Nix, Counoilmen,s ,David E. Bishop, Sam E. Box and Barney L. Shull, Councilman s H. G. Bishop and 011ie E. Deese being absent. Minutes of the previous meeting were approved. Motion by Councilman Sam Box seconded by Councilman Barney Shull that Ordinance No. 5339 AN ORDINANCE TO AMEND ORDINANCE NO. 4679 SETTING METER DEPOSITS FOR GAS CUSTOMERS OF THE CITY OF FAIRHOPE, LIVING OUTSIDE THE CITY LIMITS, introduoed at the regular meeting of April 22, 1974 be adopted as introduced. Motion carried. A Councilman Sam Box introduced the following Ordinances ORDINANCE No. 534 AN ORDINANCE TO PROHIBIT ANY PERSON OR PERSONS FROM L6TTZ&Tj1Gj BLOCKING PUBLIC STEPS LEADING TO THE BEACHES ALONG MOBILE STREET AND NO$TH ALONG THE BEACH AREA OR TO LOITER ABOUT THE SAME, AND ANY PERSON FOUND GUILTY THEREOF SHALL BE FINED NOT LESS THAN ONE NOR MORE THAN TWO HUNDRED DOLLARS OR PLACED IN THE BALDWIN COUNTY JAIL FOR A PERIOD NOT EXCEEDING SIX MONTHS OR BY BOTH FINE AND IMPRISON- MENT. BE IT 04AINED BY THE CITY COUNCIL OF THE CITY OF FAIRHOPE, ALABAMA THAT: SECTION 1 - It is hereby declared to be Unlawful for:any person or persons, to sit on, block, interfere with moving traffic, or loiter about any publio steps, leading from Mobile Street to the Beach, or any public steps along said Beach North of Fairhope Avenue and South of Fairhope Avenue, and any persqu found guilty thereof shall be punished by a fine of not less than+ ONE ($1.00) DOLLAR nor more than TWO HUNDRED ($200.00) DOLLARS, -end may also be imprisoned In the Baldwin County Jail for a period not exceeding Six Months(6) or by both fine and imprisonment at the discretion of the Court. '531 AN ORDINANCE ANNEXING THE HEREINAFTER DESCRIBED PROPERTY, WHICH SAID PROPERTY IS CONTIGUOUS TO THE: CITY LIMITS OF THE CITY OF FAIRHOPE, ALABAMA,SUCH ANNEXATION BY PETITION OF ALL OF THE PROPERTY OWNERS OF SAID PROPERTY. WHEREAS, FOREMAN AND SCHUSTER, INC.,'an Alabama corporation, being the owner of the hereinafter described property did by Petition, petition the City of Fairhope, Fairhope, Alabama for Annexation, under'Act 2228, Adopted in the 1971 Regular Session of the'Legislature of the State of Alabama, and WHEREAS, a map of said property is attached to the Petition, NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY -OF FAIR - HOPE, ALABAMA, that by these presents do hereby annex all of the hereinafter described property, which is conti,guous.to the.corporate limits of the City of Fairhope, Alabama and more parttcularly described as follows, to -wit: The West Half of the NW Quarter,of Section 21, Township 6 South, Range 2 East; LESS 1!:KE FOLLOWING EXCEPTIONS: EkceOtion'No. l:. That.portton of the said West Half.of said Northwest Quarter described as follows: From the NW corner of Section 21, T6S,.R2E, Run N 89Q 58'51" E, 40 feet; thence run S 00 06151" W, 1169 feet for a Point -of Beginning; thence run N 890 58'51" E, 400 feet; thence run S Oo 0651" W, 600. feet; thence run S 890 58'51" W,' 400 feet; thence run N 000651" E, 600 feet to.the Point of Beginning. The within described parcel of land lies to the NW Quarter of Section 21, Township 6 South, Range 2 East and contains 66.8 acres, more or less, exclusive of excepted areas. BE -IT FURTHER ORDAINED BY THE CITY OF FAIRHOPE, FAIRHOPE, ALABAMA, that the Ctty does hereby assent to the said annexation to the City of Fairhope, of the heretnabove described property. BE IT FURTHER ORDAINED BY THE GITY.OF FU RHOPE that a CERTIFIED COPY of this Ordinance, along with the Petition be recorded in the Office of the Judge of Probate, Baldwin County, Alabama. THIS ORDINANCE shall take effect immediately upon its adoption and pub-lication as required bylaw. ADOPTED THIS THE DAY OF. 1974. e Motion by Councilman Sam Box seconded by Councilman Barney Shull that the City advertise for Public Bearing in conjunction with the regular meeting of the Fairhope City Council on June 10, 1974. on East Of The Sun Subdivision Zoning B,-2 and $-3. Motion carried.. Motion by Councilman Sam Boa seconded, by Councilman Barney Shull that City advertise for Public Hearing in conjunction with the regular meeting of the Fhirhope City Council on June 10, 1974 on Paddock Estates, Rosa Acres and Jubilee By The Bay Sub- divisions zoning R-3, Motion carried. Motion by Councilman Ed Bishop seconded by Councilman Barney Shull that the bills be approved for payment. Motion carried. It was duly moved, seconded and carried that the meeting adjourn.
