HomeMy WebLinkAbout03-11-1974 Regular MeetingSTATE OF ALABAMA COUNTY OF BALDWIN The City Council of the City of Fairhope met in regular sesion at the City Administration Building, 387 Fairhope Avenue, on Monday, March 11, 1974 at 7:00 P.M. with the following members present: Mayor James P. Nix, Councilmen: David E. Bishop, H. G Bishop, Sam E. Box and Barney L. Shull. Councilman 011ie Deese being absent. Minutes of the previous meeting were approved. This being date set for public hearing on rezoning land of Middle Bay Land Co. on Greeno Road North of F irhope Avenue, protest was heard opposing rezoning anything on Greeno Road North of Fairhope Avenue. After general discussion, Councilman Box introduced the following Ordinance: ORDINANCE NO. S Z2 AN ORDINANCE AMENDING SECTION 13, DISTRICT BOUNDARIES, of ZONING ORDINANCE N0. 295 BE IT ORDAINED BY THE CITY COUlv%J U of the City of Fairhope, Alabama, that the following described property be rezoned from d-1 to R-3 subject to letter of intent for annexation of property outside City Limits from Middle Bay Land Company, as recommended by the Planning and Zoning Commission. Motion by Councilman Box seconded by Councilman Shull that City advertise for Public Hearing on rezoning Ingersoll property on West side of Greeno to 3-1. Public hearing to be held or. April 8, 1974 at 7:00 P.M. at the City Administration Building_ Motion carried. Motion by Councilman Box seconded by Councilman Shull that Ord- inance No. 527, Misdemeanors under the Laws of the State of Alabama, introduced at the regular meeting of February 25, ?974 be adopted as introduced. Motion carried. Motion by Councilman Box seconded by Councilman Shull that the following Resolution be adopted: 3ESOLUTION WHEREAS, \the City of Fairhope is in the process of purchas- ing certain new items of equipment necessary for the maintenance and operation of the sanitary landfill, and other necessary items of machinery, and WHEREAS, the City of Fairhope is desirous of paying off a certain indebtedness to the Town of Daphne, Alabama according; to a decree rendered out of the Circuit Court of Baldwin County, Alabama in the amount of approximately FORTY EIGHT THOUSAND ($489000.00) DOLLARS, and WHEREAS, the City of Fairhope is desirous of borrowing the sum of ONE HUNDRED SIXTEEN (1116,000.00) THOUSAND DOLLARS from the First National Bank of Fairhope, Alabama over a period of 84 months, with monthly payments of 11666.98 per month., which said payments shall include interest at the rate of 51% per annum on the unpaid balance, until the said Note is paid in full, and WHEREAS, the City Council is desirous of having the Mayor and City Treasurer execute a General Obligation Note, to be attested by the City Clerk to the First National Bank of Fairhope, in said amount. L NOW, THEREFORE, BE IT AESOLVED, that the Mayor and the City Treasurer be, and they are hereby authorized to execute a General Obligation Note, and to be attested by the City Clerk, payable to the First National Bank of Fa.irhope, it the amount of ONE HUNDRED SIXTEEN (1116,000.00) THOUSAND DOLLARS, and pay- able over a period of 84 months with monthly payments of $1666.98 which said payments will include interest at the rate of 51 per cent per Einnum on the unpaid balance. Bishop seconded by Councilman Barney Shull that the City purchase traffic light with left turn signal at approximate cost of $750.00. Motion carried. Motion by Councilman Sam Box seconded by Councilmm Barney Shull that the request of Carlton Niemeyer to retail packaged beer at the Village Store on Highway 98 be grantee':. Upon being put to vote, the following vote was recorded: Fors Councilmen: H. G. Bishop, Sam Box and Barney Shull. A*nst : Councilman David Bishop. Councilman 011ie Deese being absent. Motion carried. Motion by Councilman David E. Bishop seconded by Councilmen Sam Box that since D & P Roofing Co., low bidder on reroofing Police Station, has defaulted in their contract that the City award contract to next low bidder, Dawkins Construction Company in the amount of 11,310.00. Motion carried. Motion by Councilman