The City Council of the, City of Fairhope, Alabama, met in regular
session ae�the `City Administration Building, 387 Fairhope Avenue,
Monday, February 259 1974 at 7:00 P.M. with the following members
p,Te,sent : Mayor James P. Nix, Councilmen David E. Bishop, H. G.
Bishop, Sam E. Bog, 011.1e'E. Deese and Barney L. Shull.
Minutes of the previous regular and special meetings were approved.
Fir. Michael .Breedlove met with Council pertaining to Ad for Arts.
and Craft week. Motion by Councilman Ed Bishop seconded by Council-
man Barney Shull that City place full page color ad in Tabloid
for Arts and Craft Week at a cost of $168.00. Motion carried.
Councilman Barney Shull introduced the following Ordinance:
Ordinance No. 527
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FAIRHOPE,
ALABAMA AS FOLLOWS:
SECTION 1 - It shall be unlawful and be a crime against the
City of Fairhope, Alabama, under this Ordinance, for any person
to do any act or acts or to omit or to refrain from doing any
act or acts within the City of Fairhope, Alabama, or within the
Police Jurisdiction thereof, the doing of which constitutes a
misdemeanor under the Laws of the State of Alabama.
SECTION 2 - Any person who is convicted of Section 1 hereof
shall be punished by a fine, not to exceed $200.00 or by imprisonment
at hard labor upon the streets or public works or in the workhouse or
house of correction in the City of Fairhope, Alabama, not exceeding
six months, one or both, and in the event any fine or cost is not
presently paid, the Recorder of the City of Fairhope shall sentence
the offender or person, thus in default, to work out fine or costs
at hard labor upon the streets, public works, or in the workhouse
or house of correction in the City of Fairhope, and persons who are
sentenced to hard labor shall be allowed not less than $7.50 for
each day's service so performed.
SECTION 3 - Any misdemeanor created within the Police Juri'�
diction of the City of Fairhope under this Ordinance, which shall
carry a minimum fine in accordance with the statutes of the State
of Alabama, the same minimum shall apply hereunder.
SECTION -4 --All other Ordinances in conflict herewith be, and
the same are hereby REPEALED.
SECTION 5 - This Ordinance shall take effect upon its due
adoption and publication as required by law.

Motion by Councilman Ed Bishop seconded by Councilman Sam Box that
Ordinance O bb _, AN ORDINANCE TO SET A DEPOSIT FOR ALL -ELECTRIC
HOMES, introduced at the regular meeting of February 11, 1?74 be
adopted as introduced. Motion carried.
Motion by Councilman H. G. Bishop seconded by Councilman Barney
Shull that the Accountant be authorized to adjust records to show
that Street Improvement on Lots 5 & 6,.. Block 9, Volanta, in the
amount of 3137.36 has been paid in full and balance shown on assessment
book is in error. Motion carried.
Motion by Councilman Ed Bishop seconded by Councilman Barney Shull
that the following Resolution be adopted:
BE IT AESOLVED BY 12HE CITY COUNCIL OF THE CITY OF FAIRHOPE,
ALABAMA. that Mayor Nix be authorized to execute agreement on joint
use of poles with South Central Bell on behalf of the City of
.F!aIrhope, Alabama. Motion carried.
This being date set for opening bids on water pipe the following

Motion by Councilman Box seconded by Councilman Shull that the City
accept lowest bid on best delivery date provided bid meets specifi-
cations. Motion carried.

Motion by Councilman H. G. Bishop seconded by Councilman 011ie
Deese that City accept low bid of Foley Tractor Co. provided bid
meets specifications. Motion carried.

Motion by Councilman Barney Shull seconded by Councilman 011ie Deese
that David Stapleton be reappointed to the Recreation Board for a
five year term ending March, 1979• Motion carried.
Motion by Councilman Sam Box seconded by Councilman Barney Shull
that the Council accept Councilman H. G. Bishop's recommendations on
financing including Daphne settlement,, and that the City Attorney
be instructed to draw up necessary Resolution. Motion carried.
Motion duly made, seconded and carried that the meeting adjourn.

AN ORDINANCE.PROHIBITING PARKING BY ANY PERSON ON.THE NORTH END OF THE
CIITY'S BEACH PARK WHERE THE SHELL ROAD ENDS AND DIRT ROAD BEGINS, BEING APPROXI
MATELY'3.5 MILE FROM ITS INTERSECTION NORTH.. OF FAIRHOPE AVENUE BETWEEN THE HOUF
OF SUNDOWN AND SUNUP; AN0 ESTABLISHING A FINE AND COSTS.FOR THE SAME.
BE IT ORDAINED BY .THE CITY COUNCIL OF THE CITY OF.FAIRHOPE, ALABAMA:
SECTION I - It is herebyprohibited for any person to park North of
the City's Bayfront Park on the North.side of the.now existing shell road being
approximately,3.,5 mile North of its intersection with Fairhope Avenue in Fair -
hope, Alabama between the burs of sundown and sunrise.
SECTION fI - Any person convicted under this Ordinance shall be fined
not less than .one nor more than.$200.00 at the discretion of the Court, and
shall also be imprisoned in the County Jail for a term not exceeding six (6)
months; or by -fine and imprisonment both at the discretion of the Court trying
the Cause.
SECTION III - This Ordinance shall take effect upon its due adoption
and publication by law.
