COUNTY OF BALDWIN
The City Council of the City of Fairhope, Alabama met in
regular session at the City Administration Building, 387 Fair -
hope Avenue, Monday, November 10, 1975 at 7:00 P.M. with the
following members present. Mayor James P. Nix, Councilmen:
David E. Bishop, H. G. Bishop, Sam E. Box and Barney L. Shull.
Councilman 011ie E. Deese absent.
Minutes of the previous regular meeting were approved.
Councilman Barney Shull moved for final adoption of Ord=
inance No. 558, AN ORDINANCE TO AMEND SECTION 3-17 OF THE CODE
OF ORDINANCES OF THE CITY OF FAIRHOPE, ALABAMA TO RAISE THE TAX
THEREIN FROM TWO AND ONE/HALF CENTS TO FOUR CENTS, motion seconded
by Councilman Sam Box.. The Mayor opened the meeting for dis-
cussion. A prepared statement of retail merchants of the City was
presented by Henry Crawford. Several petitions protesting the
additional tax were presented to the Council. After a general
discussion the Mayor called for a vote of the Council on adoption
of the Ordinance with the following results: Voting For: Council-
men David E. Bishop, H. G. Bishop, Sam E. Box and Barney L. Shull.
Voting Against: None. Councilman 011ie E. Deese being absent.
This additional tax is to be deposited in a "RECREATION CAPITAL
I"TPROVEMENT FUND".
Councilman Barney Shull moved for final adoption of
Ordinance No.559, AN ORDINANCE TO AMEND SECTION 20-22 OF THE CODE
OF ORDINANCES OF THE CITY OF FAIRHOPE, ALABAMA BY INCREASING THE
CIGARETTE TAX, with the additional tax being designated for funding
beach park and Recreation projects as would be acceptable to the
City Council upon recommendation of the Recreation Boar.i and
deposited in "RECREATION CAPITAL IMPROVEMENT FUND". "-lotion carried
unanimously.
Motion by Councilman Sam Box seconded by Councilman Barney
Shull that Ordinance No. 560, AN ORDINANCE DETERMINING ALL OBJECT_
IONS AND DEFENSES TO ASSESSMENTS FOR THE COST OF IMPROVEMENTS
PROVIDED BY IMPROVEMENT ORDINANCE NO. 543 AND ASSESSING THE COST
OF SAID IMPROVEMENTS UPON THE PROPERTY SPECIALLY BENEFITTED
THEREBY, introduced at the regular meeting of October 27, 1975
be adopted as introduced. Motion carried unanimously.
Motion by Councilman Barney Shull seconded by Councilman
David Bishop that ORDINANCE NO. 561, AN ORDINANCE AMENDING ZONING
ORDINANCE NO. 557 BY REZONING THE NORTH TIER OF LOTS ON THE SOUTH
SIDE OF MORPHY AVENUE BETWEEN SUMMIT STREET AND CHURCH STREET
FROM B-2 to B-1, be adopted as introduced. Motion carried unani-
mously.
Motion by Councilman H. G. Bishop seconded by Councilman
Barney Shull that ORDINANCE NO. 562, AN ORDINANCE ATTENDING ZONING
ORDINANCE NO. 557, by REZONING LOTS 17, 18, 19 and 20, IN BLOCK
15 VOLANTA, FROM R-2 to B-4, be adopted as introduced. Motion
carried unanimously.
Motion by Councilman H. s. Bishop seconded by Councilman
Sam Box that bills be approved as presented. Motion carried.
The Medical Clinic Board of the City of Fairhope,
Alabama, requested the Council to appoint two new members to
the Board to fill unexpired terms of two members who have
moved outside the City Limits. Councilman H. G. Bishop nominated
Mrs. Robert Smyer to fill unexpired term of Dr. Robert McKee
whose term expires in 1981. Councilman Barney Shull nominated
Mr. Michael Ford to fill unexpired term of Mr. Leslie Allen whose
term expires in 1977. Motion by Councilman H. G. Bishop seconded
by Councilman Sam Box that the nominations be closed. Motion
carried.
This being date set for opening bids on new car for the
City Superintendent the following bids were received:
Gaston Motor Co., Inc.
1976 Ford Torino $4,473.00
Steber Chevrolet, Inc.
1976 Malibu $4,245.00
Motion by Councilman H. G. Bishop seconded by Councilman David E.
Bishop that low bid be accepted subject to proper evaluation.
Motion carried.
This being date set for opening bids on Gasoline for City
equipment the following bids were received:
Gulf Oil Company
Unable to bid at this time.
Mothershed Oil Company
.4035 current price subject to change as Shell Oil
prices change.
Exxon, current Distributor, will furnish at current
price of .39400.
Motion by Councilman David E. Bishop seconded by Councilman Barney
Shull that bids be taken under advisement for next meeting of
the Council. Motion carried.
Motion by Councilman Barney Shull seconded by Councilman David E.
Bishop that City advertise for Public Hearing on rezoning property
known as Kilgore property. Motion carried.
In order to determine if the population of the City is over
6,000 so that the Police Jurisdiction can be extended three (3)
miles instead of one and one half (12) miles, Councilman H. G.
Bishop introduced the following Ordinance:
ORDINANCE NO. 563
AN ORDINANCE TO PROVIDE FOR A CENSUS TO BE TAKEN OF
THE INHABITANTS RESIDING WITHIN THE CORPORATE LIMITS
OF THE CITY OF'FAIRHOPE, ALABAMA, APPOINTING
ENUMERATORS THEREFOR AND CERTIFYING THE RESULTS OF
THE CENSUS TO THE SECRETARY OF STATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FAIRHOPE,
ALABAMA:
SECTION 1 - There is hereby established an Ordinance to
require a census to be taken of the inhabitants residing in the
corporate limits of the City of Fairhope, Alabama.
SECTION 2 - The Mayor shall appoint the enumerators to take
the said census who sh-11 be responsible citizens, and the said
appointments by the Mayor shall be confirmed by the Council.
SECTION 3 - The enumerators so appointed and confirmed by
the Council shall take such census block by block, and shall
state, as far as practical, the names, ages, sex, and color of
each person residing within the corporate limits of such of the
City of Fairhope.
SECTION 4 - The enumerators shall, before entering upon their
duties, take and subscribe the following oath:
"I, solemnly swear that I will honestly and conscientiously
enumerate the inhabitants living within the City or portion
thereof allotted to me for enumeration."
SECTION 5 - Such enumeration shall be alphabetically
arranged and returned to the Mayor, together with the original
books of enumeration.
SECTION 6 - The Mayor shall thereupon certify to the Sec-
retary of State results of such census, giving the total number
of each race residing within the corporate limits of the mun-
icipality, and the results so certified by the Mayor under the
seal of the municipality, attested by the Clerk, shall be the
Official Census of such City until the next Federal census or
until a new enumeration shall have been taken.
This Ordinance shall take effect upon its due adoption and
publication as required by law.