H. G. Bishop seconded by Councilman Barney Shull that; Mr. & Mrs. B. Klumpp be allowed to purchase lot in. Bay View ,oubdivisiorn, owned by the City, for $500.00 subject to the approval of the 14airhope Single Tax Corporation and provid-d Mr. Klumpp swaps test Drell site for adjoining lot as per option agreement. Motion carried. Motion by Councilman Sam Box seconded by Councilman Barney Shull that the City accept overrun of 17� per foot on plipe above contract price on Transmission lines contract. Motion carried. Motion by Councilman Barney Shull seconded by Councilman H. G. Bishop that Playor Nix be authorized to proceed with proposals on adequate equipment for utility billing. Motion carried. Motion by Councilman H. G. Bishop seconded by Councilman David E. Bishop that the bills be approved for payment. Motion carried. It was duly moved, seconded and carried that the ineeting adjourn. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FAIRHOPE, ALABAMA; THAT ORDINANCE NO. 478 BE, AND THE SAME IS HEREBY AMENDED TO.READ AS FOLLOWS: Sect1on'2;'(1)-For single-family dwellings or apartment units within the City of'Fairhope, Alabama - $2.50 per month. Section 3 'Section 3 (A) to read as follows: A. There is hereby fixed the following fees for collection, hauling and disposing of garbage and trash for commercial establishments, hotels and motels, apartment houses, house trailers within the City of Fairhope, Alabama, as follows: (I) Apartment houses with more than one living unit-.$2.50 per month per unit. (2) House trailers - $2'.50 per month per trailer. (3) Offices - $2.50 per month each. (4) Businesses: (a) Two pickups per week = $6.00 per month. (b) Three pickups per week $9.50 per month. (c) One pick up per day - $25.00 per month. (5) Industries: (a) Two pickups per week - $6.00 per month. (h). Three pickups per week - $9.50 per month. (c) One Pickup per day-:$25.00 per month. Section 10-9; Permit to Use City Dump Section 10-9 of the City Code of Ordinances.of the City of Fairhope is hereby amended to read as follows: (A) The use of the City Land Fill Area, or commonly known as "City Garbage Dump" is hereby limited to the resident citizens of the.confines of within the City Limits of the City`"of Fairhope, and any such resident shall be allowed to use the -said City -Land Fill Area without charge, during the design hours as posted at the City Land Fill Area. (B) All other persons, firms or corporations be, and they are hereby prohibited from using the City Land Fill Area if they are without the confines of the City Limits of the City of Fairhope, Alabama, and any person, firm or corporation who shall be found using the City Land Fill, who are not within the confines of the City Limits, shall, upon conjiction, be fined not less than $10( nor more than $200.00.' ALL.OTHER SECTIONS OF NO. 478,,be, and the same are hereby RATIFIED and CONFIRMED except as hereinabove amended. AL.L'QRDINANCES, or parts'of Ordinances in conflict with the provisions of this Ordinance are hereby repealed. . Motion by Councilman Sam Box that all rules governing ,:the Council which might, unless suspended, prevent the passage and adoption of the Ordinance at this meeting, be and the same are hereby suspend- ed for the purpose of permitting said Ordinance to be finally pass- ed and adopted at this meeting. Motion carried and Ordinance adopted as introduced. Motion carried. Motion by Councilman Ed Bishop seecnded by Councilman Sam Box that City purchase Police equipment through a LEPA grant at 5% of their cost. Motion carried. Blind and Awning Co. $13, 495, 00 McCormick Roofing Co. 129965.00 Motion by Councilman Ed Bishop seconded by Councilman H. G. Bishop that City accept low bid of McCormick Roofing Company. Motion carried. Motion by Councilman Ed Bishop seconded by Councilman Sam Box that the City advertise for Public Hearing on rezoning land of Middle Bay Land Co. on East side 'of Greeno road, N. of Edwards Avenue. Motion carried, Motion by Councilman H. G. Bishop seconded by Councilman Sam Box that bills be approved for payment as presented. Motion carri4d.
