COUNTY OF BALDWIN.
The City Council of the City of Fairhope, Alabama met in
regular session on Monday, February 28, 1977, at 7:00 P.M.,
at the City Administration Building, 387 Fairhope Avenue,
Fairhope, Alabama with the following members present:
Mayor James P. Nix; Councilmen: David E. Bishop, Henry G.
Bishop, Sam E. Box, Jack A. Stipes and Billy Don Wiggins.
The minutes of the February 14, 1977 meeting were approved with
the following addition:
Councilman Jack A. Stipes questioned the City of Fairhope's
policies on the following:
1. Reimbursing City employees on a monthly basis for
auto expenses.
2. The City's policy on paying for long distance charges
and alcoholic beverages for city employees when they
go out of town for schooling or conventions.
3. Advances made to City employees on their salaries;
payment of fines and costs and bank notes by payroll
deductions.
Ms. Ruth DeWitt of the South Alabama Regional Planning Commis-
sion came before the Mayor and Council regarding the 208
Workshop, and urged City officials to attend the next 208
Workshop to be held March 24, 1977, at 9:00 A.M., in room 3
of the Mobile Municipal Auditorium.
Councilman Sam E. Box moved, seconded by Councilman Jack A.
Stipes, to follow the rules of procedure as adopted by the
City Council at the October 4th, 1976 meeting. Motion
carried.
Councilman Jack A. Stipes told the Mayor and Council members of
the request of the Harbor Board for the City to pave the road
next to the gas pumps , and also repairing the docks where the
wall has cracked and fallen into the creek, at Fly Creek.
Councilman Stipes stated that errosion was preventing the boats'
from getting up to the gas pumps.
Councilman Jack A. Stipes moved, seconded by Councilman Billy
Don Wiggins that the City repair the dock area where the cement
wall has cracked and fallen into the creek, and also that the
City pave the access road to the side of the gas pumps at Fly
Creek at a cost not to exceed the amount of $ 2,000.00.
Motion carried.
Councilman Jack A. Stipes presented a petition, which shall
become a part of these minutes, from residents of Fairhope,
requesting that the City of Fairhope acquire some kind of
Civic Center with an auditorium that would be suitable for
various organizations to use. Councilman Jack A. Stipes
recommended that the City set up a committee to study the
feasibility of havings a Civic Center, if there is a need,
how much the cost will be, and the best location.
Mayor James P. Nix appointed the following members to serve
on the Committee to study the need for a Civic Center in
Fairhope, by meeting with various civic clubs, etc., :
Councilman David E. Bishop
Councilman Jack A. Stipes
Councilman Billy Don Wiggins
Councilman Billy Don Wiggins moved, seconded by Councilman Sam
E. Box, that the bill in* the amount of $ 4,573.20, for a chain
link fence around the track be approved for payment out of the
Recreation Capital Improvement Account, and that any future
expenditures out of the Recreation Capital Improvement Fund
be approved by the City Council. Motion carried.
Councilman Sam E. Box moved, seconded by Councilman David E.
Bishop for final adoption of Ordinance No. 584, an Ordinance
amending Zoning Ordinance No. 557, by rezoning Dr. Diegman's
property to B-4. Motion carried.
Councilman Sam E. Box moved, seconded by Councilman Henry G.
Bishop to advertise for a public hearing on the rezoning of
Byrd Moore's property, proposed Rosa Acres Unit II, from R-1
Single Family Low Density Residential District to R-3 Limited
Multi- Family Residential District. Motion carried.
Mayor James P. Nix reported on the progress being made by the
City in securing a new source of gas. Mayor Nix stated that
the City would have to reach a decision by the 15th of April,
1977, as to whether or not the City desired to enter into a
contract for the purchase of additional gas. Mayor Nix said
that he felt the securing of additional gas would be mean a
tremendous potential for new industry for those areas being
served by our gas lines .
