A STA7EOF ALABAMA COUNTY OF BALDWIN The City Council of the City of Fairhope met in regular session at the City Administration Building, 387 Fa.irhopm Avenue, Monday, October 14, 1974 at 7:00 P.M. with the following members present: Mayor James P. Nix, Councilmen: David . E. Bishop, H. G. Bishop, Sam E. Box, 011ie E. Deese and Barney L. Shull. Minutes of the previous regular meeting were approved. Motion by Councilman Barney Shull seconded by Councilman David E. Bishop that Bon Seeour Avenue from Volanta Ave., North be deleted from the 1974 Street Improvement Ordinance. Motion carried. Councilman 011ie Deese introduced the following Ordinance; Improvement Ordinance No. AN ORDINANCE MODIFYING, AMENDING AND CONFIRMING, AS SO MODIFIED AND AMENDED, IMPROVEMENT.RESOLUTION ADOPTED ON THE 9th DAY OF SEPTEMBER, 1974• BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FAIRHOPE ALABAMA AS FOLLOWS: SECTION 1. That upon evidence presented to and considered by it, the City Council does hereby make a finding and deArmin- ation of the following facts: (a) At a regular meeting of the City Council of the City of Fairhope, held on the 9th day of September, 1974, Improvement Resolution was adopted and notice of the adoption of said Resolu- tion was given by publication of said Resolution in the FAIRHOPE COURIER, a newspaper published in and of general circulation in the City of Fairhope, Alabama, in the issues of September 12 and September 19, 19749 which said Resolution stated that the City Council of the City of Fairhope would meet on the 30th day of September, 1974 at 7:00 o'clock P. M. at the City Hall in the City of Fairhope, Alabama, to hear any objections, remonstrances or protests that might be made to said improvements or the character of the material or materials to be used, and the manner of making the same. (b) A copy of said Improvement Resolution was sent by regist- ered mail, postage prepaid, to each of the persons last assessing for City taxation the property proposed to be assessed for said Improvements at their last known addresses; said notice having bean mailed on the 20th day of September, 1974s, ten days prior to the 30th day of September, 1974• (e) The protests and objections of persons owning property on Bon Seeour Avenue from Frederick to Grand, Namely, Dr. Pierce Frederick and Mr. Paul Frederick; to the improvement on Bon Seeour Avenue from Frederick to Grand were heard, considered, sustained and granted, and improvement Resolution amended and modified by the elimination of the improvement on Bon Seeour Avenue from Frede- rick to Grand. (d) The protests and objections of persons owning property on Chestnut Street, namely, 0. D. Dunn and Melvin Wagner, to the Improvements on Chestnut Street were heard, considered, sustained and granted, and Improvement Resolution amended and modified by the elimination of the improvement on Chestnut Street. (a) The protests and objections of persons owning property on Laurel Street, namely, George Connors, Wm, ShaphaXlds Billy Sloan, Jimmie Sproels, John H. Owens, Dyson, Eldon Harrington, G. D. Myers, William Richman, Mrs. Marie Patterson, to the improve- ments on Laurel Street were heard, considered, sustained and granted, and Improvement Resolution amended and modified by the elimination o f the Improvement on 'Laurel Street. (f) The protest of Mr. Brister, by letter, to the improve- ments on Lincoln Street was heard, considered and granted and Improvement Resolution amended and modified by the elimination of the improvement on Lincoln Street. The Fairhope Single Tax Corporation withdrew their request for paving Lincoln, Chestnut, Blue Island, Mershon and Brown Streets and on motion by Councilman H. G. Bishop seconded by Councilmen Sam Box, Improvement Resolution was amended and modifle d by the elimination of the improvements on Brown Street and mershon Street.. No other protests, objections or remonstrances against said Improvement, or the character of materials to be used and the manner of making said improvements have been filed in writing with the City Clerk or in her office, or have been made at this meeting, and said Improvement Resolution is hereby modified and amended as follows: SECTION Its That the following described streets in the City of Fairhope, Alabama shall be improved as hereinafter provided between the respective terminal points hereinafter set forths A. Winn Lane from the east side of the existing pavement on Blue Island Avenue 617 feet eastwardly to the west side of existing pavement on Ingleside Avenue; B. Northrup Street, from the east edge of existing pavement on south Ingleside Avenue eastwardly 875 feet to the eastern and of the oul de sac that terminated said streets C. Burgundy Street, from the east edge of existing pave- ment on Church street eastwardly to the west edge of existing pave= ment pavement on Burgundy Street at Boone Lane 685 feet; Each of said streets to be improved as follows: a 20 foot bituminous con - orate pavement 1 1/2 inches thick (150 lbs per square yard) to be laid over a 6 inch thick compacted, primed, granular soil base constructed between 2.5 foot wide 6 inch thick portland cement concrete valley gutters; together with brick manholes and catch - basins where necessary with metal or concrete covers, concrete culverts, concrete pipe, drop '.inlets, grading, clearing, grass- ing and sodding as necessary for erosion control and effeetitre completion and protection of said streets. D. Blue Island