HomeMy WebLinkAbout09-09-1974 Regular MeetingSTATE OF ALABAMA COUNTY OF BALDWIN The City Council of the City of Fairhope met in regular session at the City Administration Building, 387 Fairhope Avenue, Monday, September 9, 1974 at 7:00 P.M. with the following members present: Mayor James P. Nix, Councilmen: David E. Bishop, H. G. Bishop, Sam E. Box, 011ie E. Deese and Barney L. Shull. Minutes of the previous meeting were approved. Mr. Don Hall, Manager of Pak-A-Sak, met with Council. requesting Beer License for Southland Corporation, Seven Eleven Store #17191. Motion by Councilman 011ie Deese seconded by Councilman Barney Shull that the Beer permit be granted. Upon being put to vote the follow- ing vote was recorded: For: Councilmen 011ie Deese and Barney Shull. Against: Councilman David Bishop. Councilmen Sam Box and H. G. Bishop abstained from. voting. Motion carried. Motion by Councilman H. G. Bishop seconded by Councilman Sam Box that payment to the Volunteer Fire Department be approved. Motion carried. This being date set for opening bids on Hadar equipment, only one bid was received. Motion by Councilman H. G. Bishop seconded by Council- man Barney Shull that the City purchase 1-MR-7 Hadar equipment under one bid from Kustom Signals, Inc. at a cost of $2,185.00. Motion carried. Motion by Councilman Shull seconded by Councilman David Bishop that the City lease old reservoir to the County for emergency operation center under proper auspices and correct time on lease. Motion carried. Motion by Councilman Barney Shull seconded by Councilman 011ie Deese that Mayor Nix be authorized to lease olJJ046 Chevrolet Fire Truck to the Barnwell Fire Department for $1.00 per year. Motion carried. Since the legal requirements for public hearing on Street Improvements were notcomplied with, the official hearing will be held on September 30, 1974, Any protest or requests at this meeting will be held for official hearing. Motion by Councilman David Bishop seconded by Councilman Sam Box SP that a special meeting be held on September 30, 19?4 at 7:00 P.M. to hear any protests on Street Improvements. Motion carried. Motion by Councilman 011ie Deese seconded by Councilman Barney Shull that the following Resolution be adopted. Motion. carried. 4 RESOLUTION WHEREAS, by Resolution adopted by the City Council of the City of Fairhope, Alatjama, August 12, 1974 the day of September 9th was set as the date for hearing objections, complaints and requests for changes in plans for the Street Improvement Program for 1974 which was established by said resolution; AND, WHEREAS, the legal requirements for the holding of said public hearing were n.otcomplied with and the resolution adopted May 122 1974 has been rescinded by motion duly made, seconded and adopted by the Fairhope City Council on the day, September 99 1974; AND, WHEREAS, the City Administration of the City of Fairhope by previous Council action, has announced and advertised its intention to undertake v� Street Improvement Program for 1974 and in order to reschedule the Street Improvement Program currently under consideration; BE IT HEREBY RESOLVED, that the following named streets in the City of Fairhope, Alabama be scheduled for receiving street Improvements, consisting of grading, concrete gutters, sand clay base and 150 pounds asphaltic concrete (plant mix) paving, together with such storm sewer construction,,drainage structures, including catch basins, junction boxes, etc., and such sanitary sewer construction as necessary to satisfy the requirements of the ordinances of the City of Fairhope, Alabama, all to be in accordance with the " minimum street improvement specification". heretofor enacted by previous ordinances of the City of Fairhope;: Bon Secour Avenue, from North end (North line of Volanta Subdivision) Southward to Volanta Avenue, Bon Secour Avenue from Froderiok Avenue to Grand Avenue. Winn Lane from Ina-leside Avenue to Blue Island Avenue, Blue Island from Winn Lane to Fairhope Avenue. Brown Street nrom Stimpson Street to Fairhope Avenue. rilershon Street from present termination of pavement at approximate South line of ball park to Nichols Street. Northrop Avenue from Ingleside Avenue Eastward to termination of Northrop. Chestnut Street from Pecan Street to Fig Street, Burgundy Street,aentire length, Church Street to Boone Lane. Laurel Street,, from Satsuma Street Eastward to a. point approximately 100 feet West of Liberty Street. Lincoln Street, from Gayfer Street, South 300 feet..- AND, BE IT HEREBY FURTHER RESOLVED, that Fairhope Title and Survey Company, Inc., Engineers, be named and designated as the engineers responsible for the execution of this contemplated work, including a, preparation of preliminary plans, specifications, letting of con£racts, and supervision of instruction and testing; I ---- AND, BE IT FURTHER RESOLVED, that the plans for the said work, including the engineer's cost estimates, and the grades for.the said work, shall be on display at the City 'Hall in the City-`of.,Fairhope beginning on September 20th; and that the date of September'30th, 1974 at 7:00 P.M. at Pthe City Hall, 'Fairhope; Alabama, be set and established as a day Land,"time for hearing any objections, complaints, and or requests for changes in said plans;! AND, BE IT FUATHER RESOLVED, that the costs for the execution of the construction work hereby and herein contemplated and described,.b� assessed against the abutting property, in accord with the recutirt�- ments of the Code of Alabama. AND, BE IT FURTHER RESOLVED, that a copy of this resolution be sent by registered mail to the owners of the properties abutting on said street, as the same appears on the current Tax Assessor's records; and that it be advertised in the Fairhope Courier for two consecutive weeks be- ginning September 12, 1974. ADOPTED THIS THE 9th DAY OF SEPTEDIBER, 1974. 11 c r Approved: Attest: Mayor idly Clerk Motion by Councilman David Bishop seconded by CoUnCilman Barney Shull that the following Resolution be adopted. 11otion carried, RESOLUTION WHEREAS, the State of Alabama, under the Omnibus Crime Control and Safe Streets Act of 1968 (P.L. 90-351 as amended) through the Alabama Law &-iforcement Planning Agency, is offering financial aid to combat risf.ng'crime, aid in crime prevention, investigation and detection; and WI3EREAS, the City Council is of the opinion it would be to advantage to snake application for said aid in the amount of $513,00 f6r shot guns and electric gun racks; The above amount; represents 95% of the program for which the application is made. WHEREAS, the City of Fairhope has agreed to contribute $27.00 as w4tching for the prodect anticipated, NOW, THEREFORE, be it resolved by the City Council that James P. Lix, Mayor in his official capacity be authorized to make applica- tion to the Alabama Enforcement Planning Agency for said grant. ADOPTED THIS THE 9th.DAY OF SEPTEMBER, 197• Motion by Councilman Barney Shull seconded by Councilman H. G. Bishop that the City grant a 60' right-of-way on City property as requested by the State for direct extension of Pecan Street to approximately 50' beyond the corner of American Telephone Company property. Motto n carried. Motion by Councilman Sam Box seconded by Councilman H. G. Bishop that the City accept 10% increase in dues from South Alabama F%gional Planning. Piotion carried. Mayor Nix appointed Councilman Barney Shull to the Planning and Zoning CommiS£bion to replace Councilman Sam Box effective October 1, 1974. Motion by Councilman Sam Box seconded by Councilman H, G. Bishop that the Harbor'Board,be authorized to purchase,numbers for Boat Stalls at a cost of $75.00. Notion carried, It was duly moved, seconded and carried that the meeting adjourn.
