COUNTY OF BALDWIN
The City Council'of the City of Fairhope met in regular session
at the City Administration Building, 387 Fairhope Avenue, Monday,
August 12, 1974 at 7:00 P- M. with the following members present:
Mayor James P. Nix, Councilmen: David E. Bishop, H. G. Bishop,
Sam E. Box, 011ie E. Deese and Barney L. Shull.
Minutes of the previous meeting were approved.
Motion by Councilman H. G. Bishop seconded by Councilman Sam Box
that the following resolution be adopted: Motion carried.
RESOLUTION
WHEREAS, Fairhope, Alabama, recognizes the need to insure
its proper and orderly growth and to prevent further development
of undesirable conditions; and,
WHEREAS, community planning is recognized to be of primary
importance for.the growth and development of Fairhope; and,
WHEREAS, the Alabama Development Office, State Planning Div-
ision, can assist in obtaining Federal Urban Assistance Funds to
aid in defraying the cost of a planning program and aid in providing
qualified personnel to perform the required planning work.
NOW, THEREFORE, BE IT RESOVED: That the City of Fairhope, Ala-
bama, requests the Alabama Development Office, State Planning Div-
ision, to arrange the following services:
Zoning Update
Subdivision Regulations Update
Capital Budget
and to obtain Federal Urban Planning Assistance Funds in the amount
of $2,61o.00 to aid in defraying the costs of the work specified
above.
BE IT FURTHER RESOLVED, That Fairhope will make available the
total sum of $1,305.00 be matched by federal funds and to pay
those costs not covered under the Urban Planning Assistance Program,
which sum will be paid to the Alabama Development Office, State
Planning Division, in accordance to the terms of a Contract to be
negotiated between City of Fairhope and the Alabama Development
Office, State Planning `Division.
Meals on Wheels was brought up for discussion. This was a request
for the City to sponsor the Meals on Wheels which would serve one
hot meal a day for Senior Citizens in the area who would not other-
wise have a hot meal. The cost to the City to sponsor such a program
would be $8,000.00. Councilman H. G: Bishop requested that no action
be taken at this time since there was no representative at the meet-
ing and the City did not have the funds at this time.
Application for Beer Permit at J & B Restaurant, formerly Parker
House,'in the name of Bill Stuart was approved on motion by Council-
man Barney Shull, seconded by Councilman 011ie Deese and carried.
The request of West Baldwin Water for purchase of additional water
if they extended their lines was brought up for discussion. Motion
by Councilman Sam Box seconded by Councilman Barney Shull that
Council pass over the request until a member of West Baldwin meets
withthe Council with information as to how much they intend to
extend their lines, number of customers, etc. Motion carried.

Motion by G)uncilman Sam Box seconded by Councilman Barney SOull that
the City noc vacate any right-of-way on North Mobile Avenue due to
erosion as 1;here hasn't been any change in the erosion for a number
of years. .Motion carried. Mrs. Maloney, who owns the adjacent
property requested that it go on record that she had previously
offered to aplit the expense of bulkheading the gulley before erosion
got to,her aroperty but due to the City's motion to do nothing about
the erosion, the offer has now fallen.
Motion by Q)uncilman David Bishop seconded by" Councilman Sam Box
that the City as4for bids on Transformers. 'Aotion carried.
Motion by Councilman David Bishop seconded by Councilman Sam Box
that the following Resolution be adopted; Motion carried.
RESOLUTION
WHEREA3, the CITY OF FAIRHOPE, a municipal corporation, adopted
electrical rates by a Resolution adopted on the 23rd day of October,
1972, which said electric rates did become effective on the 1st day
of January, 1973, and
WHEREA,>, on the 15th clay of October, 1973, the City of Fairhope
did enter into a supplemental company service agreement for the supply
of electric service to municipalities with the Alabama Power Company
and,
WHEREAS, in and by the terms of said Agreement, Alabama Power
Company did have the right to make Electric Tariff changes under the
terms and conditions and the rate schedule contained therein, and
WHEREA�S,, the City of Fairhope, is now desirous of adding to its
.Resolution the same terms and conditions as stated thereunder,
NOW, THEREFORE, BE IT RESOVED that the City of irhope amend
that certain Resolution adopted the 23rd day of October, 1972, which
said Resolution became effective on the 1st day of January 1973, to
add thereto the following;
"That the City of Fairhope be, and it is hereby authorized to
increase all electrical rates to the consumer, in the same percent-
age proportion, as Alabama Power Company raises its wholesale rates
to the City of Fairhope, under its General Contract and Service Agree-
ment for supply of electric service to municipalities, in addition
to all other stated rates in the said Resolution adapted the 23rd
day of October 1972 and effective the 1st day of January, 1973•"
BE IT FURTHER RESOLVED, that all the rest of the said Resolution
be, and the same is hereby RATIFIED AND CONFIRMED.