Avenue, from the north edge of the existing pave- ment on Fairhope Avenue northwardly 1840 feet to the existing pavement on Blue Island Avenue at Winn Lane, shall be improved by the construction of all of the construction items listed above together with such additional metal pipe and concrete pipe culverts neoessary to substantially control erosion along said street and also including construction of the 1285 linear feet of 8 ench vitrified clay sanitary sewer (with standard manholes and laterals) that will connect to the Fairhope Avenue sewer line by gravity flow. SECTION III. As herein modified and amended, Improvement Resolution is hereby in all things ratified and confirmed. Attests Councilman Barney Shull moved that all rules governing the council which might, unless suspended, prevent the passage and adoption of the ordinance at this meeting, be and the same are hereby suspended for the purpose of permitting the said ordinance to be finally passed and adopted at this meeting. Councilman Sam Bozz seconded the motion and on roll call the vote was as followss Yea: Councilmen: David E. Bishop, H. G. Bishop, Sam E. Box, 011ie E. Deese and Barney L. Shull, Nays: None. Motion adopted by unanimous vote of the members present. Councilman 011ie E. Deese moved that the said ordinance No. 543 be finally passed and adopted as introduced. Councilman Barney Shull seconded the motion and on roll call the results were as follows: Yea: Councilmen; David E. Bishop, H. G. Bishop, Sam Z. Box, 011ie E. Deese and Barney L. Shull, Nay: None. Motion finally adopted as introduced. Representatives from Republic National Life Insurance presented Hospital Insurance plan to the Council. Councilman 011ie Deese and Councilman David Bishop are to review plan as presented and make recommendation to the Council at,a future date,. Motion by Councilman David Bishop seconded by Councilman Sam Bo=:, that the City Council approve payment of $360,74 to the South Alabama Health Clinic for health program in the area. Motion carried. Motion by Councilman Sam Box seconded by Councilman Barney Shull that the Chamber of Commerce be included in the General Fund budget in the amount of $300.00 per year for fiscal year 1974-75. Upon being put to vote the following vote was recordeds For: Councilmen: Sam E. Box, 011ie E. Deese and Barney L. Shull. Against: Councilmen: David E. Bishop and H. G. , Bishop. Motion carried. Motion by Councilman H. G. Bishop seconded by Councilman Sam Boxx that the City adopt General Fund budget for Fiscal year 1974-75 with $276,471.00 defeoit. Motim carried, In order to defray cost of increase from Alabama Power Company to the City for electricity purchased, Councilman David E. Bishop, introduced the following Ordinance: ORDINANCE NO. 549 A AN ORDINANCE ESTABLISHING ELECTRIC HATES FOR ELECTRIC SERVICE FURNISHED FROM THE ELECTRIC DISTRIBUTION SYSTEM OF THE CITY,'?, OF FAIRHOPE, ALABAMA. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FAIRHOPE, ALABAMA that the following schedule of rate for electric service furnished from the Electric Distribution System of the City of Fairhope, Alabama be and the same is hereby adopted: { CITY OF FAIRHOPE Electric Dept. RATE FOR DOMESTIC RESIDENTIAL ELECTRIC SERVICE Availability Available in all areas served by the City owned Electric System. Applicability Applicable to single residences, mobile Tiomes where such are individually metered, and individual family apartments where cost of service is paid by the occupant. Character of Service Single or three phase service at 120/240 volts 60 Hertz. , _Monthly Rate r i $2.00 for the first 40 KWH or less, plus 4.0�- per KWH for the next 60 KWH, plus 3.5p per KWH for the next 200 KWH, plus .2.0� per KWH for the next 700 KWH, plus ' 1.5Q per KWH for all over 1000 KWH per month used during the period from' September 15 to April 15, or 2.20 per KWH for all over 1000 KWH per month used during the period from April 15 to September 15 each year, I Plus, to the above rate shallbe added the product of the monthly KWH used times f an•fuel cost adder. This fuel cost adder shall be the latest fuel cost adder billed to the City at,wholesale by the Alabama Power Compjiny. Minimum Bill - i The minimum monthly bill shall be $2.00. Taxes The above rate is that charged by the City of Fairhope, and any additional charges levied by State or Federal authorities, such as sales taxes,.will.be passed on to the consumer in addition to the above rate'schedule. Payments Bills for'service rendered.hereunder are payable•.within ten (10) days from due,'date, and if not paid within such period, shall--be'-increasedby a delingueut fee'�df 5% of total bill. RATE FOR GENERAL ELECTRIC SERVICE (Commercial) Availability Available in all areas served by'the City owned Electric System. Applicability Applicable for non-residential lighting and power service where the maximum 15 minute integrated demand does not exceed 49 KW. Service to more than one premises not to be combined, nor shall it be shared with or resold to others. Character of Service Single or three phase service, or combination of both, at the nominal sec- ondary voltage, or at the available primary distribution line voltage in special cases. Any consumer receiving service at two different voltages will be consid- ered as two separate consumers. The type of metering is to be specified by the City. Monthly 'Rates First 50 KWH per month or less @ 5.0e,% (Minimum) Next 150 KWH per month or less @ 5.0p Next 