COUNTY OF BALDW IN
The City Council of the City of Fairhope .met in regular session
at the City Administration Building, 387 Fairhope Avenue, Monday,
July 28, 1975 at 7:00 P.M. with the following members present:
Mayor James P. Nix, Councilmen: David E. Bishop, H. G. Bishop,
Sam E. Box, 011ie E. Deese and Barney L. Shull.
Minutes of the previous meeting were approved.
A letter from Baldwin County Mental Health requesting assistance
in funding in the amount of $ , 387.00 was presented. No action
taken at this time.
Proposed Zoning Ordinance and Map was brought up for discussion.
Members of the Council felt that they needed more time to study
map and Ordinance after changes were made following joint meeting
with the Planning Commission. Mr. Amos Wagner requested that
area be changed to B-4 rather than R-4. Mr. Willie Todd, owning
property on Coleman and Greeno, approves of a B-4 in that area."
Mr. Carlton Niemeyer requested that his property on Fairhope
Avenue which is adjoining business property, be zoned R-4 instead
of R-3. Mr. Valentim questioned off-street parking in R-2 zone
and was informed that this did not- pertain to Residential property
Mr. Valentim also brought to the attention of the Council a house
in and R-2 zone which is multiple family dwelling and a coin
operated laundry on the premises. Council to check into this.
Mr. Bob Green reported that several names were misspelled on the
map and that his subdivision -showed too many lots. Councilman
Barney S'iull requested that the Planning and Zoning Commission
be instructed to prepare map in final order as per instructions
from the Council, with park lands designated including bird
sanctuary and other changes discussed at the joint meeting of the
Council and Planning Commission, and present to the Council for
their next regular meeting,.
Motion by Councilman David Bishop seconded by Councilman Barney
Shull that the following Resolution be adopted: Motlop carried.

STATE OF ALABAMA
COUNTY OF BALDWIN
WHEREAS.'a Declaration signed by the Owners of the abutting
land on the following described street, situated in the City of
Fhtrhope," Alabama, County of Baldwin, vacating a portion of said
Greenwood Avenue, has been` duly presented to the Mayor and Council
of the City of Fairhope, Alabama., for the assent and approval of
said governing ,body, said Declaration with map attached being
hereto affixed, marked Exhibit "A" and made a part hereof, and
WHEREAS, that portion of the said street above referred is
more particularly described as follows, to -wit:
Beginning at the NW corner of Lot 299
Greenwood Park Subdivision, as recorded
in. plat book 8, page 83 in the Office
of the Judge of Probate of Baldwin County
Alabama and which is the Point or Place
of beginning: thence run South 140 feet
to a point on the -North side cif existing
Greenwood Avenue; thence run West 40 feet
to a point; thence run North 140 feet to
a point; thence run East 25 feet to the point
or place of Beginning, and
WHEREAS, it appears to the Mayor and City Council of the
City of Fairhope, Alabama, that the vacation of said street is
In order and that convenient and reasonable means of ingress and
egress is afforded to all other property owners owning properties
In the tract of land embraced it said plat of Greenwood Park
Subdivision;
NOW, THEREFORE, BE IT RESOLVED by the Mayor and City Council
of the City of Fairhope, Alabama, that the vacation of the herein -
above described portion of said street, is assented to and approv-
ed and the same is hereby vacated pursuant to the provisions of
Title 56, Section 32, Code of Alabama.