ADOPTED THIS THE 12th DAY OF AUGUST, 1974.
Mr. Claude Arnold, Engineer, presented Resolution authorizing
Street Improvement. Motion by Councilman 011ie Deese seconded by
Councilman Shull that the Resolution be adopted. Motion carried.
RESOLUTION
WHEREAS, the City Administration of the City of Fairhope did,
by Council action taken on May 27, 1974, decide and declare that
there would be a program of Street Improvement inaugurated for the
City of'Fairhope during the year of 1974; and
,WHEREAS, the citizenry of the City of Fairhope was duly notified
by public notice in the, FAIRHOPE COURIER subsequent thereto, 'for a
period of more than two weeks; and

,WHEREAS, a period,.of more than sixty days has now elapsed since
said decision was made and advertised;
INOW, THEREFORE BE IT RESOLVED, that the following named streets
be scheduled for receiving street improvements, consisting of grading,
concrete gutters, sand clay base, and 150 pounds asphaltic cortrete
(plant mix) paving, tog ether with such storm sewer construction,
drainage structures, including catch basins, junction boxes, etc.,
and such sanitary sewer construction, as necessary to satisfy the
requirements of the ordinances of the City of Fairhope, all to
be in accordance with the "minimum in street improvement specifica-
tion" heretofore enacted by previous ordinances of the City of
Fairhope:
Bon Secour Avenue, from North end (North line of Volanta Subdiv.)
Southward to Volanta Avenue.
Bon Secour Avenue from Frederick Avenue to Grand Avenue.
Winn Lane from Ingleside Avenue to Blue Island Avenue.
Blue Island from Winn Lane to Fairhope Avenue.
Brown Street from Stimpson Street to Fairhope Avenue.9
Mershon Street from present termination of pavement at
approximate South line of ball park to Nichols Street.
Northrop Avenue from Ingleside Avenue Eastward to termination
of Northrop.
Chestnut Street from Pecan Street to Fig Street.
Pomelo Street from Pier Street to Pecan Street (curb on East
side only.)
Burgundy Street, entire length, Church Street to Boone Lane.
BE IT FURTHER RESOLVED, that Fairhope Title & Survey Company,
Inc., Engineers, be named and designated as the Engineers respons-
ible for the execution of this contemplated work, including the
preparation of preliminary plans, specifications, letting of con-
tracts, and supervision of instruction and testing.
BE IT FURTHER RESOLVED that the plans for the said work, includ-
ing the engineer's cost estimates, and the grades for the said work,
shall be on display at the City Hall in the City of Fairhope begin-
ning on September 3rd; and that the date of September 9th, be set
and established as a day for hearing any objections, complaints,
and/or requests for changes in said plans:
BE IT FURTHER RESOLVED, that the costs for the execution of the
construction work hereby and herein contemplated and described, be
assessed against the abutting property, in accord with the require-
ment of the Code of Alabama..

Motion by Councilman H. G. Bishop seconded by Councilman Barney
Shull that the City accept proposal of New England Life Insurance
Company on City Employees retirement as presented. Motion carried..
A group of oitizens met with the Council protesting the trash pick-
up charges .end calling for trash pick-ups. The majority were will-
ing to pay a regular monthly charge along with their utility bill
and felt th:,.t $1.50 a month would bring in as much revenue as plan
now in effe ;t. After a lengthy discussion, Councilman Barney Shull
moved that the Council accept recommendations of the audience at
large since they indicated they would be willing to pay and are in
disagreement with what the Council has adopted. A .flat fee of $1.50
per month being set with Mayor Nix having the authority to take care
of any indi;3ents. Motion seconded by Councilman H. 3. Bishop and
carried.

STATE OF ALABAMA.
COUNTY OF BALDWIN
We, the undersigned members of the Fairhope City Council
hereby waive notice of the calling of a Special Meeting
of the Fairhope City Council and do consent that said
meeting be held at the City Administration Building, Tuesday,
July 309 1974 at 5:80 P.M. for the purpose of approving
charges for trash pick-up and approving Loan from the First
National Bank of Fairhope.
t