Councilman Jack A. Stipes moved, seconded by Councilman David E.
Bishop, for the City to put in a flume at the Art Center at a
cost of $ 180.00, in order to help out with the drainage situa-
tion. Motion carried.
Mayor Nix told members of the Council that the City could not
move over to the school's property until the City has the survey
plans developed from a registered engineer.
Councilman Henry G. Bishop moved, seconded by Councilman David
E. Bishop, to set the amount of mileage costs to be reimbursed
to City employees and officials for use of their vehicles on
City business at .15� per mile. Motion carried.
Councilman Sam E. Box,moved, seconded by Councilman Billy Don
Wiggins, to continue the policy of advancements on the employees
salaries on the basis of an emergency. Motion carried.
Councilman Sam E. Box moved, seconded by Councilman Henry G.
Bishop to continue the City's policy on Payroll Deductions.
Upon being put to vote the following vote was recorded:
AYES: Sam E. Box and Henry•G. Bishop. NAYES: David E. Bishop,
Jack A. Stipes and Billy Don Wiggins. Motion defeated.
Councilman Jack A. Stipes moved, seconded by Councilman
Billy Don Wiggins, to continue with the payroll deductions
except for deductions for banks and finance companys, after
existing obligations with the banks and finance companys are
met. Motion carried.
Councilman Sam E. Box moved, seconded by Councilman Billy Don
Wiggins, to advertise for bids on gasoline and for a new ethel
gas tank. Motion carried.
Councilman Jack A. Stipes moved, seconded by Councilman Billy
Don Wiggins, to allow the Chamber of Commerce to paint temporar
footprints on the sidewalks for the Arts and Crafts Festival.
Motion carried.
Councilman Henry G. Bishop moved, seconded by Councilman Billy
Don Wiggins, to rent two (2) portable toilets for Arts and
Crafts week. Motion carried.
Mayor James P. Nix went over with the members of the Council
the results of a recent Street Safety Study, prepared by
the Traffic Planning and Associates of Atlanta Georgia, and
funded entirely by the State of Alabama. The Council decided
to have City Superintendent E.J. Kirk look over the recommenda-
tions and report back at the March 14, 1977, meeting of the
City Council.
The Mayor and Council members discussed the dog problem in the
City. The Council decided to make'an appeal to the public for
their help in controlling the dog problem in the City by lettin
it be known that the City will enforce the existing dog laws
up to a point where the citizen will call up and be willing to
file a complaint in order --to help the City enforce the Dog
Ordinance.
Councilman Jack A. Stipes reported on Mrs. Sally Maloney's
problem of errosion on Tensaw Street. Councilman Stipes recom=.
mended that the City put a catch basin into these places and
putting the,pipe on the ground from the bottom of the catch basin
and fill in the gulleys with tree stumps,bricks, roots, limbs,
etc., and try to retake the land. Mr. Stipes cited -the --.area
behind the Beasley's Resthome as an example.
Councilman Jack Stipes reported on the drainage problem on the
property of Mr. J. Russell Kilgore. Mr. Stipes stated that he
wanted to meet with Mr. Kilgore and see what they can work out
to correct the problem and report back at a later date.
Councilman David E. Bishop presented a letter from Engineer
H.S. St. John, which shall become a part of these minutes, re-
garding the Transformer Bids taken February 14, 1977, and Mr.
St. John's recommendations.
Councilman David E. Bishop moved, seconded by Councilman Jack
A. Stipes, that the City accept Mr. St. John's recommendations
on the Kuhlman Transformer thru Hatfield and Company because
of a low firm bid and low losses. Motion carried.
Councilman David E. Bishop moved, seconded by Councilman Billy
Don Wiggins to accept the bid of Allis-Chalmers thru Trio
Electric Company for the regulators. Motion carried.
