HomeMy WebLinkAbout08-25-1975 Regular MeetingSTATE OF ALABAMA COUNTY OF BALDWIN The City Council of the City of Fairhope met in regular session at the City Administration Building, 387 Fairhope Ave., Monday, August 25, 1975 at 7:00 P.M. with the following members presents Mayor James P. Nix, Councilmen t David E. Bishop, H. G. Bishop, Sam E. Box, 011ie E- Deese and Barney L. Shull. Minutes of the previous regular meeting were approved. Motion by Councilman David Bishop seconded by Councilman Barney Shall that Mayor Nix be authorized to change parking on the. East side of Summit Street from Fairhope Avenue to St. James to parallel parking. Motion carried. G. Bishop that City accept low bid on pipe provided it meets specifications and subject to approval of West Baldwin Water Board. Motion carried. r. r i 1% A , c , , Motion- by Councilman, H. G. Bishop ,seconded by Councilman Barney Shull that the City advertise for sale, under Quit -Claim Deed, Lot 14 of Block-17 of Volanta Subdivision as per plat recorded in, MiscellaneousiBook 1, 'Page 341 of the Probate Records of Baldwin -Bounty,- Alabama. Motion carried. A This being'date set .for public hearing on drainage on Northrup St., Fels and School Street, Councilman H. G. Bishop moved, seconded by Councilman Sam Box, that the City drop the procedure since the City is iith on list to receive grant from Community Development Block Grant SMSA Discretionary Balance Funds for funding this program and all preliminary work would be paid from City funds. Motion carried. Mr. Dyas presented letter for Council agenda for next meeting requesting deannexation of approximately 50 acres of land belong.. ing' to Olympia Corte Dyas. Motion by Councilman H. G. Bishop seconded by Councilman Barney Shull that the following Amendment to the City of Fairhope Pension Plan be adopted. Motion carried. AMENDMENT NO•. 3 to CITY OF FAIRHOPE PENSION PLAN WHEREAS City of Fairhope, Alabama adopted, effective as of July 1,'i 1965, a document entitled "City of Fairhope, Alabama Pension Plan and WHEREAS Article X of said pension plan provides that the employer IiI may amend the pension plan at any time and from time to time; and WHEREAS said pension plan has been amended previously; and WHEREAS it is now desired to further amend said pension plan; NOW, THEREFORE, said pension plan, as previously amended, is further amended, effective as of April 30, 19759 by deleting Section 3.3 of Article III and substituting the following in lieu thereof: 3.3 A participant in the active employ of the employer may elect an early retirement date which may be the first day of any calendar month coincident with or subsequent to his fifty-fifth (55th) birthday and his completion of ten (10) years of credited service. This yearly amount of pension on the normal form payable to any such participant commeniding on his early retirement date shall be equal to the actuarial equivalent, determined in accordance with Table I. of the yearly amount of pension on the normal form determined in accordance with Section 3.2 as though his early retirement date were his normal retirement date; provided, however, that the minimum benefit set forth in Section 3.2 shall not be applicable in determining his pension benefit hereunder. IN WITNESS WHEREOF, City of Fairhope, Alabama, by its Mayor, has caused this amendment to be executed on the day and year herein- after set forth. Action on Insurance was held for next meeting.
