This being the date set for a public hearing on the rezoning of

Councilman David E. Bishop moved, seconded by Councilman Jack A. Stipes,
to revise the Engineering Agreement between the City of Fairhope and
St. John Engineers, Inc., as follows:
All terms and provisions of the original agreement dated October
23, 1972 remain in effect except that on the special work described
in paragraph # 2 (b) the hourly rate of compensation for the
registered engineers be increased to $ 22.00 per hour, and the auto
mileage rate be increased to 15G per mile in paragraph # 2 (c).
Motion carried.
The application of Mr. William Watson,, Jr. for a beer permit at the
Montrose Tennis Club was presented for the first time and held over
until the March 28, 1977 meeting of the Council. Councilman Billy Don
Wiggins requested that Mr. Watson appear before the Mayor and Council at
the March 28, 1977 meeting.
Councilman Jack A. Stipes gave a report on the equipment needed by the
Street Department. Councilman Stipes stated that the following equipment
was needed:
1. Flat Body Truck (two bodies)
2. 6 Yard Dump
3. Portable Compressor
4. Chipper & Packer
Councilman Stipes stated that cost of the needed equipment would cost
approximately $ 33,000.00.
Councilman Jack A. Stipes moved, seconded by Councilman Sam E. Box, for
the City to go out on bid for the equipment for the street department in
order to determine how much the equipment will cost. Motion carried.
Councilman Jack A. Stipes told the Mayor and Council of a request from
Mr. George McKean regarding the possibility of the City curb and guttering
the west side of Knoll Park on Bayview, and stated that rt . McKean said
he would be willing to pay for half of the cost. Councilman Stipes stated
that Mr. McKean needed an area for the employees to park. Mr. Stipes said
that since this was Colony property he wanted to meet with the Colony and
see if they would pay half of the material and the City do the installation.
Councilman Stipes said that he would report back at the March 28th meeting
and inform the Council of the results of his meeting with the Colony.
Councilman Jack A. Stipes moved to nominate Councilman Billy Don Wiggins
as a member of the Recreation Board to fill the expired term of Ms. David
Stapleton, whose term expires in March, 1977. Councilman David E. Bishop
seconded the nomination.
Councilman Sam E. Box moved the nominations be closed.
Upon being put to vote the following vote was recorded:
AYES: David E. Bishop; Henry G. Bishop, Sam E. Box;
Jack A. Stipes
NAPES: NONE
ABSTAIN: Councilman Billy Don Wiggins
Councilman Billy Don Wiggins was elected to serve as a member of the
Fairhope Recreation Board until March of 1982.
Councilman Sam E. Box moved, seconded by Councilman Jack A. Stipes, to
extend the 6 " water line approximately 1,629 feet down So. 98. Motion
carried.
Councilman Sam E. Box moved, seconded by Councilman David E. Bishop for
the City to go our on a water rate study. Motion carried.
Councilman Henry G. Bishop reported to the Mayor and Council on the progress
to date of the cost of Police and Fire protection outside of the City
k Limits. Mr. Bishop stated that he would present his report at the March
28th, 1977 meeting, at which time he would have the amount of revenues
collected for licenses outside the City limits.
The Street Safety Study as prepared by the State of Alabama for the City
of Fairhope was discussed. No action was taken until all members of the
Council could look over the study, and report their recommendations back
at the March 28, 1977 meeting.
This being the date set for the deadline for property owners to get their
streets under the paving program the following streets were asked to be
included in the program:
1. Wisteria ( between Dogwood and Nichols)
2. Laurel Street
3. South School Street
4. Fig Avenue
5. Third Street
6. Chestnut Street
7. Chestnut Street from Pecan to Fig.
8. Lincoln Street
9. Woodgrove Circle
10. Orchid Drive
Councilman Jack A. Stipes moved, seconded by Councilman Billy Don Wiggins,
to authorize the City Engineer, Ack Moore, to come up with an estimated
cost of paving the streets. Motion carried.
Councilman Sam E. Box moved, seconded by Councilman Billy Don Wiggins to
hear the $ 17,200.00 Performance Bond on Lots 1 thru 12 in the Rack Acres
Subdivision as requested by Mr. Byrd L. Moore. Motion carried.
Councilman Sam E. Box moved, seconded by Councilman Henry G. Bishop, for
the City to accept the Performance Bond in the amount of $ 17,200.00 for
Pack Acres Lots 1 thru 12, on Eastern Shore Builders, in lieu of actual
completion of improvements and utilities in the subdivision, providing
the drainage would not drain on,adjacent property owners lots. Motion
carried.
The Mayor and Council discussed the amendment to the sanitation Contract
with Mr. Eugene Bosby. The Mayor told Council members that in addition to
the $ 5,500.00 monthly fee currently being paid for Sanitation, Mr. Bosby
was requesting that he receive $ 2.06 on all new customers.
Councilman Henry G. Bishop moved, seconded by Councilman Sam E. Box, to
authorize the Mayor to sign the addendum to the Sanitation Contract with
Mr. Bosby to pay for new customers. Upon being put to vote, the following
vote was recorded:
AYES: Henry G. Bishop,,Sam E. Box, Jack A. Stipes and
Billy Don Wiggins.
NAYES: David E. Bishop
Motion carried.
Councilman Billy Don Wiggins moved, seconded by Councilman Jack A. Stipes
to adopt the following Resolution. Motion carried.
RESOLUTION
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF FAIRHOPE, MAMA
that the following rules be adopted at the Beach starting May 7,1977

