COUNTY OF BALDWIN
THE City Council of the*City of Fairhope met in regular session
at the City Administration Building, Monday, June 9, 1975 at 7:00
P.M. with the following members present: Mayor James P. Nix,
Councilmen: David E. Bishop, H. G. Bishop, Sam E. Box, 011ie E.
Deese and Barney L. Shull.
Minutes .pf 'the previous regular.. meeting were approved.
This being date set for opening bids on 24" culvert, the follow-
ing bids were received:

Motion by Councilman H. G. Bishop
Shull that low bid be accepted if

This being date set for opening bids on validating machine, the
following bids were received:

Motion by Councilman David Bishop seconded by Councilman 011ie
Deese that the City accept low bid if bid meets specifications.
Councilman ffl. G. Bishop moved that the motion be tabled, seconded
by Councilman Barney Shull. Upon being put to vote the following
vote was recorded: Voting for Motion to table: Councilmen:
H. G. Bishop, Sam E. Box, 011ie E. Deese and Barney Shull. Voting
Against: Councilmen David E.'Bishop. Motion carried..
Motion by Councilman Sam Box seconded by Councilman 011ie Deese
that City accept counter offer on Carrino property for lead bed
for cathodic protection. Motion carried.
Mr,. Russ Kilgore, Chairman of the Airport Board reported on
Municipal Airport. Copy Attached.
This being date set for opening bids on Sewer machine, only one
bid was received from Flexible Pipe Tool Co., Rockwell Internatio-
nal, in the amount of $4,950.00.' Motion by Councilman Sam Box
seconded by Councilman David E. Bishop that the City accept bid
as presented. Motion carried. '
Councilman Barney Shull nominated Mr. Victor Altamirano to the
Board of Adjustment and Appeals replacing Mr. George Stejskal
whose term has expired. There being no other nominations, Council.
man H. G. Bishop seconded the Motion and upon being put to vote
was unanimously carried.
Motion. by Councilman H. G. Bishop seconded by Councilman Barney
Shull that the following Resolution be adopted: Motion carried.
RESOLUTION
WHEREAS, George Stejskal'has served on tie Board of
Adjustments and Appeals for many years, and
WHEREAS, George Stejskal has given of his time and talents
for the betterment of the community,
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF
THE CITY OF FAIRHOPE, ALABAMA that George Stejskal be commended
for his untiring efforts while serving on this Board.
BE IT FURTHER RESOLVED that a copy.of this'Resolution he
mailed to Mr. Stejskal and a copy spread upon the minutes of this
meeting.

Motion by Councilman H. G. Bishop seconded�by Councilman Barney
Shull that the Mayor and City Clerk be authorized to sign lease
agreement with the Fairhope Single Tax Corporation. Motion
carried.
Councilman David E. Bishop introduced the following Ordinance:
ORDINANCE NO. 553
AN ORDINANCE TO AMEND SECTION 4-25 IN THE CODE OF FAIRHOPE, AND
ORDINANCE # 275 TO READ AS FOLLOWS:

SECTION 4-23. 'WHEN NUISANCE;, PENALTIES; DUTY OF POLICE.
The owner of dog or,cat or other pet in the city who
allows the same to -be a nuisance by barking, or making a loud or
raucous noise,'biting, etc.,, or creating offensive odors or
unsanitary conditions shall be deemed guilty of a misdemeanor.
The police.shall take action against anyone charged with viola-
tion of this section by -any party so annoyed.
This ordinance shall take effect upon its due adoption and
publication as required by law.

Councilman David E. Bishop introduced the following Ordinance:
ORDINANCE NO. 553-A
AN ORDINANCE TO AMEND SECTION 4-26 OF THE CODE OF FAIRHOPE, AND
ORDINANCE NO. 301 to read as foYlows:
SECTION 4-26 CITATION, ISSUANCE FOR VIOLATION
The City Dogcatcher shall be and he is hereby authorized
to issue citations for violations of Ordinances pertaining to
dogs, cats, or other pets.
This Ordinance shall take effect upon its due adoption
and publication as required by law.
ADOPTED THIS THE DAY OF 1975.

Mayor Nix reported that the Trustees of Foley Utility Board have
approved the sale of Riviera lines within the City Limits of
Fairhope. '
Request for 120 f t. curbing on S. Bayview Ave., housing the
Social Security Building, was referred to Councilman Deese for
report at next regular meeting of the Council.
Motion by Councilman Barney Shull seconded by Councilman H. G.
Bishop that the Jaycees be granted permission to use beach area
for concessions and parking as requested. Motion carried.
Motion by Councilman Barney Shull seconded by Councilman Sam Box
that the Council thank the Jaycees for their wholehearted efforts
in securing fireworks and promoting the July 4th celebration.
Motion carried.
Motion by Councilman Sam Box seconded by Councilman Barney Shull
that the National Guard be commended for voluntarily removing
roof from the old reservoir behind the Police station and repair-'
ing roof on shed at the Supply Building. Motion carried.
Motion by Councilman H. G. Bishop seconded by Councilman David
E. Bishop that bills be approved for payment. Motion carried.
It was duly moved, seconded and carried that the meeting adjourn.