Motion by Councilman Sam Box seconded by Councilman David Bishop
that Ordinance No.554; AN ORDINANCE PROHIBITING UNNECESSARY
NOISES, WITH MAXIMUM DECIBELS ALLOWED AND PROVISIONS FOR
ENFORCEMENT AND THE PENALTIES FOR VIOLATING THE SAME, introduced
at the meeting of July 14, 1975 be adopted as introduced. Motion
carried.
Motion by Councilman Sam Box seconded by Councilman Barney S ull
that Ordinance No, 555, AN ORDINANCE TO PROHIBIT TRUCKS AND �
BUSES WITH A CAPACITY GREATER THAN 3/4 TONS TO ENTER UPON ANY
OF THE BEACHES OR BEACH ROADS OF THE CITY OF FAIRHOPE, ALABAMA OR
ANY ROADS WITHIN ITS POLICE JURISDICTION, introduced at the meet -
in of July 14, 1975 be adopted as introduced. Motion carried.
Motion by Councilman Sam Box seconded by Councilman Barney Shull
that Ordinance No. 556, AN ORDINANCE TO AMEND ORDINANCE NO. 544
OF THE CITY ORDINANCES OF THE CITY OF FAIRHOPE, TO ESTABLISH A
LICENSE FOR PERSONS, FIRMS OR CORPORATIONS, OPERATING BUS SERVICES
IN AND OUT OF THE CITY OF FAIRHOPE, WITHOUT REGULAR STOPS, OR ON
REGULAR SCHEDULES, introduced at the regular meeting of July 14,
1975,,E be adopted as ,introduced. Motion carried.

A RESOLUTION SUPPLEMENTING THE RESOLUTION ENTITLU'D
"A RESOLUTION AUTHORIZING THE ISSUANCE, EXECUTION,
SALE AND DELIVERY OF $650,000 PRINCIPAL AMOUNT OF
GENERAL OBLIGATION REFUNDING WARRANTS OF THE CITY
OF FAIRHOPE FOR THE PURPOSE OF FUNDING OR REFUNDING ,
A LIKE OR GREATER AMOUNT OF THE PRINCIPAL OF AND
INTEREST ON THE OUTSTANDING INTEREST BEARING WARRANTS
AND NOTES OF THE CITY OF FAIRHOPE" ADOPTED MAY 26,
1975, AND RATIFYING AND CONFIRMING THE ISSUANCE,
EXECUTION, SALE AND DELIVERY OF THE WARRANTS AUTHORIZED
BY SAID RESOLUTION
BE IT RESOLVED BY THE CITY COUNCIL (the "Council") OF THE
CITY OF FAIRHOPE-(the "City") as follows:
Section 1. The City by and through its Council, does
hereby find and determine, represent and warrant as follows:
On June 30, 1975, the principal balance due on the
Municipal Airport Warrants described in Section 1, paragraph (b),
item (iii) of the resolution entitled "A RESOLUTION AUTHORIZING'
THE ISSUANCE, EXECUTION, SALE AND DELIVERY OF $650,000 PRINCIPAL
AMOUNT OF GENERAL OBLIGATION REFUNDING WARRANTS OF THE CITY OF
FAIRHOPE FOR THE PURPOSE OF FUNDING OR REFUNDING A LIKE OR GREATER
AMOUNT OF THE PRINCIPAL OF AND INTEREST ON THE OUTSTANDING INTEREST
BEARING WARRANTS AND NOTES OF THE CITY OF FAIRHOPE" adopted by
the Council on May 26, 1975, was $35,537.49; the principal balance
then due on the General Obligation Promissory Note described in
item (iv) of Section 1, paragraph (b) of the aforesaid resolu-
tion was $98,444.33; and the General Obligation Warrants or
Notes described in item (vi) of Section 1, paragraph (b) of
said resolution had been increased to a total of $79,700 by
reason of the execution and delivery by the City of a promissory
note dated , 1975, payable to First National Bank
of Fairhope in the principal amount of $24,200.
The total principal on the Warrants and Notes described
in Section'l, paragraph (b) of said resolution as corrected by
this resolution,refunded on June 30, 1975, by the General
Obligation Refunding Warrants authorized by the aforesaid reso-
lution was $661,681.82. Accrued interest on the warrants and
notes described in paragraph (b) of Section 1 of said resolution
to June 30, 1975, totaled $14,651.41.

General Obligation Refunding warrants dated June 30, 1975, to
refund and in exchange for the warrants and notes described in
Section 1, paragraph (b) of said resolution, as corrected by
Section 1 of this resolution, which were surrendered to the
City marked "Paid in Full and Cancelled", and the payment
from the funds of the City of that portion of the principal
and accrued interest on said warrants and notes as exceeded
$650,OOObe and the same hereby are approved, ratified and
confirmed.