Councilman Jack A. Stipes moved, seconded by Councilman David
E. Bishop, for the City to accept the bid of Westinghouse thru
Moore Handley for current transformer switches. Motion carried
Councilman David E. Bishop moved, seconded by Council Billy
Don Wiggins to accept the bid of Chas. W. Ashby & Co. for
fuses. Motion carried.

He: Analysis of Transformer Bids Taken 2, 14/77
Dear Sir:
A determination has been made as to what
vendor and manufacturer offers the City of Fairhope the most
desirable transformer to place on order from among the nine
bids received on February 14th. Eight manufacturers were
Involved since two vendors wuoted on the same make.
Since the City is now paying the Power Co.
at least two cents for all energy purchased ( and this will
continue to escalate;) the cost of losses must be considered
and a twenty year period was used for comparison. We do not
think a thirty year period would have changed the result.
Since the City must finance electric system additions prin-
cipally from borrowed money, most of which is tax free, we
factored into consideration the difference in the cost of
each make over a period of twenty years using 6% interest
compounded.
Out of the nine bids received three were
priced firm with no escalation. The others had a variety of
escalation clauses and we computed what we considered a
conservative amount to add to the initial price to arrive at
the price on date of delivery. Naturally, a vendor quoting
a low firm price had a financial advantage that other makes
found it hard to overcome. Some that had a low price had,
relatively high losses and lost out for this reason. Due to
the ever increasing cost of power the efficiency of any
electrical apparatus should play an important role in the future.
A tabulation is attached showing a comparison
of most of the essential features and costs. This shows clearly
that Kuhlman offers you in this case the best buy.. We recommend
that you place an order with them immediately predicated on the
data and information submitted by them. We are also attaching
copies of our work sheets showing in detail how we arrived at
each figure we used in comparing costs. The compound interest

and annuity multipliers were taken from standard mathematical
tables published in 1959 by the Chemical Rubber Publishing Co.
If Kuhlman meets their shipment promise,
delivery can be expected about the middle of July. It is
desirable to place this new unit in service prior to August
in order to insure the reliability of your service.
Drafts of purchase orders for the transformer
and the other equipment related to this job are attached also.

We have had many calls and visits by manufacturers
representatives relative to our bid analysis. After you
have taken action on our recommendations we solocit your
permission to make the data on the comparison available
to them.
Mayor James P. Nix appointed Mr. Henry G. Bishop, Chairman
of the Finance Committee, to look into the costs of providing
Police and Fire protection outside of the City Limits, in
order to justify the charging of business licenses in those
areas, and report back to the Council.
Councilman Jack A. Stipes moved, seconded by Councilman
Billy Don Wiggins, to approve the final step raise for
Gas Superintendent Gene Fuqua, which will put him in line
with the other department heads. Motion carried.
This being the date set for the opening of bids on the Gas
Tele-metering system, the following bid was received:
Instrument Control Service, Inc. $ 31,445.00
Councilman Sam E. Box moved, seconded by Councilman David E.
Bishop, to reject the bid and ask for bids to be offered at
the March 14, 1977 meeting of the Council. Motion carried.
Mr. W.R. McPherson came before the Council and requested that
his application for a beer and liquor license be heard.
Councilman Henry G. Bishop moved, seconded by Councilman
Jack A. Stipes, to hear Mr. McPherson. Motion carried.
Mr. McPherson told the Mayor and Council that he planned to
open a seafood restaurant comparable to the Red Lobster Rest-
aurants, and that he had no intention of operating a Disco,
and only wanted the beer and liquor license to serve these
beverages with the meals.
Councilman Henry G. Bishop moved, seconded by Councilman
Billy Don Wiggins, to approve the application of Mr. W.R.
McPherson for a beer and liquor license. Motion carried.
Councilman Jack Stipes told the Mayor and Council of the
request of Mr. George McKee, to stripe parking lines behind
the Klumpp building on the side of Bayview. No action was
taken.
There being no further business, on a motion duly made,
seconded and carried. the meeting adjourned.
