-STATE OF AL ABARA
COUNTY OF BALDWIN
The City Council of the City of Fairho e met in regular session
at the City Administration Building,387 Fairhope-Avenue, Monday,
September 23, 1974 at 7:00 P.M. with the following members present:
Mayor James P. Nix, Councilmen: David E. Bishop, H. G. Bishop,
Sam E. Box, 011ie E. Deese and Barney L. Shull,
Minutes of the previous regular meeting were approved.
Request for payment of the City's share of the Baldwin County
Mental Health Association at $1.00 per capita or $5,720.00 was
held for future action.
Motion by Councilman H. G. Bishop seconded by Councilman David
Bishop that the City pay their share of $286.00 to the State Depart-
ment of Toxicology and Criminal Investigation for services rendered.
Motion carried.
The request to include Lincoln Street in the 1970 Paving program
and change the name to Jansen Street was tabled for an opinion
from the City Attomey.
Councilman David Bishop introduced the following Ordinance:
ORDINANCE NO. 542
AN ORDINANCE GRANTING MRS. IrdA BECKER, THE TAX ASSESSOR OF
BALDWIN COUNTY, ALABAMA, THE AUTHORITY TO ASSESS ALL CITY TAXES
ON BEHALF OF THE CITY OF FAIRHOPE, ALABA14A AND GRANTING HER THE
AUTHORITY TO PLACE THE SAID ASSESSMENTS IN THE PROPER HANDS FOR
COLLECTION, WITH THE AUTHORITY TO REMIT THE PROCEEDS THEREOF TO THE
CITY OF FAIRHOPE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FAIRHOPE,
AL:9.BAMA :
SECTION 1 - Authority is hereby granted by the City Council of
the City of Fairhope, Alabama unto the Tax_ Assessor of Baldwin County,
Alabama to assess all of the assessments of the City of Fairhope, and
to turn all necessary assessments over -to the responsible party for
collection, and with further authority to remit all taxes collected
thereunder to the City of Fairhope for the tax season for the year
1974-75-
SECTION 2 - The City of Fairhope further grants the authority
to Mrs. Ina Becker, the Tax Assessor of Baldwin County, Alabama, to
continue to make these assessments from year to year on behalf of
the City of Fairhope, Alabama and to turn them over to the collecting
authority to be remitted to the City Treasurer from year to year until
this Ordinance shall be repealed or modified.
This Ordinance shall take effect upon its due adoption and
publication as required by law.

Councilman Sam Box moved that all rules governing the Council
which might, unless suspended, prevent the passage and adoption
of the ordinance at this meeting, be and the same are here-Oy
suspended for the purpose of permitting the said ordinance to be
finally passed and adopted at this meeting. Councilman Barney
Shull seconded the motion. The question was put before the council
and on roll call the vote was as follows: Yea: Councilmen: David
Bishop, H. G. Bishop, Sam Box, 011ie E. Deese and Barney Shull. Nays,:
None. Motion adopted by unanimous vote of the members present.
Councilman Ed Bishop moved that said Ordinance No. 542 be finally
passed and adopted as introduced. Councilman Sam Box seconded the
motion. The question of final passage and adoption of said Ordinance
was put to vote and on call of the roll the result were as follows:
Yeas: Councilmen: David E. Bishop, H. G. Bishop, &gym E. Box, 011ie
E, Deese and Barney L. Shull. Days: None. Ordinance finally passed
and adopted as introduced.
The following bids were received on Police Photo Identification
Outfit:
McCain Uniform Company $649.45
SaSo, Inc. 599.50
Motion by Councilman Scull seconded by Councilman H. G. ' Bishop
that City accept low bid provided'it•9.meets specifications, payment
to be made from 95% L. E. P. A. Grant. Motion carried.
It was duly moved, seconded and 'carried that the meeting adjourn
to meet on Monday, September 30,, 1974'at ;7:00 P.M. to, hear any
protests on 1974 Street Improvements.

SIGNAL IMPROVEMENT PROGRAM
AGREEMENT
TRAFFIC SIGNAL INSTALLATION as described below:
This agreement is for the erection of traffic control
signals at the following locationsin Fairhope, Baldwin
County, Alabama:
Greeno Road (Baldwin County 11) at Morphy Avenue (Baldwin, County 46'
Greeno Road (Baldwin County 11) at Fairhope Avenue (Baldwin County 48;
And, whereas, the State and the City of Fairhope desire to enter into
an agreement for the installation and maintenance of these traffic
signals.
Now, therefore, in consideration of these premises, the mutual
covenants herein contained and the sum of $1.00 by each of the
parties to the other in hand paid, receipt whereof is hereby
acknowledged, the parties hereto agree as follows:
i. That the State will furnish and install the signal
equipment.

2. That these signals shall be operated and maintained
by trained and competent signal technicians at the
sole expense of the City of Fairhope.
These signals shall be kept in a good state of repair
at all times in order that no traffic hazard will be
created. Should these signals in any way fail to work,
the signals shall be repaired immediately or cut off and the
signal heads covered.
In the event future traffic conditions require changes
or adjustments, (other than ordinary timing), the
Highwa-y Department will be informed and approvals
gained before such changes are made.
3. That in the event future traffic conditions, or lack of
proper maintenance by the City of Fairhope, make it
necessary to discontinue or move these signals, the
equipment furnished by the State shall remain the pro—
perty of the State and subject to its disposal.

IN WITNESS WHEREOF, the State of Alabama Highway Department has
caused these presents to be executed by Ray D. Bass, Highway
Director, and the City of Fairhope by proper resolution, has caused
these presents to be executed by mayor James P. Nix, City of Fairhope,
this the day and year below written.

COUNTY OF BALDWIN
We, the undersigned members of the Fairhope City Counil
hereby waive notice of the calling of a Special Meeting
of the Fairhope City Council and do consent that .said
meeting be held at the City Administration Building, Monday,
September 16, 1974 at 5:30 P.M. for the purpose of discussing
electric rates of Alabama Power Company and taking any action
necessary.