1800 KWH per month or less @ 4.0p Next 3000 KWH per month or less @ 3.5e, Next 5000 KWH per month or less @ 2.6,,%, plus All over 10,000 KWH per month @ 2.4o, Plus, to the above rate shall b.e added the product of the monthly KWH used times an fuel cost adder. This fuel cost adder shall be the latest fuel cost adder billed to the City at wholesale by the Alabama Power Company. Minimum Bill The minimum monthly bill shall be $2.50. Taxes The foregoing rate is that charged by the City and any additional charges levied by State or Federal authorities, such as sales taxes,.will be passed on to the consumer in addition to the above schedule. Payment Bills for service rendered hereunder are payable within tent(10) days from due date, and if not paid within such period, shall be increased by a delinquent fee of 5% of total bill. Term of Contract Y Service hereunder shall be for an initial period of twelve months, and thereafter from month to month until terminated by proper authorization. Temporary or Seasonal Service Where service is provided hereunder for a period of less than one year (continuously), or where service is seasonal or temporary, a surcharge of twenty-five percent (25%) shall be added'to each month's bill after the bill has been computed in accordance with the rate. In view of the surcharge being paid while service is being•rendered,no monthly minimum or other charge is to be made to seasonal customers during the period that service has been disconnect- ed. For each non -reoccurring temporary service where it is'necessary for a temporary service pole to be set and/or a temporary service drop to be run from existing utility lines, the City may make a charge to cover the cost of install- ing and removing such service. This fuel cost adder shall be the latest fuel cost adder billed to the City at wholesale by the Alabama Power Company. Determination 4f Billing Demand The demand for billing purposes shall be the maximum measured intergrated 15 minute interval demand during each billing period of approximately thirty (30) days, measured in KW (kilowatts); provided, however, that no demand shall be taken at less than seventy-five percent (75%) of the maximum demand established during any of the eleven (11) preceding months, nor less than 38 KW. ti Minimum Bill The minimum bill shall not be less than that computed from seventy-five percent (75%) of the largest demand in KW established during the preceding eleven (11) months, nor less than $87.00. Payment Bills for service rendered hereunder are payable within ten (10) days from due date, and if not paid within such period, shall,be increased by a delinquent fee of 3% of total bill: Taxes The foregoing rate is that charged by the City, and any additional charges levied by State and Federal authorities, such as sales taxes, will be passsd on to the consumer in addition to the above rate schedule. Annlicabilit Applicable for lighting, power, and miscellaneous electric service whose integrated 15 minute demand is 50 KW or more where the entire electrical re quirements of the consumer are furnished by the City. Service to more than one premises shall not be combined, nor shall it be shared with or resold to', others. Character of Service Three phase service, or combination of single and three phase, at the voltage of the available primary or secondary distribution lines of the City. Any Consumer receiving service at two different voltages will be considered as two separate consumers. The type of metering is to be specified by the City. This rate is based on ownership of transformation facilities by the City (for primary voltage ratings of 13KV and below); however, ownership of. such by the Consumer is subject to negotiation by and with.the City. Term of Contract Service hereunder shall be'for an initial period of two (2) years and thereafter from month to month until terminated by thirty 00) days written notice. Temporary or Seasonal Service Where service hereunder is provided for a period of less than one•,(1) year (continuously) at the request of the Consumer, or where service is seasonal or temporary, a surcharge of twenty-five percent (25%) shall be added to each month s i bill after the Bill has been computed in accordance with the rate. Private Athletic Fields Electric service to lighted athletic fields where the lighting install— ' ation is financed and maintained by private ownership shall be billed.on the following basis for such months as the field is in use: All KWH used during each monthly period @ 5.0¢ per KWH, with no monthly minimum -or demand charge, and no charges to be made during months when the field is not in use, . Plus, an Fuel Cost Adjustment adder.• Security Lip hts For 175 W mercury vapor security lights with photoelectric control when installed by the City for private use, where it's electricity is furnished by the City, and where the luminaire and control are maintained by the City, the monthly rate shall be a flat charge of $4-00. Ownership of such lights.:. is to reside in the City. Cit .Use All electricity used by the various City'departments shall be accounted for monthly and a report made monthly to the Mayor of the KWH used by the following:. City Hall Police and Fire Station City Warehouse & Shops Electric Substation Use Civic Buildings Water Pumps Sewer Plants & Lift Stations Fireman's Club Street Lights ' Traffic Lights Lighted Athletic Fields All electricity used by the above shall be valued at 240 per M.