and going through Labor Day weekend:
1. Each vehicle not bearing a City of Fairhope decal be
charged $ 1.00 plus . 25(,� for all passengers over
four (4) .
2. That the Fairhope Single Tax Corporation be allowed to
issue a special decal to their lesees within the
Police Jurisdiction. ,
3. The residents within the Police Jurisdiction may
purchase a decal for thirty-five dollars ( $35.00 )
each, per year.
4. Funds collected shall be used for maintainence and
equipping Beach Area and Park.
5. No buses (or,trucks shall be allowed on the Beach area.
6. That a booth be set up near the Rest -rooms on the
north beach area to collect admissions and issue tickets
for the south beach area, and this booth be manned
from 8:30 A.M., until 7:00 P.M., on Fridays, Saturdays,
Sundays, and Holidays.

Councilman Sam E. Box moved, seconded by Councilman Henry G. Bishop, to
amend Fairhope's Housing Assistance Plan to allow Section 8, Elderly
Housing Assistance. Motion carried.
City Engineer, Ack Moore reported to the Mayor and Council on the
Landfill plans. Mr. Moore stated that he would have to make the study
on a daily basis in order to determine which rules and regulations
the City would have to comply with according to State laws.
Councilman Henry G. Bishop moved, seconded by Councilman Billy Don
Wiggins, to authorize City Engineer, Ack Moore, to proceed with
the the survey of the landfill at the earliest possible moment. Motion
carried.

Councilman David Bishop moved, seconded by Councilman Billy Don Wiggins,
to authorize the City Attorney to proceed with collection on deliquent
street assessments. lotion carried.
Councilman Jack A. Stipes moved, seconded by Councilman David E. Bishop,
for the City to make an offer to Mannich Realty for the Alma -Jordan
property located on Young Street adjoining the City's electrical substation,
of $ 3,000.00 for the back parcel of acreage and $ 7,000.00 for the
total acreage. Motion carried.
Councilman Jack Stipes asked that the Kilgore drainage situation be layed
over until Mr. Kilgore, who has been.out.of town can meet with Councilman
Stipes.
The Merit System for City Employees was held over until each member of
the Council was provided with a copy of the contract for review.
This being the date set for the opening of bids on Gasoline, no bids
were received.
Councilman Sam E. Box moved, seconded by Councilman Jack A. Stipes, for the
City to create the position of City Planner -Building Inspector, at a
salary range from $ 10,500.00 to $ 12,000.00 annually, and for the City
to go out and try to hire an employee to fill this position. Motion
carried.
Councilman Sam E. Box moved, seconded by Councilman Jack A. Stipes, to
introduce the following Resolution. Motion carried.
RESOLUTION
BE IT RESOLVED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF FAIRHOPE,
AIABAMA, that the City discontinue the policy of City Crews installing
water lines in new subdivisions.

