. Motion
carried. i
Councilman Billy Don Wiggins moved, seconded by Councilman Sam E. Box to
hire Forrest Yerby 'as City Building Inspector and Draftsman at a salary
of $ 10,500.00 annually, on -a six (6) month trial basis. Motion carried.
