COUNTY OF BALDWIN
The City Council of the,City of Fairhope, Alabama met in
regular session on Monday, February 14, 1977, at 7:00 P.M
at the City Administration Building, 387 Fairhope Avenue,
Fairhope, Alabama, with the following members present:
Mayor James P. Nix; Councilmen; David E. Bishop, Henry G.
ishop, Sam E. Box, Jack A. Stipes and Billy D. Wiggins.
The minutes of the January 24, 1977 meeting were approved
as recorded.
Councilman Henry G. Bishop moved, seconded by Councilman
Jack A. Stipes, to approve the application of Mr. Eugene
Bosby for a beer permit at the Young Street Service Station.
Motion carried.
Councilman Sam E. Box moved, seconded by Councilman Henry G.
Bishop to hire a man for the Gas Department and set his
salary at $ 3.00 per hour with a .25¢ raise to be given after
three (3) months of service. Motion carried.
Councilman Jack A. Stipes moved, seconded by Councilman Billy
D. Wiggins, to lay over on the application of W.R. McPherson
for a beer permit until Mr. McPherson can appear before
the Mayor and Council. Motion carried.
Councilman Jack A. Stipes moved, seconded by Councilman
Billy D. Wiggins, for final adoption of Ordinance # 583,
an Ordinance establishing policy on accrued sick leave for
City Employees. Motion carried.
Mayor James P. Nix told the Council of the request of the
Fairhope Art Center for the City to provide a concrete spill-
way under Bancroft Street at the culvert in order to spread
out the water which is causing a tremendous wash out, also,
the Art Center has requested that the City reroute the storm
sewer on Bancroft Street and continue the culvert 220 feet
to the bottom of the gulley. The total approximate cost is
$ 1,944.40. Councilman Jack Stipes was asked to look into the
situation and report back to the Mayor and Council.
The drainage situation on Northrup Street was discussed. No
action was taken at this time.

Councilman Henry G. Bishop moved,, seconded by Councilman
David E. Bishop, for final adoption of the following Resolution
declaring the City of Fairhope a Bird Sanctuary. Motion
carried.
RESOLUTION
Be it ordained by the Mayor and Council of the City of
Fairhope in Council Assembled:

That the entire area embraced within the corporate
limits of the City of Fairhope be and same is hereby
designated as a "Bird Sanctuary.
That is shall be unlawful to trap, hunt, shoot or
attempt to shoot or molest in any manner any bird, wild
fowl or to rob bird nests or,wild fowl nests. Provided,
however, if starlings or similar birds are found to be
congregating in such numbers in a particular locality
that they constitute a nuisance or a menace to health or
property in the opinion of the proper health authorities
of the CITY OF FAIRHOPE then insuch event said health
authorities shall meet with representatives of the
Audubon Society, Bird Club, Garden Club, or Humane Society,
or as many of the said clubs as are found to exist in the
City of Fairhope after having given at least three (3)
days actual notice of the time and place of said meeting
to the representatives of the said clubs.
If as a result of said meeting no staisfactory alter-
native is found to abate such nuisance, then said birds may
be destroyed in such numbers and in such manner as is deem-
ed advisable by said health authorities under the super-
vision of the Chief of Police of the City of Fairhope.
Anyone violating the provisions of this Ordinance
shall be punishable by a fine of not more than $ 100.00 or
imprisonment not exceeding thirty (30) days.
This Ordinance shall take effect immediately upon its
Adoption.
ADOPTED AND RATIFIED ON THIS THE DAY OF 111977.

