COUNTY OF BALDWIN
The City Council of the City of Fairhope met in regular
session at the City Administration Building, 387 Fairhope
Avenue, on Monday, March 10, 1975 at 7:00 P.M. with the
following members present: Mayor James P. Nix, Councilmen:
David E. Bishop, H. G. Bishop, Sam E. Box. 011ie E. Deese
and Barney L. Shull.
Minutes of the previous regular meeting were approved.
Request for Beer License at the proposed Briarpatch Club was
brought up for discussion. Mr. Joseph Osterberger and other
residents of Paddock Estates requested that the license be
denied as there were already six businesses with Beer license
along Scenic Route 98, Mr. Bob Cowen stated that it would be
a private club and lounge, opening around 4:00 P.M. and serving
evening meals, no sales to go. Councilman Barney Shull moved,
seconded by Councilman Sam Box that the request be tabled for
further study. Upon being put to vote the following vote was
recorded: For: Counoilmen: H. G. Bishop, Sam E. Box, 011ie E.
Deese and Barney L. Shull. Against: Councilman Ed Bishop.
Motion carried.
Request of Mr. George Vekrakos for Beer permit at Big Daddy
East, Inc. located at 300 Fairhope Avenue in the Village
Square was discussed. Motion by Councilman Barney Shull seended
by Councilman Sam Box that the Mayor be authorized to issue
License. Upon being put to vote the following vote was recorded:
For: Councilman Sam Box, H. G. Bishop and Barney Shull. Against4
Councilman David E. Bishop and Councilman 011ie Deese. Motion
carried.
Motion by Councilman H. G. Bishop seconded by Councilman Sam Box
that Mayor Nix be authorized to proceed with negotations to pur-
chase customers from Riviera Utilities and bring final details
back to the Council before closing. Motion carried.
Motion by Councilman Sam Box seconded by Councilman Barney Shull
that the Mayor be authorized to complete transaction of consolidat-
ing General Obligation debt by issuing $650,000.00 Warrants payable
over a period of 15 years. Upon being put to vote the following
vote was recorded: Fbr: Councilmena David Bishop, Sam Box, 011ie
Deese and Barney Shull, Against: None, Councilman H. G. Bish op
abstained from voting because of prejudicial interest in the matter.
Motion carried.
Motion by Councilman H. G. Bishop seconded by Councilman Barney
Shull that the City Attorney be authorized to obtain services of
Bond Attorneys for issueing warrants. Motion carried.
Motion by Councilman Sam Box seconded by Councilman Barney Shull
that the City send four Firemen to Fire School, April 13 thru 18.
Motion carried.
Councilman David Bishop introduced the following Ordinance:
ORDINANCE NO.- 641,_
AN ORDINANCE ANNEXING THE HEREINAFTER DESCRIBED PROPERTY,.WHIGH SAID
PROPERTY IS.CONTI.GUOUS TO THE CITY.LIMITS OF THE CITY OF FAIRHOPE, ALABAMA, SUCH
ANNEXATION.BY PETITION OF ALL OF THE PROPERTY OWNERS OF SAID PROPERTY.
WHEREAS, WILLIAM P. WYLLIE and wife, ALICE P. WYLLIE, being the owners
of all the hereinafter described property, did by Petition, petition the City
lof Fairhope, Fairhope, Alabama, for annexation under Act 2228, Adopted in the
1971 Regular Session of the Legislature of the State of Alabama, and
WHEREAS, a map.of said property is attached to the Petition,
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
JFAIRHOPE, ALABAMA, that by these presents do hereby annex all of the hereinafter
described property, which is contiguous to the corporate limits of the City of
IFairhope, Alabama, and more particularly described as follows; to -wit:
From the Southwest corner of Fractional Section 19, Township
6 South., Range 2 East, Baldwin County,. Alabama, run East 409.1
{ feet; thence run North X97.6 feet to the.Point of Beginning,
said point being on the East Right-of-way line of U.S. Highway
98 and being the Northwest corner of a lot now owned or formerly
owned by Perry Lowrey; thence run South 66052'East, 272.8 feet
to an Oak Tree; thence run North-17020'East, 102.8 feet to an
iron pipe; thence run North 190.14'East; 279.4 feet to a concre?
block; thence run North 77000'West,74 feet; thence run North 41
00' East 84 feet;thence run South 86030'East; 123.5 feet to an
ironaax1b; thence run North:17 00' East, 62.5 feet; thence run
North .73q 30''.West,' 404 feet to the East right-of-way of.U.S.
Highway #98., thence following said east right-of-way, run as
follows: South 15029'W, 181.7 feet; South 12031'W,.233.5 feet;
South 070121W, 1.95..65 feet to the Point of Beginning.
BE IT FURTHER ORDAINED BY THE CITY COUNCIL OF THE CITY OF FAIRHOPE,
ALABAMA, that the City does hereby assent to the said annexation to the City of
the hereinabove described property.
BE IT FURTHER ORDAINED BY THE CITY OF FAIRHOPE, that a CERTIFIED copy
of this Ordinance, along with the Petition be recorded .in the Office of the Judgi
of Probate, Baldwin County, Alabama.
THIS ORDINANCE shall take effect immediately upon its due adoption and
publication as required by law.

PETITION FOR ANNEXATION

BALDWIN COUNTY
WILLIAM P. WYLLIE and wife, ALICE P. WYLLIE, being all of the proper
owners of the hereinafter described property, such property being without the
corporate limits of the City of Fairhope, Alabama, but being contiguous to the
corporate limits of the City of Fairhope, Alabama, and such property not lying
within the corporate limits or the Police Jurisdiction of any other municipality
do by these presents, hereby petition that said property be annexed to the City
of Fairhope, Alabama.
A Map of said property is hereto attached.
This Petition is filed under Authority of Act No. 2228, 1971 Acts of
the State Legislature of the State of Alabama, and the property being more
particularly described as follows:
From the Southwest corner of Fractional Sect. 19, Township

said point being on theEast right-of-way line of U.S. Highway
98 and being the Northwest corner of a lot now owned or formerly

iron pipe; thence run North 19014'East, 279.0feet to a concrete

Motion by Councilman H. G. Bishop seconded by Councilman David
Bishop that the bills be approved for payment. Motion carried.
Council requested that a monthly list of delinquent utility
accounts be presented to the Council each month.
It was duly moved, seccmded and carried that the meeting adjourn.
