Nix, Councilmen: David (Ed) Bishop, H. G. Bishop, Sam E. Bog, 011ie Be Deese.:and Barney L. Shull. In absence of City Clerk, Jerry Hanak acted as Clerk of the meeting. ,mutes of the prevtous regular and special meetings were approved. Motion by Councilmen Barney Shull seoonded by Councilman 011ie Deese that Ordinance # 51410 an Ordinance Amending Zoning Ordinance No: 295 by adding District B-4, introduced at the regular meeting of October 22, 1973 be adopted as introduced. Motion carried. This being date set for public hearing on rezoning from &2 to B-20 Lot 32, Block 1, Volanta, protestsbeing heard, Councilmen. Sam Box introduced the following Ordinances ORDINANCE # 515 AN ORDINANCE AMENDING SECTION i39 DISTRICT BOUNDARIES, OF ZONING ORDINANCE # 2959 by rezoning the following described property from R-2 to B-2 as recommended by the Planning and Zoning Commissions Lot 32, Block 1, Volanta 805 N. Section Street, Councilman Sam Box moved that all rules governing the council which might, unless suspended, prevent the passage and adoptlon:of=this Ordinance at this meeting, be and the same are hereby suspended for the purpose of permitting the said.ordinance to be finally passed and adopted at this meeting. Councilmen Barney Shull seconded the motion. The question -.was put before the council and on roll call the vote was as follows: Yeas Councilmen: David (Ed) Bishop, H$ G, ,-Bishop, Sam E. Boa, 011ie E. Deese and Barney L. Shull. Motion adopted by F uananimous vote. Councilman Barney Shull moved that said Ordinance #515 be finally passed and adopted as introduced. Councilman Sam Box seconded the motion. The question of final passage was put before the Council and on roll call the vote was as follows: Yeas: Councilmen: David (EI) Bishop, H. G. This being date set for public hearing on rezoning property known as Dyas property, Mr. Carlton Niemeyer, representing the property owner presented revised plans for rezoning. RESOLUTION > ., BE IT`RESOLVED BY THE CITY COUNCIL OF THE CITY OF FAIHHOPE, ALABAMA$ that'by and through Provisions of Act No. 1133 of the 1973 Regular Session of the Legislature of the State of Alabama, a Special Election be held at Ft. Riel Armory on the 18th day of Dpcember,,1973 for the purpose of ascertaining whether the Mayor. and City Council of the City of Fairhope, Phirhope, Alabama, shall by local Ordinance create a Parking Authority or Parking Committee to wh1ohq'it may delegate all authority delegated to the Mayor and City C©uncil-under the,Aet Noe 1133, with respect to the development, oreatioa, operation and -general supervision of any and all as teems related to public parking. The said Parking Committee or Parking Authority shall be composed of not less than seven nor more than thirteen members as the City Council may deoide in its Ordinance; all members shall -'be residents of the City of Fairhope and over the age of twenty-.o e i Mr* Le I. BE IT RESOLVED by the City Couaoil of the City of Fairhope, Ala_ bama `as follows: SECTION le That the Mayor of the City of Fairhope, ;Alabama,,, be and is hereby authorized, empowered and directed for andi�on,behalf of:the City Council of the City of Fairhope to execute a -service a agreement with the Alabama Power Company, a oorporatlon,�,its­-suoeessors or assigns, the terms of which are herein set out and approved 3n all things by the City Council of the City of Fairhope.