Judge Phyllis Nesbit came before the Mayor and Council and
thanked them for the use of the Fairhope Civic Center and for
the signs which had been made for the Baldwin County Court
System.
Councilman Sam E. Box moved, seconded by Councilman Billy Don
Wiggins, to advertise for bids on the sewer project on
Middle Street. Motion carried.
Councilman Jack A. Stipes moved, seconded by Councilman David
E. Bishop, for the City to authorize City Engineer Ack Moore,
to be the engineer on the new Street Assessment Program.
Motion carried.
Councilman Billy Don Wiggins moved, seconded by Councilman
Jack A. Stipes, for the City to advertise a cut off date of
March 14, 1977, for all people who would like to come'under
the street assessment program, with all petitions to be in by
that date. Motion carried.'
Councilman David E. Bishop moved, seconded by Councilman Billy
Don Wiggins, for the City to draw up a contract with the
Fairhope Ambulance Service, appropriating $ 3,000.00, payable
in monthly installments from February 1, 1977 thru January 31,
1978, to be used for indigent care. Motion carried.
The dog problem in the City of Fairhope was discussed. It was
decided to have each Councilman look over a copy of the Dog
Ordinance and report their recommendations back at the February
28, 1977 meeting of the Council.
This being the date set for the opening of bids on a new
Police car the following bids were received:
Bill Steber Chevrolet-- Without -Trade 5,994.50
With two Trades 5,294.50
Gaston Motor Company -- Without Trade 5,653.00
With two Trades 4,303.00
Councilman Henry G. Bishop moved, seconded by Councilman
David E. Bishop to accept the low bid providing it meets
specifications. Motion carried.
Mr. H.S. St. John of St. John Engineers, came before the Mayor
and Council. Mr. St. John led an open discussion on the fuel
adjustment charges on City bills as passed along by Alabama
Power Company. Mr. St. John stated that the power which the
City purchased from Southeastern Power Administration, (SEPA),
was allocated for non-profit usage and to help with the losses
of the City. Mr. St. John said that the time was coming when
the amount of power purchased ,from SEPA would not be enough to
cover the losses of the City, which are presently running from
six (6) to seven (7) percent.
Mr. St. John read the Engineer's statement regarding substation
transformer bids, before the opening of the bids received and
this statement shall become a part of these minutes.

Engineers' Statement Regarding Substation Transformer Bids
All suppliers of substation transformers invited to bid were asked to
furnish certain data with their bids. Included in this data are "load" and
"no load" losses, expressed in watts (@ 100•0 voltage and OA base rating).
In determining the low bidder, the above losses will be evaluated at a unit
energy cost of 2.0 cents per kilowatt-hour over a period of 20 yeaxs.
The delivered prices bid will be appropriately adjusted.for such
escalation as may be included in the quotation so as to approximate actual
price at time of shipment. Any exceptions to the Engineers' specifications
or the mode of shipment may result in a bid being disqualified; or, in the
alternative at the Engineers' election, the exceptions will be factored into
the quoted price in order to obtain a price comparable to the other bids.
The Engineer will base his recommendations to the City—apon-the fore-
going factors,'plus any other considerations which may have an important
bearing on price, product, or delivery, in determining the successful.

Councilman David E. Bishop moved, seconded by Councilman
Henry G. Bishop, to entertain Mr. H.S. St. John's recommenda-
tions and accept the low bid providing it meets specifications.
Motion Carried.
Councilman Henry G. Bishop moved, seconded by Councilman
Jack A. Stipes, to adopt the following Resolution:
RESOLUTION
WHEREAS, Weather Conditions prevailing within the
area serviced by the City of Fairhope's
Electric and Gas Systems for the month of
January and first ten (10) days of February
were abnormal with extremely low temperatures,
causing utility bills to be extremely high,
and
WHEREAS, Many of the consumers affected will have
difficulty in paying their bills within
the period allotted before imposition of
the usual five -percent (50) penalty for,
late payment, `
NOW THEREFORE BE IT RESOLVED, that payment of five -
percent (5%) for late payment be dropped
on all utility bills pertinent to this
period of time that are paid on or before
March 10, 1977.

Councilman Henry G.- Bishop moved, seconded by Councilman
Billy Don Wiggins, that the,bills be approved for payment
as presented. Motion carried.
Councilman Jack A.'Stipes was asked to look into the drain-
age situation on Tensaw Street at the gulley as requested
by Mrs. Sally Maloney, and report back at the next meeting
of the Council.with his recommendations.