Councilman Henry G. Bishop moved, seconded by Councilman Jack A. Stipes,
that the bills for the month be approved as presented for payment with
the exception of the request of Berglin Realty for a refund on eleven
months of Business License in the amount of $ 91.67. Motion carried.

Mr. Herman Hilliard of Risk Management Services of Alabama, Inc., came
before the Mayor and Council and explained the benefits to be given the
City of Fairhope by coming under the Municipal Workman's Compensation
Program.
Councilman Henry G: Bishop moved to introduce and finally adopt the
following Resolution, seconded by Councilman Sam E. Box. Motion carried.
RESOLUTION
WHEREAS, the City of Fairhope is now required to provide workman
compensation to its employees injuried in the line and scope of their
duties, and may obtain insurance to protect such employees or may become
a self insuror; and
WHEREAS, Municipal Workmans Compensation Management Company, Inc.,
whose Board of Directors are all municipal officials, has been organized
to establish a program to handle claims and services and workman
compensation claims of Alabama municipalities and to provide management
therefor; and
WHEREAS, Municipal Workmen Compensation Management Company, Inc.
has contracted with a service organization to provide claim services,
safety instruction, and other services in connection with the handling
and disposition of Workman's Compensation claims; and
WHEREAS, it is desirable for the City of Fairhope to agree with
Municipal Workmens Compensation Management Company, Inc., to handle and
service its workmen compensation claims; and
WHEREAS, the said Municipal Workmen Compensation Management Company,
Inc., has agreed to provide such services and protection at 85 % of the
normal premium rate charged by private insurance companies and has
further agreed to use any surplus earned by said corporation to benefit
its members;and, Now, Therefore,
BE IT RESOLVED, that the City of Fairhope make application to and agree
with Municipal Workmen Compensation Management Company, Inc. for said
company to service and handle all of the workmen compensation claims
of its employees; and
BE IT FURTHER RESOLVED that the Mayor be authorized to execute a
contract with the said management company and that he be authorized to
expend funds of the City for payment of such services and that the
City Clerk be authorized to attest said agreement.

following Resolution, seconded by Councilman Sane E. Box. Motion
carried.
RESOLUTION
BE IT RESOLVED by the City Council of Fairhope as follows:
(1) That the City of Fairhope commencing on the 25th
day of April, 1977, shall self insure its workmen's
compensation obligations which are imposed on the
City of Fairhope by, the Workmen's Compensation Law
Of Alabama.. "
(2) That Mayor James P. Nix is hereby authorized and
directed to make application with the Workmen's
Compensation Division of the Industrial Relations
Division of the State of Alabama for the City of
Fairhope to be registered and declared as a
self insurer of its workmen's compensation
obligation under said law and further that the
Mayor be and is -hereby authorized to sign the
necessary application and documents for this
purpose with the said division.
ADOPTED BY THE CITY COUNCIL OF THE CITY OF FAIRHOPE, ON THIS
THE 14TH DAY OF MARCH, 1977.

He: Revisions to Engineering Agreement
Dear Sir:
This letter is intended to effect a revision
in the consulting engineering agreement dated October 23, 1972
covering the services rendered by St.John Engineers and
their compensation. Since the terms of this agreement are
currently in effect (the contract never having been cancelled)
this letter is to evidence that fact, particularly because
of the electrical system additions proposed to be made this
year.
It is proposed that all the terms and provisions
of.the original agreement remain in effect except that on the
special work described in par. #2 (b) the hourly rate of
compensation for the registered engineers be increased to
$22.00 per hour, and the auto mileage rate be increased to
15 cents per mile in par.# 2 (c).
This revision in compensation rates will not
apply to engineering on the additions now contemplated at
the Young and Nichols substation, since such is covered by
the provisions of par.# 2 (a).
The adjustments requested are in line with our
agreements with other cities.
